Premesso che:
il 12 marzo 2005, il Comitato Centrale del Partito Comunista dei
Lavoratori Ungherese decise l’espulsione (per ragioni relative al
dibattito interno al partito) di Attila Vajnai, ex vicepresidente del
partito, e dei suoi sostenitori, e che alcune settimane più tardi,
il 2 aprile 2005, il Comitato Centrale convocò il 21° Congresso del
partito per il 4 giugno 2007, allo scopo di risolvere la crisi politica;
l’opposizione interna, capeggiata da Attila Vajnai, si appellò al
Tribunale di Budapest, chiedendo l’invalidazione delle risoluzioni
del Comitato Centrale del Partito Comunista dei Lavoratori Ungherese;
il Tribunale di Budapest invalidò le risoluzioni del Comitato
Centrale l’8 giugno 2005, riconfermando l’appartenenza di Vajnai e
dei suoi sostenitori al partito e a tutti gli incarichi dirigenti
ricoperti in precedenza e annullando così tutte le decisioni prese
dal partito nel 21° Congresso;
il Presidium del Partito Comunista dei Lavoratori Ungherese ha
espresso la propria opinione affermando che la sentenza è stata una
sentenza politica, che non ha precedenti nella storia legale degli
ultimi due decenni, affermando, inoltre, che essa rappresenta una
risposta vendicativa al referendum promosso dal partito contro la
privatizzazione degli ospedali, svoltosi nel 2004 con la
partecipazione di circa due milioni di elettori che hanno votato
contro la privatizzazione del sistema sanitario;
il Tribunale di Budapest ha richiesto al Presidium del partito di
ritirare immediatamente la propria opinione e di dichiarare che la
sentenza non aveva niente a che fare con la politica.
la leadership del partito ha rifiutato di farlo;
il presidente del Tribunale di Budapest ha poi deciso di chiamare
in giudizio l’intera dirigenza del partito, incriminando il Presidium
per “diffamazione pubblica”;
Considerato che:
il Partito Comunista dei Lavoratori Ungherese è convinto che
questa sentenza violi la Costituzione ungherese, precisamente
l’articolo 61 della Costituzione che concede a chiunque la libertà di
esprimere la propria opinione;
il Presidente Gyula Thurmer ed altri sei membri del Presidium,
secondo il Codice Penale Ungherese, potrebbero essere condannati ad
un massimo di due anni di carcere;
Si chiede di sapere:
se il Governo non ritenga l’accusa di “diffamazione pubblica”
rivolta al Partito Comunista dei Lavoratori Ungherese un grave atto
di violazione delle libertà e dei diritti civili e democratici in un
paese dell’Unione europea;
quali iniziative il Governo intenda adottare nei confronti del
governo ungherese affinché vengano garantiti i diritti civili e
democratici, a tutti i cittadini, internazionalmente riconosciuti.

Tomorrow Hungarian Communist leaders go to the court
Tomorrow, 21 September, Friday at 09.00 the trial against the whole
leadership of the Hungarian Communist Workers’ Party begins in the
Hungarian City Szekesfehervar. The Hungarian communists leaders are
accused in libel made in public place because the characterised a
decision of the Budapest Court in 2005 as a political sentence.
The leaders of the Hungarian communists confirmed 20 September in a
public statement they had not violated the Hungarian Constitution or
any Hungarian laws. According to the Constitution all citizens have
the right to express their opinion freely.
They underlined that different Hungarian organisations, political
parties and individuals made similar public statements about the
Hungarian courts in recent years but nobody, no other party have been
accused and taken to the court.
The Presidium of the HCWP emphasized that this process will take in
such a situation when extreme-right organisations have no obstacle to
organise demonstrative meetings in Hungary, and when the extreme-
right Hungarian Guard marches in its SS-like uniforms in Buda Castle.
The Hungarian government speaks about extreme-right and fascist
danger but it is the Communist Party to be accused.
The Presidium of the HCWP confirmed that now the Hungarian state is
attempting to use these fallacious grounds to cripple and potentially
liquidate the HCWP precisely at a time when the left and Communist
movement is growing once again in Hungary.
Gyula Thurmer, president of HCWP emphasized that the Hungarian
communists continue their fight against capitalism, for the rights of
working people and no political and financial pressure, no legal
processes can force them to give their struggle.
Gyula Thurmer, president of the HCWP informed that a lot of communist
and workers’ parties expressed their solidarity, among others the
communists of Italy, Belarus, Austria, Czech Republic, Russian
Federation, Cuba, Laos, Germany, Argentina, Chile, Romania, Spain,
Italy, Slovakia, Greece, Ukraine, Sweden, Denmark, Finland. Many
youth organisations joined the protests, including the Communist
Youth Organisation of the Czech Republic, many youths organisation
from Canada, Britain. The representatives of the World Federation of
Democratic Youth will join the solidarity meeting in front of the
Szekesfehervar Court.
There will be demonstration in front of the Hungarian embassies among
others in London, Berlin. Many parties and organisations informed
that they are going to organise protest meetings after 21 September.
Some parties organise international press conferences in their
capitals, and invite the representatives of the Hungarian communists
to be present there. The legal cause against the Hungarian communists
is a part of the anticommunist campaign in Europe and we should fight
together.
All communist parties condemned this transparent manoeuvre of the
Hungarian authorities as a vengeful assault against the Hungarian
Communists, and called for international solidarity in defence of the
legal and political rights of the HWCP. They demanded the Hungarian
authorities to guarantee the constitutional rights of all citizens,
in this case to guarantee the freedom of opinion and expression and
the freedom of association and to organize.
The HCWP will inform all communist and workers’ parties about the
coming events.

In the Szekesfehervar City Court (Hungary, 68 km from Budapest) the
process
against the whole leadership of the Hungarian Communist Workers’ Party
started 21 September, Friday. The Court led by judge Mrs. Ilona Sarkozi
gathered to discuss the cause of Gyula Thürmer, President of the
HCWP, Magda
Karacs and Janos Vajda, vice-presidents of the HCWP, Peter Szekely,
Laszlo
Kerezsi, Sandor Urban, members of the presidium of HCWP and Pal Kollat,
former member of the presidium of HCWP.
The public prosecutor read the official indictment. According to the
indictment the members of the leadership of the HCWP are accused “in
libel
made in public place” because they characterised a decision of the
Budapest
Court in 2005 as a political sentence.
The members of the leadership of the HCWP were questioned by the
judge. The
Hungarian communist leaders declared that it is their right
guaranteed by
the Hungarian Constitution to express their opinion freely. They used
this
right when they characterised the decision of the Budapest City Court
as a
political one. They asked the Court to finish the legal process and
to clear
them of the charge because no crime was committed.
The judge decided to postpone the session of the Court on the 6 November
2007.
In front of the City Court hundreds of communists and inhabitants of
Szekesfehervar had a meeting of protest and solidarity. The Hungarian
media
paid great attention to the event.
We have fulfilled the mission the party has sent us to the court. –
Gyula
Thürmer declared on the press-conference after the process. We
defended our
rights and unveiled that the ruling capitalist forces try to destroy the
communist party before the new referendum and parliamentary elections
which
can take place in the near future. He declared that it rather
embarrassing
that the second session will take place 6 November, just on the eve
of the
great day of the Hungarian and the international communist movement, the
90th Anniversary of the October Revolution.
