Međunаrodni krivični sud (MKS) izdаo je nаlog za hapšenje Moаmerа Gadafija, predsjednika Libije, okrivljujući gа zа "nelegitimno hаpšenje ljudi " i za "ubistvа člаnovа opozicije" koji se protive libijskoj vladi, od februаrа ove godine. Još jednom, MKS dolаzi dа se dokаže kаo smiješnа mаrionetа imperijаlističkog poretkа, čiji je jedini cilj dа legitimiše imperijаlističke intervencije.
Od velikog je znаčаjа dа se podsjetimo još jednom dа ovаj sud ne sudi аmeričkim vojnicimа ili zločinima počinjenim od strаne SAD-a i od osnivanja, nikаdа nije rekao ni riječ protiv bezbrojnih zločina NATO-а ili bilo koje druge imperijаlističke koаlicije ili intervencije.
Svjetska Federacija Demokratske Omladine ne priznаje MKS kao autoritet da okrivljuje bilo koga za bilo šta. Tokom posljednjih godinа, ovаj tаkozvаni "sud", nikаdа nije govorio o ubistvima koja su izvršili imperijаlistički kriminаlаci i njihovi sаveznici u Libiji, Avgаnistаnu, Irаku, Pаlestini, Zаpаdnoj Sаhаri, Bаhreinu, Jemenu, Tunisu i Egiptu (dа pomenemo sаmo nekoliko) i uvijek je stаjаo nа strаni okupаtorа, bombаrderа i diktаtorа. Njegovа ulogа je dа doprinese pljаčkama i ubistvima koje imperijаlizаm širi po svetu sа svojim stаlnim rаtovimа i konfliktimа.
Motivаcijа imperijаlizmа dа bombаrduje i nаpаda Libiju nikаdа nije bio i nije Gаdаfi ili bilo kakva licemjerna odbrana ljudskih prava. Imperijаlizаm je nаoružаo pobunjeničke snаge, bombаrdovаo i nаpаo Libiju i ubijao nevin libijski narod kako bi krenuo u pohod na ogromne rezerve nаfte i dа bi instаlirаo u toj oblаsti još jedаn ogromаn vojni kompleks koji će stvoriti bolje uslove zа svаku novu intervenciju.
Ovom prilikom, WFDY pozivа sve svoje članove dа osude ovаj novi tаlаs propаgаnde kаo dio kontinuirаnog nаporа kojeg činimo zа hitаn prekid rаtа protiv Libije, tаko dа libijski narod sam može da riješi svoje probleme , kаo i u svаkoj drugoj suverenoj držаvi.

The International Criminal Court (ICC) has issued a capture warrant Muammar Khadafi, president of Libya, blaming him for the “illegitimate arresting of
people” and “murders of opposition members” standing against the Libyan government, both done since last February.
Once again, the ICC comes to prove itself as a ridiculous puppet of the imperialist order, whose only purpose is to legitimate the imperialist interventions.
It is of high importance to remind, once again, that this court does not judge American soldiers or crimes done by the US and, since it exists, never it has taken even a word against the countless crimes of NATO or any other imperialist coalition or intervention.
WFDY does not recognize to the ICC even a drop of authority to blame or find guilty anyone for anything. Over the last years, this so-called “court”, has never even spoken about the killing done by imperialist criminals and their allies in Libya, Afghanistan, Iraq, Palestine, Western Sahara, Bahrain, Yemen, Tunisia and Egypt (just to mention a few) and always stood by the side of the occupiers, the bombers and the dictators. Its role is to contribute to the pillage and murder that imperialism spreads around the world with its constant wars and conflicts.
The motivation of imperialism to bombard and invade Libya was never and is not Khadafi or any hypocrite defense of the human rights. Imperialism has armed rebel forces, bombed and invaded Libya and killed innocent Libyan people to go after the Libyan immense reserves of oil and to be able to install in that area another huge military compound that will create better conditions for any new interventions.
On this occasion, WFDY calls upon all its member organizations to denounce this new wave of propaganda as part of the continuous efforts we are making for the immediate end of the war against Libya, so that it can be the Libyan people to solve their own issues, as in any other sovereign country.

A mesi di distanza dall'inizio della guerra in Libia, le chiedo: che storia è questa?
«È una storia che si può guardare da molti lati, e comunque la si analizzi resta sempre una brutta storia. Perché è vero che c'è stata una risoluzione, la 1973, del Consiglio di Sicurezza dell'Onu che autorizzava l'attacco alla Libia di Gheddafi, ma poi questa facoltà è stata sicuramente snaturata, nel senso che ciò che si sta cercando di fare in tutti i modi è assassinare Gheddafi. Ormai nessuno tace su questa ipotesi. Gli stessi rappresentanti della Nato ammettono che se il Colonnello viene colpito e fatto fuori è ancora meglio È quindi una guerra strana ».
Strana perché?
«Perché in realtà la Francia ha un suo obiettivo, l'Italia un altro e gli Stati Uniti un altro ancora. Ma in definitiva nessuno sa come uscirne. E' una guerra nata sotto una cattiva informazione e continua ad essere corredata da storie inverosimili, da veri falsi. Amnesty International è stata sia a Tripoli che a Bengasi, e ha documentato che le torture sono state fatte in modo particolare a Bengasi su presunti mercenari che non erano altro che poveri migranti africani provenienti dal Sahara».
Ma qual è a suo avviso l'obiettivo dell'Italia?
«L'obiettivo dell'Italia è il più strano. Perché in realtà noi siamo entrati in guerra controvoglia. Da principio davamo soltanto le nostre basi, poi abbiamo messo a disposizione un certo numero di aerei, e soltanto in un secondo tempo è arrivato l'ordine di sparare. Oggi si dice che il 30 per cento delle missioni le fa l'Italia. Ed è veramente un controsenso perché noi dovevamo restare estranei a questa guerra, così come ha fatto la Germania di Angela Merkel. E noi avevamo ancora più motivi della Germania ».
Quali?
«Primo: la Costituzione italiana all'articolo 11 ci proibisce di entrare in guerra. Secondo: soltanto tre anni fa abbiamo firmato un trattato di amicizia e cooperazione con Tripoli. E anche se di recente abbiamo di fatto annullato questo accordo, in realtà è un atto che non si può cancellare se non viene fatto contemporaneamente dalle due parti. Per finire, con la nostra aggressione ad uno Stato sovrano, noi facciamo un balzo indietro di 100 anni, a quando attaccammo Tripoli nel 1911, in una atmosfera coloniale che oggi si ripete in maniera straordinaria, tragicamente straordinaria».
Quali scenari possibili nel futuro immediato?
«Le opzioni sono tutte legate alla sorte di Gheddafi. Gheddafi ha tre possibilità: quella di fuggire dal Paese, ma non è nella sua storia mitizzata; può lasciare la Libia dopo trattative, ma non vedo in queste ultime settimane trattative consistenti. E infine, l'ultima possibilità, quella che lui sembra, in un certo senso, invocare: morire da martire nella sua Tripoli. L'ultima sua dichiarazione in un qualche modo evoca proprio questa fine, quando Gheddafi dice ho le spalle al muro . Per quanto mi riguarda, come biografo di Gheddafi, spero che non sia questo il suo ultimo destino, ma temo che questa guerra finirà proprio con un assassinio».
Quale Libia sta nascendo sulle macerie del regime di Gheddafi?
«Nel dopo-Gheddafi si parla di mandare un centinaio di osservatori e poi anche alcune migliaia di soldati, turchi si suppone, per mantenere quel minimo di tranquillità dopo la guerra. Queste sono le ipotesi formulate in ambito Nato. Io invece prevedo un terribile caos nella Libia di domani, una somalizzazione dell'intero Paese. Vi saranno molte vendette consumate, e poi bisogna vedere che cosa accadrà sul piano delle speculazioni, perché non credo proprio che Sarkozy abbia puntato tutto sulla guerra solo per guadagnare qualche punto sul piano elettorale. Penso che ci saranno molti interessi petroliferi in gioco e a farne le spese di questo cambiamento sarà sicuramente l'Italia».
Mentre parliamo, la tv di Stato libica ha denunciato una strage di civili a Brega a seguito di un raid aereo Nato. L'Alleanza nega...
«Non è la prima volta che Bruxelles nega ma i morti civili ci sono, proprio i civili che andavano protetti...». Non esistono dunque bombe «intelligenti»... «In questa guerra di intelligente non c'è niente, non solo le bombe. Penso anche a dichiarazioni di autorevoli capi militari della Nato che ammettono che il bersaglio principale è Gheddafi».
French lawyers sue Sarkozy over crimes against humanity in Libya

Two high-profile French lawyers, Jacques Vergès and former Socialist Party minister Roland Dumas, have announced that they plan to sue French president Nicolas Sarkozy on charges of crimes against humanity committed in the on-going NATO military intervention in Libya. They are acting for some thirty Libyan families who have lost family members in the NATO bombings.
At a press conference May 29 in Libya they declared that they would initiate legal proceedings in the French courts on Monday, May 30. There has been an almost complete blackout of the announcement in the French media. Only the Socialist Party-leaning newsweekly Marianne commented, attacking Dumas and Vergès for “a grotesque accusation against the president of the Republic.”
At a press conference in Libya on Sunday Dumas said, referring to the NATO bombing, “this mission, which is supposed to protect civilians, is in the process of killing them.” He said the war in Libya was “a brutal aggression against a sovereign nation.”
Calling the NATO alliance nations “murderers”, Vergès denounced “a French state led by thugs and murderers ... We intend to break the wall of silence.” He said he had seen several civilian victims at a hospital and had been told by one of its doctors that there were as many as 20,000 victims.
Dumas said he was ready to take the defense of Gaddafi himself if he was to appear at the International Criminal Court (ICC) at The Hague. On May 16, acting at the behest of the major Western powers, the ICC prosecutor requested an arrest warrant for crimes against humanity against Gaddafi.
Dumas questioned the authority of Sarkozy and NATO to conduct bombing based on UN Security Council Resolution 1973, calling it “the artificial—very artificial—cover of the United Nations.”
The lawsuit comes at a time when the NATO allies have stated that the war will be extended for at least 90 days, until September, and when Britain and France have announced the stepping up of the military bombardments, which have already involved several attempts at targeted political assassination through the bombing of homes of Libyan leader Muammar Gaddafi’s family.
British ex-SAS elite troops and other mercenaries employed by NATO are helping identify targets in the Libyan port city of Misrata, They are there with the blessing of Britain, France and other NATO countries, which have supplied them with communications equipment. They are likely to be providing information for the pilots of newly deployed British and French attack helicopters.
The French government was the main protagonist of United Nations Security Council Resolution 1973, a flimsy legal cover for the naked neo-colonial, imperialist intervention supposedly to protect civilians from the Libyan armed forces. In reality, it is part of the scramble for Libya’s oil and gas resources and the imposition of a pliant pro-imperialist government being assembled and groomed in Benghazi.
Other lawyers acting for Aïcha Gaddafi, the daughter of the Libyan leader Muammar Gaddafi, have reportedly filed charges against NATO in a Belgian court. They declared, “The decision to target a civilian home in Tripoli constitutes a war crime.”
The charge concerns a NATO air raid on April 30 that killed Gaddafi’s youngest son and three of his infant grandchildren. The two lawyers are also suing for the annulment of the EU ministers’ decision to freeze the accounts of the Libyan regime in the European Court of Justice in Luxembourg.
It is not clear whether the octogenarian Vergès and Dumas, with long and close ties to the French state, are directly working with sections of the French state but certainly serious doubts have emerged in French ruling circles on Sarkozy’s decision to embark on the military intervention in Libya.
The TTU defense information web site commented on an unpublished 50-page report issued after a three-week visit to Libya by intelligence experts headed by Yves Bonnet, former chief of the French national intelligence agency, the DST. According to the TTU site, the intervention is overstepping resolution 1973 and “the control of energy resources is at the heart of the current strategy. The US would like to overthrow Gaddafi in order to kick China out of the country. Egypt, which has never accepted the attachment of Cyrenaica and its oil reserves to Tripoli, can see nothing but advantages from the partitions of the country.”
The site adds: “The report expresses alarm at this ‘thoughtless’ involvement by Paris, which plays into the hands of the American administration, which has taken care not to show its hand and let France take all the risks.” It expresses serious doubts as to whether the Benghazi transitional council could “preserve the interests of the powers involved,” implying most especially those of French imperialism.
The military commentator Jacques Borde has also suggested that, while France is futilely overreaching its military capacities, its Arab and Western allies will be reaping the rewards in terms of the share-out of the spoils. There is also the danger of the “Somalisation” of Libya – that is its disintegration into warring tribes and warlords.
The two aging lawyers have long political and legal histories. Dumas, born 1922, was a close collaborator of François Mitterrand, Socialist Party (PS) president of France from 1981 to 1995, and served as a minister in several PS governments. He has never been a policy-maker, but rather a trusted errand boy for the executive.
He was part of the corrupt relations of French imperialism with African governments known as Françafrique. In 1983 he was Mitterrand’s special envoy to Gaddafi. His task was to persuade Libya not to invade Chad in support of a rebellion in the north of the country against the pro-French government. Finally, with the complicity of Gaddafi, the government was kept in power thanks to France’s intervention.
In 1995 Dumas was nominated President of the Constitutional Council, the French constitutional court, by Mitterrand. He resigned in January 1999 because of the Elf corruption affair.
Vergès was born in 1925 of a Vietnamese mother and a Réunionese father. Among the most famous legal defenses he carried out were that of the terrorist Carlos “the Jackal” and the Nazi war criminal Klaus Barbie, “the butcher of Lyon” in occupied France. He accused French imperialism of committing similar crimes in Algeria to those of the Nazis.
Dumas has admitted that he and Vergès were approached by the Gaddafi régime to take the case. Whatever their motivations, however, there is no doubt that the indictment they are making of French and Western imperialism’s criminal action against the Libyan people is a source of some embarrassment for the Sarkozy government and its imperialist allies. So it is also for the PS, the PCF, and the fake lefts of the NPA in France, who have peddled the lie that the intervention is “humanitarian” and designed to protect the Libyan people.
