Constitutional charter of Serbia and Montenegro
ONE STEP BACK - TWO FORWARDS

Yugoslavia is now facing the grave of her vanishment. She
is frequently advised to take a step back and than two steps
forward.

The project of the Constitutional (?) charter is certainly a
step back. The whole world knows that it is only a
temporary arrangement invented by the US and EU to
delay the secession of Montenegro. Because they still did
not make up their minds about how to finish off former
Yugoslavia. Secession of Montenegro does not suit them
since secession of Kosovo and Metohija would follow in
order to create Great Albania. That would cause serious
difficulties inside NATO, in Greece and the FYR of
Macedonia. The presently NATO occupied southern part
of the western Balkans would in that case definitely turn
into the shithouse of Europe. Therefore they took a time
out of three years both in case of Kosovo and Montenegro.

The Charter has since the very beginning been constructed
so that it should not be able to function, but to legitimize
the already high degree of unconstitutional separation of
Montenegro. It is aimed in advance to legitimize the
secession of Montenegro after three years.

The charter has many built-in misconceptions which will
disable the functioning of the economies of the associated
states.

The Charter envisages separate economic systems of the
two states and only an undefined degree of their
harmonization. The two economies have two different
national currencies, two central banks, two customs tariffs
and revenue authorities, separate fiscal systems.

The Charter envisages a common market but makes its
functioning impossible. A common market can not exist if
there is no customs union (a single customs area, a single
tariff and common customs revenue). Having their own
custom areas, Serbia and Montenegro are not in a
common market but only in a free trade zone. Within such
a zone there is free movement of goods only for the
products made in Serbia and Montenegro. Such free trade
zones already exist between Yugoslavia and: Bosnia-
Herzegovina, Russia and Hungary although there is no
association between the states. In order to prevent the
smuggling of goods from third countries through Serbia
and Montenegro, between them there will have to be a
customs border where certificates of origin will be
presented. Only goods produced in Serbia and Montenegro
may cross the border customs free.

It is strange that intermediaries from the EU tolerate such
a misuse of the concept of the common market. The EU
countries defined it clearly some fifty years ago in the
treaty of Rome. They achieved it ahead of time. After that
they moved from common market to single market,
economic and monetary union. For two years they are
preparing their Constitution, not an association charter!

The principles of the Serbia- Montenegro association
agreement increase confusion by envisaging free
movememnt of capital. Since there are two different non-
convertible currencies (in respect of capital transactions)
and separate financial markets (Montenegro already has
its separate Securities Commission), it is clear that there
can not be fully free movement of capital like in a single
country. Securities denominated in foreign currency are
foreign securities, their movement is flow of foreign
capital. That is in any country regulated by the law on
foreign exchange and convertibility does not apply to
capital transactions. Anyway, it is inconceivable that the
euro from Montenegro could be treated in Serbia
differently than the euro from its countries of origin!

At the time countries of EU abandoned their own
currencies and intoduced the euro, one of the main
justifications was: one market - one money! The fact that
the EU now supports a meaningless construction involving
one market with two currencies only proves that the EU
acknowledges that Serbia and Montenegro are not a single
market and even less a single state!

The association charter envisages a single membeship of
Serbia and Montenegro in international monetary and
financial institutions but actually it prevents that.
According to their Articles of Agreement, in the IMF and
the IBRD each country is represented by the governor of
the Central bank and the minister of finance, respectively.
The association of Serbia and Montenegro does not have
any of them. It is also unlikely hat the IMF and the IBRD
would be going to adjust their Articles of Agreement to
this strange situation.

The fact that the association of Serbia and Montenegro
does not have its own property (except for some buildings
of the administration) nor foreign exchange reserves or
state budget, will greatly hinder their access to
international financial markets. That is because there is no
collateral to be supplied. Without a state budget, a central
bank and foreign exchange reserves, the association of
Serbia and Montenegro cannot have credibility in servicing
foreign debt.

Without the mentioned necessary conditions, potential
foreign investors cannot know who is going to guarantee
their rights. According to the Charter, that is not even
envisaged!

Without a central bank and ministry of finance with a
state budget with own revenues, there are no instruments
of monetary and fiscal policy. Without them there cannot
be a macroeconomic policy of Serbia and Montenegro.

Anyway, there will not be other necessary segments of
macroeconomic policies either. It only seems as if two
ministers of the Council of ministers had any relation to
the economy. The Charter envisages that the minister od
foreign economic relations is responsible for negotiating
and coordinating the implementation of international
agreements, including those with the EU. He may act only
after consultations with the relevant ministers of the states
of Serbia and Montenegro! There is no prerogative for him
to propose laws regulating international economic
activities of the economy.

The minister for domestic economic affairs also only
coordinates the harmonization of the separate economic
systems of the two states, but he does in no way carry out
any economic policies or proposes legislation.

It is clear that there is not going to be any legislation
concerning the economy of Serbia and Montenegro, like a
company law, foreign exchange law, laws on taxation,
banking, securities and financial markets.

After all it is a legitimate question to ask; what kind of a
state is an entity which has no name of its own, no
property, no single economic area, no national currency, no
central bank, no state budget and no economic and
development policies?

The answer is: it is no state!

Za obele?avanje ?etvrte godisnjice po?etka NATO agresije na
Jugoslaviju

Beogradski forum za svet ravnopravnih podse?a gradjane Srbije i
Crne Gore i svetsku javnost da se 24. marta 2003. godine navrsava 4
godine od po?etka agresije NATO pakta na Jugoslaviju. Tog dana,
na osnovu isfabrikovanih optu?bi zarad strateskih vojnih, politi?kih i
ekonomskih interesa, NATO pakt predvodjen SAD-om, zapo?eo je
78-dnevno bombardovanje Jugoslavije.
Poga?ena je Povelja UN, prekrseni su principi medjunarodnog prava
uopste i napravljen opasan presedan za upotrebu sile bez saglasnosti
Saveta bezbednosti UN. U napadu NATO je stupio u Savez sa
teroristi?kom "OVK" koja je povezana sa "Al Kaidom", ?ime je
ohrabrio terorizam na Balkanu, u Evropi i na globalnom planu.
Agresija NATO je izazvla nemerljive ljudske ?rtve i patnje, ogromna
razaranja i trajno ugrozila ?ovekovu prirodnu okolinu. NATO je
podstakao dalje nasilno menjane granica i stvorio dugoro?no krizno
?ariste na evropskom tlu. Politi?ari i lideri NATO nose odgovornost
za humanitarne, ekonomske, ekoloske i strateske poreme?aje ?ije se
posledice prenose izvan Evrope i u tre?i milenijum.
Nakon bombardovanja i okupacije Avganistana, SAD sa Velikom
Britanijom pripremaju napad na Irak, i druge zemlje. Cilj napada na
Irak nije unistavanje oru?ja za masovno unistavanje, ve? nasilno
rusenje postoje?e vlasti i stavljanje pod kontrolu njegovih rezervi u
nafti. NATO, na ?elu sa SAD, upravlja globalnim medijskim
sistemima preko kojih je skrivao prave razloge agresije na
Jugoslaviju 1999. godine, a metod obmane svetske javnosti
primenjuje i sada pripremaju?i napad na Irak.
Danas, kada bivsi generalni sekretar NATO, odgovoran za po?etak
agresije NATO na Jugoslaviju, Havijer Solana, ukida Jugoslaviju i
svaku zajedni?ku dr?avu Srbije i Crne Gore, i obi?nim ljudima
postaju jasni pravi razlozi agresije 1999. godine: drobljenje ugledne
evropske dr?ave i lisavanje njenog naroda najva?nijeg oslonca
postojanja i razvoja. U Beogradu niko ne brine o proizvodnji, otkazi
su masovni, milion ipo ljudi je bez posla, 750 hiljada je izbeglica i
raseljenih lica. Pod zastitom vlasti i njihovih stranih patrona odvija
se grab?` nacionalnih i prirodnih bogatstava. Paralelno, vesina
medija, kulturne i obrazovne institucije su pod pritiskom da realizuju
program duhovnog i kulturnog razaranja naroda. One institucije koje to
ne prihvataju bivaju nasilno izopstene i lisene zakonskih prava na
prihode iz bud?eta.
Beogradski forum za svet ravnopravnih poziva sve slobodoljubive
snage Srbije i Crne Gore, Balkana, Evrope i sveta da se anga?uju u
oble?avanju 24. marta dana kada je zlo imperijalizma pokazalo svoje
pravo lice i namere.
Pozivamo lidere svih verskih zajednica - Srpske pravoslavne crkve,
Rimokatoli?ke crkve, muslimanske zajednice, jevrejske zajednice i
drugih, zatim, politi?ke partije, institucije i patriotska udru?enja
gradjana, sve one pojedince i gradjane da odaju du?nu po?ast
poginulima u tom strasnom zlo?inu protiv Jugoslavije i njenog naroda.

Da se ne zaboravi, ali i da se nikad i nigde vise ne ponovi.
Podignimo svoj glas, odajmo po?ast ?rtvama i uputimo javnu poruku
da se ne mirimo sa poni?avanjem, neravnopravnos?u i socijalnom
bedom. Recimo jasno da smo ponosni nacionalnom kulturom,
istorijom i doprinosom Evropi.
Budu?nost planete nije u bombama i sili, ve? u ravnopravnosti,
samopostovanju i saradnji.
Beogradski forum za svet ravnopravnih ?e ovaj datum obele?iti
okruglim stolom o posledicama agresije NATO pakta koji ?e se
odr?ati u subotu, 22. marta 2003. godine, na Pravnom fakultetu,
Amfiteatar VI, sa po?etkom u 11:00 ?asova. Forum poziva nau?nike,
stru?njake, afirmisane analiti?are iz zemlje i inostranstva da
prisustvuju i u?estvuju na tom okruglom stolu.

NATO WAR CRIMES IN YUGOSLAVIA

Slobodan Milosevic is on trial for crimes against humanity, genocide
and war crimes. However, Pravda.Ru remembers the crimes perpetrated
by NATO in its illegal campaign against Yugoslavia in 1999. We cite
the ?collateral damage? from just two months of this 73-day campaign.

5th April - Aleksicac, mining city. A precision weapon, a laser-
guided bomb, kills 17 civilians as it misses its target, smashing
into houses.

9th April - Pristina, Kosovo. Civilian houses destroyed with
unconfirmed loss of life as a bombing misses its target, a
communications centre.

12th April - Grdelicka Klisura. 55 civilians murdered by a NATO
strafing attack on a bridge as a crowded passenger train was passing.

14th April - Djakovica, more civilian passenger trains bombed. 75
civilians murdered.

28th April - Surdulica, residential area bombed. Unconfirmed number
of deaths, but huge losses of property. The victims are still waiting
to be paid.

1st May - Luzane, Kosovo. Another bombing raid on a bridge as a
passenger bus was crossing. 47 civilians were murdered in this
attack.

7th May - Nis. In full daylight, the city centre, crowded with
civilians carrying out their shopping, was strafed by NATO military
aircraft. Unconfirmed number of deaths, damage to property severe.
The victims have yet to receive compensation.

13th May - Korisa, Kosovo. An Albanian village is inexplicably
targeted by NATO warplanes. 87 civilians murdered.

20th May - Precision bomb dropped on Belgrade strikes the Dragisa
Misovic hospital in Dedinja, murdering patients.

21st May - Istok, Northern Kosovo. A prison is bombed, murdering at
least 100 inmates.

22nd May - Kosare, Kosovo. NATO inexplicable bombs a UCK position on
the Albanian border. Unconfirmed number of deaths.

30th May - Varvarin, another bridge strafed while civilians were
crossing. Unconfirmed number of deaths.

31st May - Surdulica, sanatorium targeted. 20 senior citizens
murdered.

31st May - Precision bombs launched at Novi Pazar murder 23 civilians
as they destroy a residential area.

Carla del Ponte does Mr. Milosevic a favour by pursuing this case. It
will give him the opportunity to open up many wounds and speak out,
exposing some embarrassing new truths about how the international
community handled the Balkans crisis.

As the ex-President of Yugoslavia pulls the punches, and the truth is
revealed, Carla del Ponte will wonder why she ever launched her
vindictive crusade against the Serbs.

LARGE UNEXPLODED BOMBS AT 40 LOCATIONS ACROSS SERBIA

NOVI SAD, Feb 3 (Tanjug) - Director of the center for removing mines
and other unexploded devices Petar Mihajlovic told the Novi Sad
Dnevnik newspaper, in an interview released on Monday, that at 40
locations across Serbia there are still large unexploded aircraft
bombs, left over from NATO's bombing in 1999. Most of them are in
Belgrade, and there are also some in Novi Sad, at 9 locations in the
rivers Danube and Sava, Mihajlovic specified. The international
foundation for mine clearance and aid to victims of mines, he said,
has accepted to finance the removal of aircraft bombs in Belgrade with
200,000 euros and has set aside 240,000 euros for the first phase of
clearing cluster bombs from the airport in Nis. For sounding the bed
of the Danube for left over missiles in the Novi Sad area, according
to the manager of the project for clearing the Danube of the Belgrade
firm PMC engineering, Dragomir Gavrilovic, are needed about 600,000
euros. "It is absolutely necessary to sound five more kilometers of
the Danube bed, Gavrilovic told the Novi Sad Dnevnik newspaper.
