Dopo anni di dispute sui dettagli, la Romania e la Bulgaria si sono
accordate sulla
Localizzazione di un nuovo ponte da costruire sul Danubio. Ora l'Unione
Europea (EU) può completamente
sviluppare il corridoio IV: un grande progetto di infrastruttura che
collega

Europe's Dirty Secret

I've hesitated to weigh in on this issue for fear that my ethnic
background might leave me open to the suspicion of "special pleading."
But this issue has to be met head on.

To someone outside of Europe or not of European ancestry, all Europeans
must appear homogeneous. Similarly, Europeans and North Americans are
often shocked when they learn of the extensive ethnic and cultural
diversity that obtains in Asia, Africa and the Middle East, as those
areas are presented in the West as stereotyped and monolithic. In fact
Europe is and has always been divided in a number of ways: Language
groups, different branches of Christianity, social class, ethnic
pluralism within nations, with certain groups historically disadvantaged
(Celts, Basques, Romany, etc.), and - perhaps most demonstrably - by
geographic divide. North vs. South and West vs. East are the major
cleavages.

Anti-Slavic prejudice - more properly, racism - is a dirty secret in
European history.

It reached its most monstrous level of refinement with Hitler, who both
'scientifically' codified and savagely implemented this prevailing view
of Slavs as Untermenschen - subhumans. Fifty million human beings lost
their lives in World War Two, the majority of them Slavs. Estimates of
Soviet dead, which include Jews, Roma and other non-Slav minorities, but
which were overwhelmingly Slavic, range as high as thirty million.
Additionally, millions of Serbs, Poles and other Slavs were killed in
battle or along with Jews and others in death camps.

Every action has its rationale and every policy its doctrine. Had
anti-Slavic (and related anti-Eastern - that is, anti-Romanian, Greek,
etc.) bigotry not been allowed to simmer in Europe for centuries, it
wouldn't have been as easy to exterminate tens of millions of Eastern
Europeans as it was for the Third Reich.

A resumption, an hysterical revival, of this racism has been dredged up
since the beginning of the break up of Yugoslavia in 1991. Often the
pronouncements of Western government and media spokespeople are a barely
disguised recycling of Nazi race propaganda from the 1930s and 40s. As
one British journalist put it a few months ago, this campaign of
collective dehumanization (another trick infamously practiced by Hitler,
Rosenberg, Goebbels and company) has led to the word Slav being
synonymous with criminal. Or subhuman. Or inherently (read: racially)
inferior, lazy, dishonest, violent people who deserve all the misery,
disease, bombing and eventual physical elimination NATO and IMF/World
Bank policies have brought on them.

When the life expectancy of a Russian male (one current estimate is 56
years) is lower than that in most 'official' Third World countries; when
Romanians, Bulgarians and others are eating out of garbage cans and
sleeping in sewers; when 1.2 million ethnic Serbs are driven out of
their homes and living destitute in Serbia proper, consituting the
largest mass scale refugee crisis in Europe since World War II and its
aftermath; when all this is occurring and nobody in the West says
ANYTHING about it, except to callously and contemptuously blame the
victims - it's time for all people of good will to oppose the
ethnopsychological (that is, racist) and other propaganda devices use to
perpetrate and excuse this travesty.

T.V. and Alida Weber and 'Stormie' Leporte (who by the way runs a superb
Web site: http://www.abolishnato.com ) have performed an indispensible
service by analyzing and exposing this campaign of racial dehumanization
and persecution.

Lastly, it's not a matter of contrasting one group's tragedy with
another's, but of learning from many experiences to recognize a current
catastrophe. The Roman poet Virgil has a line that says, "Taught by
misfortune, I pity the suffering." United by our horror at past acts of
racial stereotypng and persecution, we can condemn it whenever it
occurs.

One point of information. The D-Day invasion didn't occur until Spring
of 1944. By that time the Soviet Union and numerous Eastern European
partisan groups (Serbian, Greek and others) had been holding off and
driving out the overwhelming bulk of Axis troops for over two and a half
years. They, more than anyone else, saved the world from fascism. They
deserve far more consideration and gratitude than they've ever received
from the Western nations who, with the exception of Britain in Europe,
didn't even put up a decent fight against Hitler.

There are five sectors in Kosovo:

- the south, incl. cities of Prizren (2nd largest in Kosovo, some
10,000 Serbs ethnically cleansed from there since "liberation") and
Djakovica, is under the German formal control.

- the west (region we call "Metohija", pronounced cca Me-to-khia),
with
the city of Pec, with its 20,000+ Serbs cleansed (Pec is 3rd largest in
Kosovo) and the old Pec Patriarchy of
Serbian Orthodox Church, is the so-called Italian zone.

- the central part is occupied by the British. This part includes
Kosovo's capital, Pristina, from where 40,000 Serbs and another 20,000
non_Albanians were cleansed.

- the east sector is under the US control/occupation. It includes
towns
Gnjilane (a place where a lot of trouble happened after "liberation",
even
though not a single person got killed prior to March 24, 1999) and
Kosovska Kamenica. This sector is the closest to Bujanovac and Presevo,
municipalities outside of Kosov where the KLA is stirring up the trouble
lately. This is also where the US is building one of their largest
military bases outside of the US.

- finally, NORTH sector is under the French control. This sector
includes a couple of municipalities that maintained its local Serbian
majority (Leposavic, Zvecani, Zubin Potok) and also includes Kosovska
Mitrovica, with the river Ibar dividing its north part (where the Serbs
are still hanging on) and its south part (thoroughly cleansed of nearly
10,000 Serbs, many Roma and Slavic Muslims).

The Russian troops are divided among the German, American and (to the
best of my recollection) British sectors.

Medal of Honor history - Staff Sergeant James Leroy
Bondsteel, Vietnam

Staff Sergeant James Leroy Bondsteel first joined the
HQ and HQ Co, 1st Brig, 1st ID, in Vietnam in Oct.
1967.

SSG. James L. Bondsteel had already distinguished
himself as a soldier of the highest caliber when he
was awarded the Soldier’s Medal.

>From the morning of 23 May through the night of 24
May, elements of the 2nd Bn [Mech], 2nd Inf clashed
with the 141st Reg, 7th NVA Div. A Co had been
"scrambled" with the mission to proceed to Minh Duc as
a Ready Reaction Force with the Recon Platoon of the
2nd Bn. A Co’s infantry dismounted and broke out of
the bamboo. The infantrymen received intense fire from
a bunker complex well fortified and concealed behind
large berms. Armored personnel carriers had to push
almost on top of the bunkers to chop into them with
the fire of fifty caliber machineguns, which enabled
the infantry to maneuver and neutralize the enemy
strongholds with fragmentation grenades.

SSG Bondsteel was serving as platoon sergeant with Co
A. He organized the men of his platoon and spearheaded
the attack by destroying four enemy bunkers. He then
raced some 200 meters to rally an adjoining platoon
and assist their wounded. SSG Bondsteel then returned
with munitions to his own sector and destroyed four
bunkers and a machinegun which had threatened his
platoon. Although painfully wounded by a grenade, he
refused medical attention and continued to neutralize
two more bunkers. While searching one of these
emplacements he narrowly escaped death when an enemy
soldier detonated a hand grenade at close range. SSG
Bondsteel then ran to the aid of a severely wounded
officer and struck down an enemy soldier who was
threatening the officer’s life. SSG Bondsteel then
continued to lead his men through the entrenched enemy
until his company was relieved. His personal courage
throughout the 4-hour battle ensured the success of
his unit, and resulted in the saving of numerous
lives. By individual acts of bravery he destroyed 10
enemy bunkers and accounted for a large toll of the
enemy, including two key enemy commanders.

A Co and the Recon Plt. had encountered the very heart
of a reinforced battalion size NVA base camp and were
up against a superior force. A Co had suffered
casualties equivalent to one platoon.

C Co swept in behind to redouble the assault into the
bunker complex and completely overwhelm the enemy. The
NVA force had suffered total devastation. A search by
C Co found a body count of over 100, including the NVA
battalion commander and several of his aides.

SSG Bondsteel served with Co A, 2nd Bn, 2nd Inf from
Dec. 1967 to Feb. 1970. He then transferred to the 1st
Arm Div, but rejoined the 1st ID in May of 1973, when
he served with the 121st Signal Bn, at Ft. Riley, KS.

KFOR: KOUCHNER DRIVES FRENCH ARMY CRAZY


There is a covert or openly manifested defiance which exists from a
quite
some time. An annoyance that has been displaced from Beirut to Bosnia,
from
Somalia to Kosovo. French soldiers do not like Bernard Kouchner much.
His
theory about the necessity of intervention can be even accepted. The
military personnel has realized that they have no much choice, but the
person himself irritates them. He is too much of a comedian, too much in
the media, too much talkative, too much a politician. There is too much
of
everything.

The atmosphere in Kosovo is becoming tense. The intervention of Kouchner
requesting more policemen has not contributed to the calming down. The
core
of the problem is that the soldiers consider that the Special
Representative of the Secretary General expresses the opinions which are
too favorable for the Albanian community, while he is too vigorous in
condemning the perpetrators of the incidents on Serbian side.

Of course, nothing is being said. Everything is subtle, insistent but
discrete. French soldiers are quite aware of the superiority of
politicians
to take risk of directly confrontation with a government ? their own
government ? which has proposed and supported the candidacy for Kosovo
of
its former Secretary of State for Health . But when indiscrete observers
cannot read the messages sent by the military, the tone is changed.

In one of the daily reports in COIA (General Army Operative Centre), the
French general Lemierre, assistant head of KFOR, overreacted. In his
text
of 11 February, a few days before serious incidents in Mitrovica, he
says
that Bernard Kouchner is ?true to his extremely political personality?
who
has announced ?may be too prematurely? the unhacement of security
measures.
And finally, it is assessed that his ?speech mainly spontaneous and
focused
on security does not include social and economic dimension accompanying
necessarily the semblance of a political solution?. Therefore it would
be
better, they assess in short, if some one would like to take Bernanrd
Kouchner from the embrace of French soldiers. The least we need is the
French-French battle on the Kosovo front.

FRENCH MILITARY HAVING A FIELD DAY IN KOSOVO
AND RAILING AT KOUCHNER

The military adore Bernard Kouchner, so they say. On 25 February the
General Staff issued an embarrassing statement to explain how much it
appreciates the work done in Kosovo by the Un Secretary-General's
Special
Representative. The reason for releasing such kindly-worded statement
was
reporting the same day in the paper "Le Point" the statement in which
the
French military criticize, through their commander on the ground, Gen.
Lemierre, that civilian whom they hate.
As can be seen from another telex marked "confidential-defence" (our
document), which also originated from the Military Intelligence
Directorate
(DRM), Gen. Lemierre did not react on the spur of the moment. This
practice
was in principle not dangerous because this communication addressed to
the
General Staff only was not meant to get into the hand of civilians.
What was Kouchner's crime? In the opinion of these military critics, his
conduct was anti-Serb. Luckily, that displeased both people in the
General
Staff in Paris and the commanders deployed in Kosovo, who do not think
much
of Kosovar Albanians. The French officers call them "Arabs" and "rags".

Masked soldiers
This is not without blunder. On 13 February, after two French KFOR
soldiers had been wounded, a four dozen persons were arrested in
Mitrovica.
The arrested Albanians were taken to an unheated gym adjoining the
headquarters. The lot had food and drink. Five of them belonged to UCK,
a
paramilitary group recruiting only angels, some twenty of them had
weapons
and the rest were rounded up at random.
One of the latter group was a metre twenty and the other had a limp. The
people of URI (Research and Investigation Unit), a military intelligence
unit, took over. While they interrogated the sick ones without the masks
on, those who could be blamed for something were brought before groups
of
two or three masked investigators.
The explanation was the security of French militaries. The "suspects"
were
not beaten, not in the least but, for thirteen of them, detention lasted
for a full week. In order to give these interrogations the semblance of
legality, they sent for gendarmes, who only have the right to intervene
and
whose status as judicial police is an acceptable cover. The procedure
was,
otherwise, invalid as it took place out of France.

Objections were abundant. A young woman, an army NCO, said without
hesitation:"I don't like these Albanians. They stink." But before she
added
anything more, an embarrassed colleague of hers interjected:"Keep your
opinion to yourself." Because of the expenses, they were all eventually
released at the end of the week. "How do you think not to be seen as an
army of occupation after this incident?" "Our mission is to reduce the
tensions and not to incite them", said a young and too emotional
officer.
"We are not in Belfast." Nor in Algeria, in the good old times.

Kasbah Mitrovica
Nevertheless, it appeared that we were close, when the commander of the
French contingent General Poncet, organized a meeting last autumn in
Mitrovica. Also present were Commander-in-Chief of COS (Special
Operations
Command), General Rondo, Alain Richard's adviser, colonels-
representatives
of DGSE, DRM, KFOR and Kouchner's legal advisor, a gendarmerie officer.
"If necessary, we shall fight a battle for Algiers in Mitrovica" (a
reminder of the city's division during the war of Algeria). There is no
legal framework. "People are getting killed, and that is it", says
General
Poncet. Kouchner's associate is startled:"General, I feel free to remind
you that there is a legal framework, that is UN resolution 1244 (1999)
and
Military Technical Agreement, whose Annex E specifically defines all
this".
Poncet shoots a glance at the intruder, but keeps silent.
The change will leave traces. Although Kouchner wishes to keep this
gendarme as a special adviser, General Staff refuses to extend his stay
more than scheduled. Last February 4, despite orders of Kouchner's
mission,
his participation at the meeting in Paris primarily dedicated to the
Albanian mafia eroded from within by UCK was prevented.

Generous earnings
Against the background of ethnic conflict, bloody stand off rages on
also
in Kosovo. The army criticises, because of the attacks on its morale all
those who question its readiness to maintain presence. Particularly
ground
troops, "opex" (foreign operations) is an outstanding strategic stake.
"For a long time now, the opex became the only military testing ground.
If
the ground forces do not play their role adequately, there is no longer
any
reason for them to stay in. At the height of discussion on planning, in
order to get loans, we have to prove that we serve some purpose", is
maliciously commented by an air serviceman with a higher rank.
Namely, the ground forces have trouble fulfilling their tasks. It is
obvious that KFOR needs less courageous combatants and more agile
gendarmes
or CRS members. Because the largest task is maintenance of peace, and
the
army is not trained to do so. To acknowledge that would mean to be
condemned to the gloomy barracks in the capital. Goodbye generous
earnings!
That is why this small world is alarmed not to lose this edge. Despite
Kouchner's pleadings, asking for cops and police officers, the genders
received orders to train soldiers at all cost to maintain order.
Equipment:
60 shields, 120 Robocop uniforms, 1200 tear gas bombs have been
delivered
to the soldiers. Then they pray to God that some of them do not finally
have to shoot.
"In this powder plant, one match is enough, General Staff is playing
with
fire", commander returning from Kosovo says, in disappointment. But if a
large number of officers find it difficult to become supercops, some
Generals are obviously eager to use the skills acquired outside the
boundaries of France, to deal with disorders in the country. On return
to
Paris, the one and only General Poncet even dared to recently mention
this
bizarre idea in the presence of the cream of the General Military
Operations Centre.
This statement does not seem to have been appreciated by Alain Richard.
It
should be a consolation. At least, a little one.

DECEDUTO IL SOLDATO KFOR MALATO DI AIDS

Il soldato S.M., 37enne, dello Zimbabwe, e' morto alla clinica di
Chirurgia di Skoplje. Era malato di AIDS. E' interessante, scrive
il quotidiano "Makedonija Danas", che questo soldato anziche' essere
curato nell'attrezzatissimo ospedale americano n.67 "Bondsteel" APO
AF 09340, per l'assistenza alle truppe KFOR in Kosovo e Metohija,
sia stato trasportato in Macedonia dove e' morto. La stampa macedone
si chiede apertamente se l'ospedale militare americano in Kosmet
si sia volutamente sbarazzato del soldato, gravemente malato. Lo
stesso giornale denuncia anche le difficolta' per il trasporto del corpo
verso l'Austria.
Il corpo del soldato si trova ancora nell'obitorio di Skoplje.
Dal comando KFOR a Skoplje insistono presso l'ospedale perche' vengano
rilasciati dei documento dai quali non si evinca la vera causa della
morte del soldato.

Bondsteel!

A friend asked the following question: "James Rubin admits that
the
US considered the Kosovo Liberation Army and the Bosnian Muslims
‘allies’ . . . Why? What motive does the US have for picking
these
bums as pals?" A review of authoritative sources on this subject
makes the answer quite obvious.

At the beginning of the Balkan conflict, Acting Secretary of
State,
Lawrence Eagleburger made it clear that a US goal in Bosnia was
to
mollify the Muslim world. In a MacNeil/Lehrer NewsHour interview
on 6 October 1992, Eagleburger characterized the US government’s
pro-Muslim position in Bosnia as a counter to the Muslim World’s
perception of an anti-Muslim position regarding Iraq.

Dr. Ron Hatchett, Director, Center for International Studies at
the
University of St. Thomas, Houston, commented on the essay "The
Third American Empire," in The New York Times, 2 Jan 96:

"In a recent opinion piece in The New York Times, Jacob Heilbrunn

and Michael Lind of the New Republic editorial staff argue that
the
American commitment to the Islamic connection is so strong that
the
US design is to make the Islamic world part of a new American
empire and that American support of the Bosnian Muslims is part
of
the implementation of this plan."

Dr. Hatchett continues:

"General George Joulwan the American Commander in Chief of
NATO told the Washington Post . . . that NATO’s actions in Bosnia

are not about the future of Bosnia but the future of Europe. I
think
this is true. Bosnia is a test case for the new American designed

security architecture for Europe. If it achieves all American
goals here
at little or no cost [to us], then it will be applied elsewhere
and it
doesn’t take much imagination to predict where." [The Caspian,
maybe? The Middle-East? Colombia?]

In a Washington Times commentary of 4 Feb. 1996, Congressman
Duncan Hunter wrote, "Under Clinton’s policy, Bosnia will
continue
to be our responsibility for the rest of the century and beyond.
This is
a much broader and deeper commitment than what the American
people realize. It runs far beyond mere ‘peacekeeping.’ ...
Administration officials have looked far and wide for somewhere
to
implement these notions [total, systematic restructuring of a
society].
Bosnia is their new laboratory, providing a larger scope for
experimentation than either Somalia or Haiti." Let me repeat
that. The
"Administration officials have looked far and wide for somewhere
to
implement these notions. Bosnia is their new laboratory."

Yohanan Ramati, Chairman of the Jerusalem Institute for Western
Defense, wrote in his "The Cold War is Back!" (June 1996):

"The strategic goal is to turn Bosnia-Herzegovina into the main
American military base in Europe and transfer the U.S. forces now

stationed in Germany there. The confirmed contract (value $1.3
billion!) To build military barracks and latrines at Tuzla in the
Moslem
part of Bosnia is far too big to relate to the 20,000 American
troops
presently in Bosnia and supposed to be evacuated from there in
early
1997. Nor is it likely that so much American money is being
invested
to build barracks for German or other European forces. So the
transfer of U.S. ground forces now stationed in Germany to Bosnia
is
by far the most reasonable assumption - especially since Germany
has
been pressing for their evacuation, regarding them as an
unwelcome
reminder of its defeat and occupation in World War II." Yohanan
Ramati’s accurate prediction that the buildup in Tuzla foretold
the
transfer of the major American bases from Germany to the Balkan
region has been reinforced by the buildup in Kosovo.

SO, MOVE OVER CAMP SWAMPY AND MAKE ROOM FOR
CAMP BONDSTEEL! Camp Bondsteel in Kosovo is becoming the
Mother of all Camps. "About 4,860 US troops, or roughly 77
percent
of Americans deployed in Kosovo, are based here in what is, in
effect,
a 775-acre city being built at a cost of $32 million among the
hills near
the town of Urosevac." (The Times of London, 6 Oct 1999).

"‘It is an obvious sign that the Americans are making a major
commitment to the Balkan region and plan to stay,’ said a senior
British officer." (The Washington Post, 5 Oct. 1999). Camp
Bondsteel, complete with a library, a chapel, a hospital, and
three
recreation centers, was named after an American officer who
performed bravely in Vietnam. A fitness center and a Burger King
food court rivaling those in American shopping malls offer cheap
sweets and soft drinks. (The Times of London, 6 Oct 1999).

At a CATO Institute panel discussion, I asked Col. Harry Summers
why predictions of our GI’s coming back in body bags never
materialized? He said that it was because (to paraphrase), "GI’s
are
virtual prisoners and never allowed to leave the base because the

leaders know that if they did, they would be prime targets."
After all,
who would want to go after a "peacekeeper" from Turkey, or from
Nigeria? "They have dubbed the base ‘Disneyland’ and suggest the
concentration of so many soldiers in a single, isolated location
will
hinder their ability to perform peacekeeping tasks. ‘This was a
wheat
field,’ said Maj. Jimmie Kenan, the hospital’s chief nurse. ‘Now,
it’s a
metropolis’." (WP 5 Oct 99)

During a Congressional hearing, General John Shalikashvili,
Chairman
of the Joint Chiefs, testified that the Bosnia deployment could
complete its mission in a year. When testifying before Congress,
Skalikashvili was obligated to tell the truth, not just support
administration policy. He was either lying or he was incompetent.
In
either case, he should have resigned or have been fired.

The bottom line is that C-A-M-P B-O-N-D-S-T-E-E-L spells a lot of

$$$$ dished out by American taxpayers, (from whom we will hear
little protest), and our GI’s spending a lot of time separated
from their
families in order to implement Clinton’s New World Order. It also

spells lucrative contracts and confiscation of Kosovo’s rich
mining
wealth for multi-national contractors and arms dealers, not to
mention
control of Caspian Sea oil pipelines. "With the Middle-East
increasingly fragile, we will need bases and fly-over rights in
the
Balkans to protect Caspian Sea oil." (WP, 28 Feb 99)

Seen from this perspective, the reasons for the Kosovo War, based
on
exaggerated and often false claims of "humanitarian" crises, take
on a
different light. There is an old saying that goes, "When you
can’t
understanding why something is being done, follow the money."

As a career military officer's wife, Stella Jatras has traveled

MEMORANDUM
OF THE GOVERNMENT OF THE FEDERAL REPUBLIC OF YUGOSLAVIA
ON THE IMPLEMENTATION OF UN SECURITY COUNCIL RESOLUTION 1244 (1999)


I. COMMUNICATIONS ADDRESSED BY THE GOVERNMENT OF THE FR OF YUGOSLAVIA TO
THE UN SECURITY COUNCIL, UN SECRETARY-GENERAL, KFOR, UNMIK AND OTHER
INTERNATIONAL ORGANIZATIONS

1. Persistent warnings to the violations of UN SC resolution 1244 (1999)

Even ten months since its adoption, no changes whatsoever have taken
place
concerning the respect of UN SC resolution 1244 (1999) as well as of
Military Technical Agreement by the international forces, KFOR and
UNMIK,
in the southern Serb province of Kosovo and Metohija.
Continuous warnings of the Government of the FR of Yugoslavia to the UN
Security Council, UN Secretary-General, KFOR and UNMIK and other
relevant
international organizations and factors to the flagrant violations of
the
key provisions of the Resolution, Ahtisaari-Chernomyrdin document and
the
Military Technical Agreement have not been heeded at ll. At the same
time,
the processes in the Province run contrary to the letter and substance
of
the Resolution and its related documents, threatening the security of
the
entire region.

- Memorandums of the Government of the FR of Yugoslavia: It is only a
month
from the latest, third, Memorandum of the Government of the Federal
Republic of Yugoslavia (1 March 2000), and in spite of clear examples of
direct violations of the key provisions of the Resolution and its
related
documents by KFOR and UNMIK, as well as of unambiguous demands of the
Government of the FR of Yugoslavia that UN Security Council, as a
primary
responsible body, should finally take energetic and urgent measures in
order to stop dramatic worsening of the overall situation in the
southern
Serbian Province, the United Nations Security Council continues closing
its
eyes before the facts and tolerates flagrant violations of fundamental
principles of the Charter, key provisions of the Resolution and its
related
documents, as well as all other widely accepted international standards
in
the field of human and civil rights.

- The Government of the FR of Yugoslavia, in more than its 60 direct
communications to the Security Council, continuously pointed to the
drastic
examples of non-compliance with or gross violations of the mandate of
KFOR
and UNMIK, particularly related to the violation of the sovereignty and
territorial integrity of the FR of Yugoslavia in Kosovo and Metohija.
Particularly well substantiated and justified are the warnings to the
continuation of terror, ethnic cleansing and genocide of Albanian
terrorists and separatists against the Serbs, Montenegrins, Roma, Turks,
Goranci and other non-Albanian population in the Province.
- In its direct communications to the head of UNMIK and KFOR commander,
through its Committee for Cooperation with the UN Mission in Pri{tina,
the
Yugoslav Government has on a daily basis drawn the attention to, and
lodged
regular protests in connection with, flagrant violations of their
authority
and failure to implement their mandate, clearly established by UN SC
resolution 1244 (1999).

2. Passive attitude of UN SC and other bodies of international community

- In view of the continuous and dramatic deterioration of the situation
and
drastic violations of fundamental human rights, as well as of
destruction
of historical and cultural monuments, constituting an integral part of
the
world cultural heritage, the Government of the FR of Yugoslavia has
informed timely and in a well-documented way other international
organizations engaged in Kosovo and Metohija (UNHCR, UNHCHR, UNESCO,
ICRC,
OSCE, EU, Council of Europe, etc.). In spite of the demands that they
should also fulfil their share of responsibility in accordance with SC
resolution 1244 (1999) and other relevant international legal
instruments
within their field of activity, there are still no signs of the real
readiness to engage in earnest in order to put an end to the present
devastating trends in the Province, seriously undermining the authority
of
the United Nations and weakening the confidence in the genuine readiness
of
the world Organization to meet its obligations and offer protection to
the
Member States in accordance with the Charter of the United Nations.

II. SYSTEMATIC VIOLATIONS OF UN SECURITY COUNCIL RESOLUTION 1244 (1999)
AND
MILITARY TECHNICAL AGREEMENT

1. Systematic violation of the sovereignty and territorial integrity of
the
FR of Yugoslavia and the mandate of UN Security Council

a) UN SC resolution 1244 (1999) unambiguously confirms the sovereignty
and
territorial integrity of the FR of Yugoslavia in Kosovo and Metohija
(preambular para 10; subpara 8, Annex 2)

- Decisions of UNMIK and KFOR: Regulations of UN Secretary General
Special
Representative and head of UNMIK B. Kouchner lack basis in the
Resolution
and are aimed at severing all ties between Kosovo and Metohija and the
Republic of Serbia and the FR of Yugoslavia, i.e. totally separating
the
Province from the constitutional, legal, economic, monetary, financial,
banking, customs, visa, administrative and other systems of the FR of
Yugoslavia and the Republic of Serbia.
Regulations and decisions of the UN SG Special Representative for Kosovo
and Metohija B. Kouchner, systematically and directly undermine the
State
sovereignty of the FRY in Kosovo and Metohija as a basic principle
guaranteed by SC resolution 1244 (1999) and bring into question the
legal
basis and prerogatives of statehood of the State of Serbia and the FR of
Yugoslavia, in the southern Serb Province, as an integral part of the
sovereign territory of the Republic of Serbia and of the FR of
Yugoslavia.
Special Representative B. Kouchner continues with his illegal acts aimed
at creating prerequisites for the independence of the Province from the
Republic of Serbia and the FR of Yugoslavia, favouring political and
other
interests of Albanian separatists and terrorists, which is unprecedented
in
history of UN missions. Illegally established the so-called Interim
Administration Council, de facto Provincial "Government", composed
exclusively of Albanians, mostly from the ranks of the terrorist
so-called
KLA and separatist Albanian political parties, even before the minimum
security and living conditions have been created for non-Albanian
population, represents an attempt of legalizing ethnic supremacy of
Albanians, with a view to creating an ethnically pure Kosovo and
Metohija.
Persistent efforts to include the Serbs into this body, mostly for the
functions of irrelevant political importance and influence, represent
Kouchner's attempts to legalize the status quo to the detriment of the
Serbs and other non-Albanian population.
The developments in the Province unambiguously confirmed that the claims
of the Government of the FR of Yugoslavia to the effect that the UNMIK
decision on the transformation of the terrorist KLA in an alleged
civilian
organization - "Kosovo Protection Corps" are justified, and that the
decision is not only illegal as it lacks basis whatsoever in SC
resolution
1244 (1999) and its related documents, but is also one of the main
generators of exacerbating the situation and the crisis in the Province.
The attack of well-armed members of the so-called Kosovo Protection
Corps
on a patrol of the Republican Ministry of the Interior near Bujanovac,
outside the administrative area of Kosovo and Metohija, unambiguously
confirms that the so-called Kosovo Protection Corps is not any
"civilian"
structure - its members are re-cycled terrorists of the so-called KLA,
whose combat structure and command personnel have been fully kept,
creating
a core of a future Albanian army in Kosovo and Metohija, as has been
publicly pointed out by its "commander", notorious terrorist A. Cheku.

- Building of military bases: The Government of the FR of Yugoslavia
most
energetically opposes the building of KFOR military bases in a part of
its
sovereign territory, without its approval. It represents the most
flagrant
violation of its sovereignty and provisions of UN SC resolution 1244
(1999), as well as the existing laws of the Republic of Serbia and the
FR
of Yugoslavia. The building of foreign bases without the approval of the
receiving State is contrary to the character and spirit of peace
missions
under the auspices of the United Nations and represents a dangerous
precedent, contrary to the fundamental principles and purposes of the
United Nations.
- Military exercises of NATO/KFOR: The Government of the FR of
Yugoslavia
resolutely opposes military exercises of NATO and KFOR in the Province,
under any pretext, which represents the most flagrant violation of the
territorial integrity and sovereignty of the FR of Yugoslavia.
Sabre-rattling in the Province, which is obviously not in the function
of
creating security conditions for all its citizens, is just another form
of
support to the Albanian terrorists in their attempts to cement
mono-ethnic
structure of the Province, as a basis for its total separation from the
constitutional and legal system of the Republic of Serbia and the FRY.
Such
provocative conduct on the part of KFOR represents a factor of serious
destabilization of the region and directly threatens peace and stability
in
Europe.
Although it is obliged to prevent any act of violation of UN SC
resolution
1244 (1999) and to eliminate all sources of instability in the region,
the
Security Council did nothing to protect the sovereignty and territorial
integrity of the FR of Yugoslavia, thereby directly violating not only
the
key provisions of the Resolution but the fundamental provisions of the
Charter of the United Nations as well.

- Representation of some countries: Despite the warnings and protests of
the Government of the FR of Yugoslavia, UNMIK continues to tolerate the
establishment of foreign para-diplomatic missions in the Province,
without
consultations with and approval of the Government of the FR of
Yugoslavia,
which represents a gross violation of the principle of the sovereignty
and
territorial integrity of the FR of Yugoslavia. The attempt of Kouchner
to
even legalize that (his draft regulation on "immunities and privileges
of
the liaison offices of foreign Governments in Kosovo") is a direct
attack
on the sovereignty and territorial integrity of the FR of Yugoslavia
which
grossly violates the principles of the UN Charter, provisions of the
Vienna
Conventions on diplomatic and consular relations and the Convention on
the
Privileges and Immunities of the United Nations as well as prevailing
international practice.
- The Government of the FR of Yugoslavia reiterates once again that it
has
never ceded or intends to cede the sovereignty over any part of its
territory and resolutely rejects the tactics of manipulating or
diverting
the attention from the alliance of UNMIK and KFOR with the terrorist
so-called KLA. It particularly refuses all moves in line with fait
accompli
acts.
- The sovereignty and territorial integrity of the FR of Yugoslavia are
inviolable and final: overall conduct, decisions of KFOR and UNMIK
particularly of the UN SG Special Representative and head of UNMIK B.
Kouchner, including his decision on the establishment of the "Interim
Administration Council of Kosovo" disregarding or violating the
principle
of sovereignty and territorial integrity of the FR of Yugoslavia, as
well
as all measures, acting and failing to act, contrary to the UN SC
resolution 1244 (1999) or MTA, or represent an attempt at their
revision,
the FR of Yugoslavia considers null and void and they cannot have any
legal
effect or be binding on the FR of Yugoslavia or its organs in any way.




2. Massive violations of human rights

Terror and violence : Albanian terror and violence, ethnic cleansing and
genocide against non-Albanian population, above all the Serbs and
Montenegrins, but also Roma, Muslims, Turks, Goranci and others,
destruction of their homes, usurpation and destruction of private and
State-owned property, rampant crime and chaos in the Province, continue
despite the presence of several dozen thousand of well armed members of
KFOR and more than 2,000 UNMIK policemen. That speaks convincingly that
KFOR and UNMIK do not fulfil their basic obligations arising from their
mandate, particularly in terms of guaranteeing full personal and
property
security and safety of all citizens in the Province, above all the Serbs
and Montenegrins, who have been exposed to systematic ethnic cleansing,
terror, killings and abductions.
- The Government of the FR of Yugoslavia insists that KFOR and UNMIK
fulfil without delay all their obligations and create as soon as
possible
the conditions for a safe return of all expelled persons to Kosovo and
Metohija.

Ethnic cleansing: Since the deployment of KFOR and UNMIK, more than
350,000 Serbs, Montenegrins, Roma, Muslims, Turks, Goranci and other
non-Albanians were forcibly driven out of the Province. Terrorists are
increasingly targeting Albanians, loyal citizens of the Republic of
Serbia
and the FR of Yugoslavia, who refused to obey the demands of Albanian
terrorists and criminals.
- The fact that the alleged search of the Serbs in Kosovska Mitrovica by
KFOR was used by Albanian terrorists to expel additional 16,000 Serbs
and
Montenegrins, should serve as a warning. It is evident that this form of
intimidation of the Serbs in Kosovska Mitrovica, with direct
participation
of the members of KFOR, is just another example of the proven policy of
bringing pressure to bear on the Serbs, with a view to completing ethnic
cleansing of the Province.

- Terrorism: In the period from 10 June 1999 through 30 March 2000,
there
was a total of 4,564 terrorist attacks (4,314 against Serbs and
Montenegrins); 936 persons (835 Serbs and Montenegrins) were killed; 876
(824 Serbs and Montenegrins) were wounded, and 867 (798 Serbs and
Montenegrins) were abducted. More than 50,000 homes, mostly those
belonging
to Serbs, Montenegrins and Roma, were destroyed, burned down or severely
damaged.

- The latest serious crimes: During the month of March, the crimes
committed by Albanian terrorists continued. There were motivated by the
desire to scare the remaining Serb and other non-Albanian population
into
leaving the Province. The manner in which these crimes were committed is
yet another proof that Albanian terrorists have neither been disarmed
nor
demilitarized. The most brutal crimes include: planting of explosives
in
the home of Azem D`aferi, a Muslim, in Prizren (1 March 2000); shelling
of
the village of Grabovac and a bombing of the building housing the
training
centre in Obili} (3 March 2000); brutal attacks on Serbs in the villages
of
Bostane and Trni}evce (6 March 2000); terrorist bombings of the Serbian
section of Kosovska Mitrovica, in which 19 Serbs were injured (7 March
2000); shelling of the Serbian village of Gora`devac (10 March 2000);
brutal murder of Srdjan Peri} by beating him about the head with a axe
when
the terrorists opened machine gun fire at a group of Serbs working in
the
field (11 March 2000); blasting of a railway overpass causing
interruption
of services between Kosovska Mitrovica and Le{ak, municipality of
Leposavi}
(23 March 2000).


- New forms of terror against Serbs and other non-Albanian population:

Instead of providing full security to Serbs, KFOR resorts to the use of
brute force, harassment, physical violence, including causing damage to
Serb property, which represents a new form of an inadmissible behaviour
of
international forces with a clear message to the Serbs. Particularly
drastic incidents occurred in Kosovska Mitrovica (on 20-25 February) as
well as in the villages of Mogila (on 25-26 February), in which Serbian
houses were searched by using the method of most brutal physical
violence,
Draganovac (Gnjilane municipality) and Mioli~e (Leposavi} municipality),
Mali Zve~an (27 February), Gornje Kusce (1 March) and the Serbian
villages
of Rudare and Grabovac (1 March). The searches were conducted by KFOR
jointly with the terrorists of the so-called KLA, who wore international
security forces uniforms, thus proving the strong links between KFOR and
Albanian terrorists.
The illegality and brutality of this action as conducted by US and
German
KFOR contingents were also condemned in the OSCE report of 21 February
2000, saying that in doing so, KFOR violated the provisions of the
International Covenant on Civil and Political Rights. Establishing also
that the operation was illegal, the fact was brought to the attention of
the head of UNMIK B. Kouchner.

- Terrorists attacks outside the Province: In the belief that the
destabilization of the situation on the widest possible territory
facilitates the achievement of their separatist goals, Albanian
terrorists
are seeking to spread terror, chaos and lawlessness outside the Province
to
other parts of the Republic of Serbia and the FR of Yugoslavia, which
would
not have been possible without the support and direct assistance by
members
of KFOR and UNMIK, whose responsibility is to prevent all attempts of
violating safety within the administrative territory of the Province.
The
fact that the members of the so-called Kosovo Protection Corps take part
in
terrorist attacks outside the Province, clearly confirms that Albanian
terrorists from the so-called KLA have neither been disarmed nor
demilitarized, and least of all, that the so-called Kosovo Protection
Corps
is an allegedly a civilian structure.

- "Labour camps" for Serbs: The prisons, run by the terrorist so-called
KLA
throughout Kosovo and Metohija, house several hundred abducted Serbian
civilians, who have been placed in "labour camps" controlled by the
so-called KLA. The abductees have been subjected to extremely cruel and
inhuman treatment in these "labour camps" located in the village of
Mati?ane, 15 kilometres away from Pri{tina, as well as in the village of
Du{anovo near Prizren and in Drenica. Access to these people is strictly
forbidden, even by ICRC representatives.
Additionally, in the Republic of Albania there are also some 350
persons
of Serb nationality, who have been abducted in Kosovo and Metohija. The
international forces in Kosovo and Metohija are aware of the existence
of
such prisons for the abducted Serbs. Despite the fact that it represents
the most inhuman violation of individual human rights and freedoms they
have done nothing to free the abducted persons.
Other representatives of the international community (UN
Secretary-General, the Security Council, the ICRC as well as Mrs S.
Ogata,
Mr. J. Dienstbier and others) have been fully informed about the lists
of
abducted Serbs without any major effect as regards the release of those
who
were not executed in the meantime.

- Attacks on aid convoys: Attacks on aid convoys and prevention of the
delivery of basic food staples, medical supplies for hospitals, etc.,
all
intended for the Serb population under several months blockade have
become increasingly frequent, which is a special form of genocide
against
Serbs, calculated at bringing about their physical destruction. In this
respect, particularly striking examples are the following: attack on the
Serb convoys headed for [trpce, near the village of Radivojce (on 22 and
29
February); attack on the Serb convoy en route to Koreti{te, in the
village
of Dobri~ane (28 February); attack on the bus transporting Serb children
on
their way back from school, on the road between Gornje Kusce and
Koreti{te
(29 February); attacks against Serb convoys in the village of Koretin
(6
and 20 March); repeated attacks against Serb convoys in Gnjilane (7 and
10
March); an attack on a Serb convoy in the village of Dobrovce (27
March).
KFOR has not prevented these attacks by terrorists. Also, it has refused
to provide security escorts (Lieutenant Peter Ramstel, KFOR, Kosovska
Mitrovica area, banned all KFOR security escorts for buses transporting
Serbian schoolchildren and sick persons to Gra~anica, 1 March. It is not
prepared to escort convoys between Merdare and Kosovo Polje) which is
yet
another proof that KFOR does not carry out is obligations under the
resolution, thereby encouraging Albanian terrorists to freely continue
their daily violence against Serbs in order to force them to leave
Kosovo
Polje and other places.

- Destruction of cultural and historic sites: Destruction of Serbian
monuments of culture and the most precious symbols of centuries' old
roots
of Serbian statehood and spirituality in the region of Kosovo and
Metohija
has continued. In total, 85 churches and medieval monasteries have been
destroyed, burned or seriously damaged.

- Discrimination against Serbs and a cultural and spiritual genocide of
Serbs: UNMIK continues to tolerate and encourage through its actions
discrimination against Serbs especially in education (the closure of
universities, schools), culture and the media in the Serbian language.
In
doing so the most frequently cited excuse is alleged attempt to preserve
the multi-ethnic, multi-cultural and multi-religious structures in the
Province. The fact that this is done where the Serbs have managed to
live
in larger numbers clearly shows that KFOR and UNMIK directly encourage
the
aspirations of Kosovo Albanian terrorists towards breaking apart the
ethnically solid Serbian communities, and that they directly pressurize
Serbs into leaving their ancestral homes.
- The policy of double standards and unobjective criteria disfavouring
Serbs, applied by UNMIK on the one hand have deprived not only Serbs
but
also Roma, Muslims, Turks and Goranci of their jobs, doing nothing to
ensure their reinstatement to the jobs they were forcibly kicked out of.
On
the other hand, they favour Albanians irrespective of the lack of skills
on
their part, constituting the most flagrant violation of the principle of
equality and multi-ethnicity.

- KFOR and UNMIK bear sole responsibility for massive violation of human
rights in the Province, for lawlessness, chaos and breaches of the
provisions of Security Council resolution 1244 (1999), relating to the
preservation of the multi-ethnic, multi-confessional and multi-cultural
character of the Province, by becoming outright accessory to ethnic
cleansing and genocide.

3. Disarming of the terrorist so-called KLA

Daily terrorization, violence, killings and destruction of Serbian homes
and settlements, cafes and other places frequented by Serbs in massive
numbers in the remaining Serb enclaves, as well as attacks on civilians
and
Yugoslav security forces beyond the boundaries of the Province, with the
use of heavy ordnance even, all testify to the fact that the terrorists
of
the so-called KLA have not been disarmed.

Leaders of these terrorist/separatist formations, Hashim Thaqi, Agim
Cheku
and others, continue to openly advocate the independence of the
Province,
whereby the so-called KPC, which is nothing but a "transformed"
terrorist
so-called KLA, would be a core of the future Albanian army.

The Government of the FR of Yugoslavia recalls once again its position,
expressed in the letter of 22 September 1999 to the President of the
Security Council, that purported transformation of the terrorist
so-called
KLA into the so-called "Kosovo Protection Corps" was a sham and a
manipulation, so as to avoid the obligation of a genuine
demilitarization
and disarming of this illegal terrorist organization. This has been
clearly proven by the situation in the Province, as is being
increasingly
openly admitted to even in the biased media and Western political
circles.
KFOR and UNMIK, in particular Bernard Kouchner, bear full responsibility
that the so-called KLA has not yet been disarmed, and that with their
blessing, an illegal Albanian armed formation was created, composed
mostly
of proven Albanian but also of international terrorists recruited in
neighbouring and other States known for sponsoring international
terrorism.
There is information that Islamic extremists from Chechnya are
sheltering
in large numbers in Kosovo and Metohija where they enjoy the protection
of
KFOR and UNMIK.

- Thriving crime in the Province: Direct proof that KFOR and UNMIK have
failed to discharge their mandates strictly, notably with respect to
securing the international borders of the FR of Yugoslavia with Albania
and
Macedonia, is their patronizing attitude towards Albanian terrorists and
separatists who enter the FR of Yugoslavia without hindrance, which is
the
main cause for the thriving crime and chaos in the Province.

As a result of an unprotected border, in flagrant violation of Security
Council resolution 1244 (1999), KFOR and UNMIK have allowed illegal
entry
into the Province of several hundred thousand criminals and looters from
Albania, aimed at spilling over the chaos from Albania into Kosovo and
Metohija. Kosovo and Metohija have, thus, been turned into a stronghold
of
organized international crime, terrorism, narco mafia, illicit arms
trafficking, white slavery, juvenile crime and prostitution rackets in
Central and Western Europe, with a view to spreading crime and
destabilizing Europe and preventing the ongoing integration processes.



4. Civil registration and local elections in Kosovo and Metohija

On the basis of UN SC resolution 1244 (1999), UNMIK has no authority to
conduct civil registration and issue personal IDs to the citizens of the
FR
of Yugoslavia from Kosovo and Metohija. In accordance with the
sovereignty
and territorial integrity of the FR of Yugoslavia, that right has been
vested in the competent State authorities of the Republic of Serbia and
the
FR of Yugoslavia, in line with the existing legislation.
UNMIK has no authority to conduct local elections in the Province,
particularly not without explicit approval and participation of the
competent authorities of the Republic of Serbia and the FR of
Yugoslavia,
but only to monitor them.
The Government of the FR of Yugoslavia confirms its commitment towards
fair and democratic elections in the Province. However, it warns again
that
it will be possible to organize such elections only after necessary
conditions are created and the structure of local government
(substantial
autonomy) is established, for which the elections are being held, which
should be an outcome of a comprehensive political process, with active
and
equal participation of the official authorities and institutions of the
Republic of Serbia and the FR of Yugoslavia as well as representatives
of
all national communities in Kosovo and Metohija.
Against a background of continuing terror, final stages of the ethnic
cleansing of Serbs and other non-Albanian population in the Province,
absence of conditions for the return of over 350,000 expellees and a
presence of a couple of hundred thousand illegal foreign citizens in
Kosovo
and Metohija, it is evident that there are not even the basic conditions
for civil registration in the context of the preparations for the
elections
to be held in near future. Ignoring these facts and insistence by OSCE
and
UNMIK to proceed to civil registration in the circumstances described
represent an attempt at the policy of fait accompli, i.e. at legalizing
local para-Statal institutions set up by the terrorist so-called KLA
after
the deployment of KFOR and UNMIK in the territory of the Province, and
thereby at encouraging the further destabilization of the Province along
the lines of achieving the separatist goals of Albanian extremists.

The Government of the FR of Yugoslavia strongly rejects any attempt at
calling for early elections in the Province until basic conditions are
not
met, i.e. consolidated peace and stability on the basis of Security
Council
resolution 1244 (1999).
This, first and foremost, implies a free and safe return of all expelled
Serbs and other non-Albanian population, expulsion of more than 200,000
non-residents of the FR of Yugoslavia who illegally entered the Province
since the deployment of KFOR and UNMIK, and agreeing, with the
Government
of the FR of Yugoslavia, basic parameters for the political settlement
in
Kosovo and Metohija, in line with UN SC resolution 1244 (1999).

5. Parameters of "substantial autonomy" of the Province

All attempts to establish parameters of "substantial autonomy" of the
Province outside the constitutional and legal framework of the FR of
Yugoslavia and the Republic of Serbia, are illegal, particularly without
active participation of their competent authorities.
The Government of the FR of Yugoslavia most resolutely opposes all
attempts that the projects on the future status of autonomy and
self-government, enable the separation of the Province from the current
constitutional and legal system of the Republic of Serbia and the FR of
Yugoslavia, which has no basis in UN SC resolution 1244 (1999), nor in
the
existing constitutional order of the FR of Yugoslavia, which is
inviolable.
The FR of Yugoslavia will not accept, nor will in any way be bound by
any
acts of imposition of outside solutions for the Province, no matter
where
they came from. In line with this, it is absolutely against the Security
Council legalizing any document containing parameters of a future status
of
autonomy in Kosovo and Metohija, in whose formulation the official
representatives of the Republic of Serbia and the FR of Yugoslavia did
not
participate directly.
Democratic and fair solution implies a political agreement, with full
and
equal participation of the representatives of the Republic of Serbia and
the FR of Yugoslavia and representatives of all national communities in
the
Province, when all relevant preconditions are fulfilled:
- ensuring full security of all citizens;
- safe return of all expelled and displaced Serbs and other non-Albanian
population;
- disarming of all terrorists and eliminating combat structure of the
terrorist so-called KLA, i.e. dismantling of illegal Kosovo Protection
Corps;
- suspension of all illegal decisions of "Interim Administrator" and
local
para Statal and para political structures based on them;
- ensuring full respect and application of the Constitution and laws of
the FR of Yugoslavia and the Republic of Serbia;
- normal functioning of the competent State authorities and
institutions;
- ensuring conditions for the establishment of democratic, multi-party
structure of the Province, etc.

- The Government of the FR of Yugoslavia recalls that the State
delegation
of the Republic of Serbia, during negotiations in Paris, on 15 March
1999,
signed an agreement with the representatives of all national communities
in
Kosovo and Metohija on self-government in the Province. This
unambiguously
confirmed its commitment to have the question of autonomy and
self-government in the Province resolved by exclusively political means,
on
the basis of guaranteeing full equality of all citizens and ethnic
communities living in the Province. However, only the representatives of
Albanian political parties refused to sign the agreement, those parties
whose platform includes separatism and terrorism as an end to it. In
doing
so, they clearly demonstrated that they were interested only in full
"independence" of the Province from "Belgrade", in other words - only in
the project that implies the change of the State borders of the FR of
Yugoslavia and the Republic of Serbia, which is in direct contravention
of
the Charter of the United Nations, the Helsinki CSCE/OSCE principles and
the basic provisions and substance of UN SC resolution 1244 (1999) and
its
related documents.

6. The return of Yugoslav Army (VJ) and police (MUP)

- It is unjustified and absolutely unacceptable to continue to fail to
implement clear provisions of the Resolution and Military Technical
Agreement (operative para 4, subparas 6 and 10, Annex 2 of the
Resolution
and para 4 of Military Technical Agreement), on return of members of VJ
and
MUP to the Province, particularly when KFOR and UNMIK have proved
totally
inefficient in ensuring security for all citizens, peace, rule of law in
the Province and particularly in guaranteeing full safety of persons and
property, safe and unimpeded return of all expelled Serbs and other
non-Albanian population. By such attitude, KFOR and UNMIK directly give
in
to the interests of Albanian terrorists and separatists and encourage
them
to continue with their daily terrorization of Serbs and other
non-Albanians
with the aim at completing the ethnic cleansing of Serbs and other
non-Albanians in the Province.

- The Yugoslav Government insists that this obligation be fulfilled
immediately and without any conditions, in the interest of all citizens
of
the Province and of the protection of the sovereignty and territorial
integrity of the FR of Yugoslavia and the Republic of Serbia.

6. Responsibility of the United Nations Security Council

The Security Council, as guarantor of its resolution 1244 (1999), is
fully responsible for the failure to comply with, and for the flagrant
violations of, its key provisions, primarily those reaffirming the
sovereignty and territorial integrity of the FR of Yugoslavia on all its
territory.
Continued gross violations of the provisions of the Resolution and its
related documents by KFOR and UNMIK which brought about an alarming
development of the situation in the Province, with potentially
far-reaching
harmful consequences for the entire region, have not been responded to
by
adequate measures of the Security Council to put an end to such
dangerous
developments. This confirms the lack of readiness on the part of the
Security Council to fulfil its obligations arising from the Charter, and
is
therefore to be held directly accountable for the detrimental
consequences
caused by such conduct as well as for all future developments should the
Council continue to be passive.
The Government of the FR of Yugoslavia insists that the Security
Council,
in accordance with its obligations, took immediate and urgent measures
to
implement strictly the resolution and its related documents thud
preventing
the further undermining of the sovereignty and territorial integrity of
the
FR of Yugoslavia.


- In accordance with the primary responsibility of the Security Council
for the consistent implementation of the Resolution and its related
documents, the Government of the FR of Yugoslavia resolutely rejects all
attempts to delegate the competencies of the Security Council in
connection
with the Resolution in any part, to some narrow groups with interests
outside the Security Council, such as G-8, the Contact Group, etc. The
decisions of such ad hoc bodies, whose mandate is established outside
the
competencies and control of broader international community,
particularly
the Security Council, are absolutely unacceptable and cannot have any
binding effect for the Government of the FR of Yugoslavia.


III. ASSESSMENT OF THE CURRENT DEVELOPMENT OF THE SITUATION IN KOSOVO
AND
METOHIJA


1. Overall performance of KFOR and UNMIK

The results of the ten-month long international security (KFOR) and
civilian (UNMIK) presence in the south Serb Province are devastating.
The
utterly disturbing situation is characterized by wide-spread crime,
chaos
and lawlessness, large-scale terror, genocide and ethnic cleansing of
Serb
and other non-Albanian population, destruction of their private
property,
looting and usurpation of the property of the State and of private
firms,
carried out by armed Albanian extremists, members of the terrorist
so-called KLA in particular.

- Multiethnic Kosovo and Metohija - hypocrisy of KFOR and UNMIK:
Developments in the Province, owing to non-implementation of SC
resolution
1244 and its flagrant violation by KFOR and UNMIK have fully revealed
that
verbal commitment by KFOR and UNMIK for the maintenance of multi-ethnic
structures in the Province are mere farce. Total failure of the
international mission under the auspices of the United Nations is a
serious
blow to the reputation and credibility of the world Organization. In
particular, it is inadmissible that the KFOR and UNMIK, in a situation
when
they are doing nothing to ensure the return of more than 350 thousand
expelled Serbs and other non-Albanian population
are trying to impose their commitment for an alleged multi-ethnicity by
force only on the remaining Serb enclaves, which is a clear message to
the
Serbs that they are undesirable.

- Ethnic cleansing of Serbs and Montenegrins in the largest part of the
Province has been already accomplished. Concentrated attacks of Albanian
terrorists and senseless moves by KFOR and UNMIK towards the remaining
Serbian enclaves, above all Kosovska Mitrovica as the largest one,
confirm
a direct collusion between Albanian terrorists and international forces
in
Kosovo and Metohija in an ethnic cleansing campaign of the Province of
non-Albanian population, primarily Serbs.
The insistence of KFOR and UNMIK on the establishment of multiethnic
communities, particularly the so-called security zones, in the remaining
Serbian enclaves in particular is both unconvincing and cynical, while
at
the same time no one is even mentioning for example Pri{tina in which
about
40 thousand Serbs and Montenegrins used to live before the arrival of
KFOR
and UNMIK, with hardly hundred of them remaining now. Particularly
striking
is the fact that of the previous 250,000 Serbian school children and
undergraduate students who attended classes in Pri{tina there are now
only
35 of them who attend school outside Pri{tina (Laplje selo).
At the same time, there is not a word about the re-establishment of
multi-ethnic structure in Prizren, Pe}, Orahovac, Djakovica, Glogovac
and
many other towns, villages and areas in Kosovo and Metohija, like Kosovo
Pomoravlje, which are also completely ethnically cleansed of Serbs and
Montenegrins. Moreover, the most responsible official of the world
Organization, Secretary-General Kofi Annan, in his latest report to the
Security Council (C/2000/177 of 3 March 2000) only notes that there are
no
conditions for the return of expelled Serbs and other non-Albanian
population, while at the same time he does not even mention that he will
undertake measures to create such conditions, although it is an explicit
obligation under UN SC resolution 1244 (1999).
The latest "games" by KFOR and UNMIK over Kosovska Mitrovica are but a
new confirmation of the proven policy of demonizing Serbs in order to
justify true ends, namely finalization of the ethnic cleansing of the
Province of all its Serbs and to cover up the fact that the members of
the
terrorist the so-called KLA have neither been demilitarized nor
disarmed.
Recent articles in the French press fully expose perfidious tactics of
B.
Kouchner and those who stand behind him, aimed at fuelling and
artificially
maintaining at all cost the picture of the Serbs as usual suspects. In
doing so, B. Kouchner seeks to conceal that he is directly involved in
catering to the interests of a separatist movement of H.Thaqi and A.
Cheku,
to the detriment of the vital interests of the Serbs and other
non-Albanian
population, the Republic of Serbia and the FR or Yugoslavia.

- Non-compliance and gross violations of the basic provisions of
Security
Council resolution 1244 (1999) and its related documents by KFOR and
UNMIK,
has resulted directly in the dramatic security and general situation in
the
Province, above all in the continuation of Albanian terrorism, violence
and
ethnic cleansing of Serbs and other non-Albanian population and wide
scale
crime and lawlessness in the Province. Thus KFOR and UNMIK have become
accomplices in the most serious crimes committed against Serbs and other
non-Albanian population and they are responsible mostly for the lack of
elementary security of Serbs and non-Albanian population in the
Province.
However, the tested tactics of deluding the world public and of
diverting
the attention from the complete fiasco of international mission under
the
auspices of the United Nations is in place, while the attempts are being
made to blame at any rate the remaining Serbs. This is not only a
cynicism
of its own kind, but also a proof of direct protection of Albanian
terrorists and separatists, of organized international crime and of the
continuation of a new form of aggression against the FR of Yugoslavia
though the alliance of NATO and terrorist so-called KLA. Such activity
is
obviously aimed at spreading the destabilization over the entire region
of
southeastern Europe and transforming Kosovo and Metohija into a centre
of
prolonged destabilization of Europe, and the entire region into a centre
for the concentration and spreading of international terrorism
throughout
Europe in order to jeopardize the processes of integration.
The continuous deterioration of the overall situation in the Province is
in line with the efforts to provoke artificially the prolonged
destabilization in the region which should justify the existence of NATO
and rehabilitate its prestige and authority which have been seriously
brought into question by its illegal aggression against the FR of
Yugoslavia. Therefore, manipulations with utterly malicious assertions
of
KFOR and UNMIK officials about an alleged success of the international
mission in the Province have continued, as also evidenced in the recent
report of the UN Secretary General to the Security Council.
The statements of KFOR and UNMIK representatives of alleged success of
the
international mission in the Province are absolutely unacceptable since
they are not founded on real situation on the ground and consequently
this
inevitably leads to a conclusion that they are based on the assessment
of
some other goals which are different from those set up in Security
Council
resolution 1244 (1999) and its related documents. The data presented by
KFOR and UNMIK concerning the decrease of crimes in the Province are
also
unacceptable and malicious, because they are the result only of a
continuous reduction of the total number of Serbs and other non-Albanian
population who are the victims of Albanian terrorists.
Open cooperation of KFOR and UNMIK with Albanian separatists and
terrorists in jeopardizing the sovereignty and territorial integrity of
a
sovereign Member State of the United Nations is without a precedent in
the
history of the UN peace-keeping missions, whereby the reputation and
authority of the United Nations are seriously brought into question. The
credibility of the world Organization is particularly eroded by the
behaviour of its representative B. Kouchner, which has been recently
openly spoken about in France (articles in "Le Point", "Le Canard
Enchaine"
and other media).

2. Strict implementation of the Resolution and its related documents -
an
imperative for the normalization of the situation in Kosovo and
Metohija.

All parameters unambiguously confirm that the developments in the
Province
are moving towards the further worsening of the overall situation, its
dangerous compounding and increased threats to the overall stability of
the
region.
By the gross violation of the provisions of the Resolution and by
their
overall conduct, KFOR and UNMIK have unambiguously confirmed that the
presence of international forces under the auspices of the United
Nations
in Kosovo and Metohija so far is a complete fiasco. The United Nations
Security Council bear primary responsibility tragic consequences brought
about, since it failed to undertake necessary and energetic measures it
was
bound to under the Resolution, to ensure a strict implementation of the
provisions of the Resolution and its related documents.
It is obvious that there is no longer an excuse for further stay of the
mission of the so-called international community, since it was not able
or
did not want to carry out the mandate entrusted to it in UN SC
resolution
1244 (1999). It is therefore necessary that this shameful mission be
ended
as soon as possible and that the competent authorities of the FR of
Yugoslavia and the Republic of Serbia be enabled to:
- restore order and peace, rule of law and legality;
- ensure personal protection and the protection of the property of all
its citizens irrespective of their ethnic origin or religion;
- ensure normal functioning of all commercial entities and local
authorities, and
- create all necessary preconditions for launching political dialogue
between the representatives of the State and ethnic communities in
Kosovo
and Metohija about the parameters of autonomy and self-governance in the
Province, within the constitutional system of the Republic of Serbia and
the FR of Yugoslavia.
Strict compliance with the resolution and its related documents is the
fundamental precondition for the normalization of the overall situation
in
the Province and the obligations of all to respect it unconditionally.
In that context, the Government of the FR of Yugoslavia expects that its
previous initiative for a mission of the Security Council to visit the
FR
of Yugoslavia and sees first hand the dramatic developments in the
southern
Serb province has been implemented in the very near future.


IV. DEMANDS OF THE GOVERNMENT OF THE FR OF
YUGOSLAVIA

Proceeding from its sovereign rights, guaranteed by Security Council
resolution 1244 (1999), Ahtisaari-Chernomyrdin document and Military
Technical Agreement, the Government of the FR of Yugoslavia most
resolutely
reiterates its demand:

- that the Security Council undertake urgently energetic measures to
ensure strict respect of all provisions of the Resolution and its
relevant
documents, above all, those guaranteeing the sovereignty and territorial
integrity of the FR of Yugoslavia on its entire territory;

In this context, the Yugoslav Government insists in particular :

- that UNMIK and KFOR unconditionally and without delay respect and
implement the mandate set up in the Resolution and its relevant
documents;
- that KFOR and UNMIK strictly respect sovereignty and territorial
integrity of the FR of Yugoslavia and the Republic of Serbia and
immediately end all acts and behaviour violating them, and restore the
situation in the Province to the status quo ante;

This, above all, implies:
- full normalization of customs and border regime, inevitable return of
Yugoslav border authorities, customs and passport control to the State
border of the FR of Yugoslavia with Albania and Macedonia;
- normalization of public services (PTT, power supply system, railway,
banking system) in accordance with the laws of the Republic of Serbia
and
the FR of Yugoslavia and principles of market-oriented economy in view
of
restoring the ties of the Province with the Republic of Serbia and the
FR
of Yugoslavia which have been artificially broken;
- that all regulations and other decisions of UNMIK and KFOR which
violate
territorial integrity and sovereignty of the FR of Yugoslavia and the
Republic of Serbia be rescinded, that the respect for the laws in force
of
the FR of Yugoslavia and the Republic of Serbia be ensured on their
entire
territory; in that context, it most resolutely opposes the abuse of
authority
by UN SG Special Representative B. Kouchner in connection with civil
registration and local elections in the Province and planned procedure
to
establish parameters of "substantial autonomy", without direct
participation of the competent authorities of the FR of Yugoslavia and
the
Republic of Serbia, in accordance with the existing Yugoslav
legislation;
- to undertake energetic measures to put an end to terror, intimidation
and ill-treatment of Serbs, Roma, Muslims, Goranci, Turks and members of
other non-Albanian ethnic communities, as well as abuse of force which
results in violation of their fundamental human rights and efficiently
prevent further ethnic cleansing of the Province of non-Albanian
population;
- that all illegally seized State, public, socially-owned and private
property primarily PTT, power supply system, railway, banks, mines,
factories, firms, as well as private property of citizens of the
Province,
be returned to legal owners.
- that immediately a safe environment for all citizens and their full
personal safety and safety of their property be ensured;
- that a free and safe return to the Province be ensured without delay
to
more than 350,000 Serbs, Montenegrins, Roma, Goranci, Turks, Egyptians
and
other inhabitants expelled in a campaign of ethnic cleansing after UNMIK
and KFOR came to the Province;
- that several hundred thousand citizens of Albania who have illegally
entered the Province by crossing the unprotected Yugoslav State borders,
be
expelled immediately;
- that without further manipulations and delay, the combat structures of
the terrorist so-called KLA be disbanded and all its members disarmed as
well as other Albanian armed gangs, that all their weapons be destroyed,
which is the main reason for the lack of security in the Province and
for
overall thriving crime, and in particular to declare null an void the
document on the "transformation" of the so-called KLA;
- that, without delay, an unhampered return of the members of VJ and MUP
to Kosovo and Metohija be allowed, in compliance with the MTA, in the
interest of normalizing security and preventing further massive
expulsions
of the remaining Serbs and other non-Albanian population from the
Province;
- that full freedom of movement on the entire territory of the Province
be
ensured and that all existing ghettos, detention camps, blockading of
towns
and villages, such as Kosovska Mitrovica, Orahovac, Gnjilane and others,
where the remaining Serbs now live, be removed;
- that an unimpeded delivery of humanitarian assistance be enabled,
particularly to isolated Serbs, as the most vulnerable category of
population in the Province;
- that normal functioning of education, respect for the autonomy of
university and other educational and cultural institutions and the
media,
especially those in Serbian language and wherever Serbs are predominant
(Kosovska Mitrovica, etc.) be ensured;
- that full and permanent protection of remaining cultural and historic
monuments, medieval monasteries, churches and cemeteries be ensured and
to
undertake measures for their gradual restoration;
- that without delay, the leaders of the so-called KLA, H. Thaqi and A.
Cheku in the first place, as well as all other instigators of serious
crimes, genocide, ethnic cleansing and terrorist acts against the
non-Albanian population, their property and State and public property,
and
against cultural and historic sites, educational, health, commercial and
other institutions and facilities, be held accountable and punished in
an
exemplary fashion;
- that without any further delay, a comprehensive agreement between the
FR
of Yugoslavia and the United Nations on regulating the status of the
international presence under the auspices of the United Nations in
Kosovo
and Metohija and on other relevant issues, be concluded without further
delay.

II

O V E R V I E W
of terrorist and other acts of violence and of certain violations of
Security Council resolution 1244 (1999) in the Province of Kosovo and
Metohija since the arrival of KFOR and UNMIK in the period
from 10 June 1999 to 30 March 2000

(1) Number of terrorist attacks: 4,564

4,314 were committed against Serbs and Montenegrins, 104 against
Albanians
and 146 against Roma, Muslims, Goranci, Turks and members of other
nationalities.

(2) Number of killed persons: 936

835 were Serbs and Montenegrins, 72 were Albanians and 29 members of
other
nationalities in Kosovo and Metohija.

(3) Number of abducted and missing persons: 867

798 were Serbs and Montenegrins, 40 Albanians and 29 members of other
nationalities.
The fate of 744 persons is still unknown; 81 abducted persons were
killed,
6 persons escaped while 36 were released.

(4) Number of wounded persons: 876

824 were Serbs and Montenegrins, 20 Albanians and 32 other
nationalities.

(5) Ethnic cleansing: In the campaign of ethnic cleansing following the
deployment of KFOR and UNMIK over 350 000 Serbs, Montenegrins, Roma,
Muslims, Goranci, Turks and other non-Albanians were expelled from
Kosovo
and Metohija, of whom 270 000 are Serbs.

The following towns and villages are ethnically cleansed of Serbs, Roma,
Muslims, Goranci, Turks and other non-Albanians:
- Pri{tina (all Serbs have been driven from its largest suburbs of
Ulpijana, Su~ani Breg, Dardanija, Univerzitetsko Naselje). Of the 40 000
Serbs who used to live in Pri{tina before KFOR and UNMIK came to the
Province, 25 000 were schoolchildren and undergraduate students. Today,
only 35 Serb schoolchildren live there and attend classes a local school
in
the village of Laplje;
- Gnjilane, Uro{evac, Prizren (only 100 Serbian families remained);
- Djakovica, Pe}, Podujevo, Glogovac, as well as the wider areas of
Kosovska Mitrovica (Vu~itrn, Srbica), Lipljan, Kosovo Polje, from which
80
per cent of Serb residents were expelled (their homes are burned, looted
and property is seized from the owners of cafes and shops, while
Albanian
terrorists brutalize and mistreat those Serbs who refuse to sell their
homes and leave Kosovo and Metohija, in the presence of KFOR);
- the whole area covered by the municipalities of Istok and Klina
including
the villages: D`akovo, Osojane, Tu~epom, Ko{, @a~, Belica, Krnjine,
Mati~ane, Ka~anik, [timlje, Kmetova~ka Vrbica and others, where 3 440
Serbian homes were burned down;
- the surroundings of Uro{evac, Slivovo, Nedakovac, Nevoljane, Vrpica,
Lje{tar, @egra (municipality of Gnjilane), @itnje, Po`aranje, Grmovo,
Drobe{;
- the surroundings of Vitina (Kaba{, Bina~and other villages), the areas
of
Kosovska Kamenica (villages of Bratilovce, Firi}eja and others) and
Kosovsko Pomoravlje, as well as the villages of Topli~ane, Rujice,
Magure,
Slovinja, Staro Gracko, Klobukar in the municipality of Novo Brdo. (All
Serb houses have been burned down and all its owners forced to leave.)

Members of the terrorist "KLA" exercise particularly strong pressure on
the
region of Gora populated by an indigenous ethnic group - Goranci, who
are
not allowed to use their mother tongue, i.e. the Serbian language, in
schools and in everyday life, in an attempt to misrepresent this ethnic
group as members of Albanian nationality.

In the area of Istok municipality, expulsion of the Muslim ethnic
community, who are loyal citizens of the FR of Yugoslavia, has been
particularly intensified.

(6) The latest brutal crimes: Planting of explosives in the home of Azem
D`aferi, a Muslim, in Prizren (1 March 2000); shelling of the village of
Grabovac and a bombing of the building housing the training centre in
Obili} (3 March 2000); brutal attacks on Serbs in the villages of
Bostane
and Trni}evce (6 March 2000); terrorist bombings of the Serbian section
of
Kosovska Mitrovica, in which 19 Serbs were injured (7 March 2000);
shelling
of the Serbian village of Gora`devac (10 March 2000); brutal murder of
Srdjan Peri} by beating him about the head with a axe when the
terrorists
opened machinegun fire at a group of Serbs working in the field (11
March
2000); blasting of a railway overpass causing interruption of services
between Kosovska Mitrovica and Le{ak, municipality of Leposavi} (22
March
2000).

(7) New forms of terror against Serbs and other non-Albanian
population:
KFOR's security actions against Serbian and other non-Albanian
population
increasingly demonstrate force, harassment, physical violence, including
causing damage to Serb property. Drastic incidents occurred in Kosovska
Mitrovica (on 20-25 February) as well as in the villages of Mogila (on
25-26 February), in which Serbian houses were searched by using the
method
of most brutal physical violence, Draganovac (Gnjilane municipality) and
Mioli~e (Leposavi} municipality), Mali Zve~an (27 February), Gornje
Kusce
(1 March) and the Serbian villages of Rudare and Grabovac (1 March). The
searches were conducted by KFOR jointly with the terrorists of the
so-called KLA, who wore international security forces uniforms, thus
proving the co-ordination between KFOR and Albanian terrorists.

(8) Latest terrorist attacks on Serb convoys:
Attacks on the Serb convoys headed for [trpce, near the village of
Radivojce (on 22 and 29 February); attack on the Serb convoy en route to
Koreti{te, in the village of Dobri~ane (28 February); attack on the bus
transporting Serb children on their way back from school, on the orad
between Gornje Kusce and Koreti{te (29 February); Lieutenant Peter
Ramstel
(KFOR, Kosovska Mitrovica area) banned all KFOR security escorts for
buses
transporting Serbian schoolchildren and sick persons to Gra~anica (1
March); attacks against Serb convoys in the village of Koretin (6 and 20
March); repeated attacks against Serb convoys in Gnjilane (7 and 10
March);
an attack on a Serb convoy in the village of Dobrovce (27 March).

KFOR has not prevented these attacks by terrorists. Also, it has refused
to
provide security escorts between Merdare and Kosovo Polje. This is yet
an
additional pressure on Serbs to leave and flee the daily terror against
them in Kosovo Polje.

(9) Number of arbitrarily arrested persons by KFOR and UNMIK: 191
Arrested Serbs are detained in prisons in Pristina, Prizren, Sojevo near
Uro{evac, Kosovska Mitrovica, Gnjilane, Lipljan and Klokot Banja.

They have been arrested without any explanation or charges, only on the
ground of information provided by the Albanians, most frequently by the
members of the terrorist so-called "KLA".

(10) Prison and labour camps run by the so-called "KLA" for abducted
Serbs
The abducted Serb civilians are detained by the so-called "KLA" in the
labour camps located in the village of Mati~ane and in the wider area of
Prizren (Ortokal estate, a building situated on the road to Djakovica)
and
in Drenica.
The prisons run by the so-called "KLA" for Serbs, Montenegrin and other
residents who are not supportive of Albanian terrorists are also
situated
around the village of Brod, Draga{ municipality, and along the Djakovica
road towards the village of Junik, De~ani municipality, as well as in
the
villages of Glodjane, Izbica and Strovce in the Kosovska Mitrovica
district.



(11) Situation in Kosovska Mitrovica:
Since KFOR and UNMIK were deployed in Kosovo and Metohija, the security
situation is particularly serious in and around Kosovska Mitrovica,
characterized by:
- the looting and destruction of 2,365 homes belonging to Serbs,
Montenegrins and other non-Albanians (1,200 in Kosovska Mitrovica; 1,060
in
Vu~itrn; and 105 in Srbica);
- 700 Serbian families being thrown out of their flats (500 in southern
part of Kosovska Mitrovica; 150 in Vu~itrn; and 50 in Srbica);
- the looting and destruction of the property of the following
companies:
1. In Kosovska Mitrovica: Socially-owned companies "Kosovo-Sirovina",
"Betonjerka", "Lux", "AMD", "Kosmet-Prevoz", "Trans-Kosovo", Duvanska,
Minel, Zemljoradni~ka zadruga (cooperative), Hortikultura, Mitrov~anka,
DES, "Ibar-Ro`aje" warehouse, the utility company "Vodovod" (water), the
printing company "Progres", the public company "Elektro-Kosovo", PTT and
a
larger number of bars and cafes owned by non-Albanian residents.
2. In Vu~itrn: Socially-owned companies "Sartid", "Vu~itrn-Prevoz",
"Ratar", the local cooperative, the paints and coatings factory
"Ekstra",
the construction company "Kosovo", the utility company "Sitnica", the
private company "^i~avica", the Labour Exchange, the local community
centre, the municipal authorities of Vu~itrn, the Building Land Fund,
the
local department store, the Auditing Office building, Jugobanka, primary
and secondary schools, Jugopetrol, Beopetrol, the public company
"Elekro-Kosovo", PTT.
3. In Srbica: Hunting munitions factory, plastics factory, the
socially-owned company "Budu}nost", local cooperative, the public
utility
company, the socially-owned company "Dijamant-produkt", the local
community
centre, the local self-managing community of interest, the
socially-owned
company "@itopromet" and its silos.

(12) Recent killings and terrorizing of Albanians loyal to the FR of
Yugoslavia:
The terrorist so-called "KLA" has stepped up execution of Albanians who
do
not back it, in particular in the areas of Pri{tina, Podujevo and Pe}.
The
most drastic examples are: the murder of Hejdi Sejdiu, a member of the
Serbian Socialist Party Committee in the province, in his home town of
Uro{evac in front of his wife and three children (on 10 February), the
killing of Danu{ Januzi in Vitina (on 10 February); the massacre of
Tahir
Bekim, who was abducted and later killed by the terrorists of the
so-called
"KLA" (parts of his mutilated body were found on 24 February).

The terrorists of the"KLA" have burnt down the house of Selim Bro{i,
former
head of the Ministry of the Interior of the Province, in the village of
Odanovce, municipality of Kosovska Kamenica on 20 March 2000. They are
also
trying to catch Red`epi Sinan, former employee of the Ministry of the
Interior of the Province. Every day they are threatening Sadik Hajrulah
from Vitina, Ramadan Sermad`i, an employee of the Ministry of the
Interior
in Gnjilane, Minir Krasni}i from Kosovska Kamenica, as well as other
former
or present members of the Ministry of the Interior of the Province in
Gnjilane, who are of Albanian nationality.

Besides Serbs, the terrorist so-called "KLA" also round up Albanians
loyal
to the State of the FR of Yugoslavia and bring them to their prison
camps
(around the village of Brod, Draga{ municipality).

(13) Destruction of churches, monasteries and cultural monuments:
85 churches, monasteries and other cultural monuments were burned down,
demolished or seriously damaged including the following: the Church of
Assumption of Our Lady in Dolac, monastery of St. Marco in Kori{a from
1467, monastery of Prophets Kosmo and Damien in Zo~i{te from 14th
century,
the church in Kijevo from the 14th century, the Holy Trinity monastery
from
the 14th century near Mu{uti{te, monastery Devi~ built in 1440, Church
of
St. Paraskeva in Drenik from the 16th century, Church of St. Dimitri
near
Pe}, the Orthodox church in Grmovo near Vitina, Church of St. Ilija in
@egra near Gnjilane, church of Holy Mother in Mu{uti{te from 1315,
Church
of St. Prophet Ilija in Bistra`in, Church of Apostles Peter and Paul in
Suva Reka, monastery of St. Uro{ in Nerodimlje, monastery of St.
Archangel
Gabriel from the 14th century in Bina~, Church of the Holy Virgin from
the
16th century in Belo Polje, Church of St. John the Baptist in Pe}ka
Banja,
churches in the villages of Naklo, Vu~itrn, Petrovac, Uro{evac,
Podgorce,
Djurakovac, Kru{evo, Osojane, Samodre`a, Dresna near Klina, Rekovac,
Petri~, monastery Bina~ near Vitina, Holy Trinity Cathedral in
Djakovica,
St. Nicholas' Church in Gnjilane.

Clergy, monks were terrorized and persecuted. More than 150 parish
residences were destroyed or damaged. Over 10,000 icons and other sacred
objects, most of which are cultural monuments and landmarks under the
special protection of the State, were stolen or destroyed.

Assaults on members of the Catholic religious community by the
terrorists
of the so-called "KLA" have become more and more frequent in Prizren and
Pe}, particularly assaults on clergymen (The homes of two Franciscan
priests were burned down.).

The following cultural monuments were damaged or demolished:
- monuments in memory of the giants of Serbian and Montenegrin
literature
Vuk Karad`i? and Petar Petrovi} Njego{ in the very centre of Pri{tina;
- monuments in memory of King Uro{ in Uro{evac and King Du{an in
Prizren;
- memorial to Prince Lazar in Gnjilane and the memorial to Serbian
rulers
from the Nemanji} dynasty in the village of Gornje Nerodimlje;
- memorial to Milo{ Obili} which was the symbol of the town of Obili}.
KFOR
have placed the damaged statue within the compounds of the thermal power
plant "Kosovo B".

Many of the destroyed monuments are outstanding examples of the Serbian
cultural heritage and are on the list of the monuments of exceptional
cultural value under the protection of UNESCO.

(14) Forced and illegal taking over of public institutions:
- Forcible and illegal take-overs of premises and buildings of post
offices, banks, medical institutions, water and power supply systems,
university, elementary and secondary schools, municipal and other
authorities of local administration, local communes, buildings of the
Ministry of the Interior and the Army of Yugoslavia, factories,
enterprises, cooperatives, etc. in Pri{tina (premises of the Clinical
Centre "Pri{tina" and the health station whose equipment has been stolen
and taken to private practices, the Federal Customs Administration, the
Public Housing Company, the Institute for Urban Planning, the public
enterprise "Vodovod", thermal power plant "Kosovo B", depots and petrol
stations of "Jugopetrol", the shareholding companies "Kosmet-Pri{tina",
"Kosovo-Trans", the public enterprise "Energoinvest", the public
enterprise
"Autopri{tina", the car shock absorbers factory, "Jugotrans", etc.) as
well as in Prizren, Draga{, Podujevo, Lipljan, [trpci, Kosovska
Mitrovica,

Iniziativa a Ravenna il 28 Aprile
La prossima iniziativa a Ravenna ci sarà il 28 aprile, ore 21 alla sala
Melandri (Via Ponte Marino), con al presentazione
della "sezione italiana del tribunale internazionale contro i crimini
della Nato in Jugoslavia". Il tribunale internazionale è
nato su proposta di Ramsey Clark (ex ministro della giustizia americano)
con l'adesione di magistrati, avvocati, militanti,
ecc. da tutto il mondo. Si proietterà il video "Bombe sulle Fabbriche
Chimiche" e sarà disponibile un opuscolo di
presentazione del tribunale indipendente (3.000 lire). Ovviamente si
raccoglieranno le firme contro l’embargo all’Iraq. La
serata è organizzata dal "Comitato Contro la Guerra e la Nato" di
Ravenna e dal "Coordinamento Romagnolo Contro la

TUTTE LE RAGIONI DELL'AFRICA


I leaders europei, e primo tra tutti il Presidente della Commissione
Europea Romano Prodi, sono rimasti profondamente scioccati lo scorso 3
aprile sentendosi raccontare dal colonnello Gheddafi alcune elementari
verita', verita' che avrebbero preferito dimenticare.

E' successo al summit euro-asiatico del Cairo, in Egitto. Senza mezze
parole o reticenze, Gheddafi ha ricordato le colpe storiche dell'Europa
rispetto all'Africa, a cominciare dalla pregiudiziale razzista e fino ai
danni prodotti dai vari colonialismi. Ha poi spiegato che nemmeno
l'Europa puo' essere libera se non si libera del fardello della NATO, e
che il Mediterraneo deve certo ritornare ad unire Europa ed Africa, ma
che questo non e' proprio semplice finche' vi stazioneranno le portaerei
statunitensi. Sulla attitudine di impartire lezioni di democrazia -
attitudine oggigiorno particolarmente di moda in paesi come l'Italia
dove tuttavia lo stesso Parlamento e' espropriato delle sue facolta'
decisionali su temi piuttosto cruciali quali la guerra contro un paese
vicino - Gheddafi ha chiarito agli ipocriti che "l'Africa non ha bisogno
di importare democrazia, ma piuttosto medicinali e pompe per l'acqua".

Grave il disappunto degli Europei, che non si erano certo mossi dai
sontuosi palazzi delle rispettive capitali per sentire parlare di acqua,
ma piuttosto di petrolio e gas naturali.

PALE

One of the best known representatives of the authorities in the Republic
of
Srpska, former President of the Republika Srpska Assembly, a member of
Bosnia and Hercegovina's Presidency, and a participant at the Dayton
peace
conference, Momcilo Krajisnik, was arrested and taken to the Hague on
Monday. This was accomplished in a most brutal way by the International
forces in Bosnia and Hercegovina.

On Monday morning SFOR troops entered his house, broke down the door
with
dynamite, tied up his children, and locked his parents in the kitchen.
Krajisnik was taken in his pyjamas, barefooted, to be accused of so
called
"genocide" and "crimes against humanity".

BELGRADE

The Yugoslav Foreign Ministry on Monday condemned the perfidious arrest
of
Momcilo Krajisnik, former Republika Srpska (R.S.) parliamentary speaker
and
member of Bosnia's three-man presidency, by Bosnia's Stabilisation Force
(SFOR). In a statement issued by the Ministry it is said that this
shameless
and scandalous act by NATO-led SFOR was a direct attack on the Dayton
peace
agreements. This is the latest and most dramatic form of activity, made
on
the eve of Bosnia's elections, aimed at stifling democracy and
intimidating
and discriminating against the Serbs with a view of promoting the U.S.
administration's and NATO's puppet regime, which would seek to create a
unitary Bosnia-Herzegovina and eliminate Republika Srpska an equal
entity in
Bosnia. This act of violence clearly indicates that NATO continues its
policy of genocide against Serbs in an organised manner. By minimising
the
importance of the Dayton and Paris agreement, initial results in
restoring
confidence, security and safety in Bosnia-Herzegovina are annulled.
SFOR's
action has once again shown that force is an instrument openly used by
NATO,
which unequivocally indicates that the United Nations has been totally
outmanoeuvred. The peacekeeping mission has been taken advantage of in
political, legal and moral principles in international relations. They
have
enabled the policy of force to usurp their role of supreme arbiter in
the
world. The arrest of Krajisnik shows that the so-called Hague tribunal
operates only as an illegitimate political body with a task to ensure
the
collective punishment of all the Serbs, announced the Yugoslav Foreign
Affairs Ministry. Momcilo Krajisnik arrest has been severely condemned
by
the Socialist Party of Serbia, the Yugoslav United Left, the Serbian
Radical
Party, and numerous other political parties, organisations and
associations.

It is practically unknown that the attorneys and
law professors responsible for the above documents met
the War Crimes Tribunal Prosecutor on 9 June 1999 to
discuss the indictment of NATO. The following day, she
was made a judge of the Canadian Supreme Court
and resigned as the Tribunal's prosecutor!

Professor of Law, Michael Mandel, wants 64 of NATO's
leaders indicted for War Crimes as a result of NATO's
bombing. On 11 June 1999, Mandel gave a devastating

Before sending this text to the states members of the Security Council
of the UN I'd like to have
anybody's well-intentioned comments and/or suggestions. Especially about
what kind of action
would be most appropriate in order to succeed in the basic aim of this
initiative: to abolish this
perverse institution, which is a disgrace to the concept of justice. It
is now the main tool for satanisation of the Serbs and political and
psychological pressure on them and their state.


INTERNATIONAL TRIBUNAL FOR THE PROSECUTION OF PERSONS
RESPONSIBLE FOR SERIOUS VIOLATIONS OF INTERNATIONAL
HUMANITARIAN LAW COMMITTED IN THE TERRITORY OF THE FORMER
YUGOSLAVIA SINCE 1991

REQUEST TO THE SECURITY COUNCIL

FOR ITS CANCELLATION


Indeed, the idea to exclude from criminal prosecution of
those who inspired, planned,
assisted (including weapons), ignited and conducted secessionist wars in
Slovenia, Croatia and
Bosnia and Herzegovina, and prosecute only those who while killing one
another failed to stick to the
certain stipulated rules (the rules of international humanitarian law),
could be born only in pervert and
sick minds. Who those minds are is difficult to say, but it is known
that they are coming from
Clinton's and Kohl's environment. The predominant ones are, no doubt,
Madeleine Albright, Samuel
Berger, Daniel Sheffer, James Rubin, William Cohen, Lawrence
Eagleburger, Richard Goldstone,
the Nazi Hans Dietrich Genscher and who knows who not. The oddest thing
of all is, certainly, how
the official politics of USA, Germany and many other states could accept
such an ugly idea for its
official attitude and impose it to the Security Council of the United
Nations which established a court
based on such an idea. It is well known that London Agreement of 8
August 1945 (which is, of
course, still in force) on punishment of the main Nazi criminals and its
Statute, in the first place
incriminate exactly "the crimes against peace: namely, planning,
preparation, initiation or waging of
a war of aggression, or a war in violation of international treaties,
agreements or assurances, or
participation in a common plan or conspiracy for the accomplishment of
any of the foregoing.
Leaders, organisers, instigators and accomplices participating in the
formulation or execution of a
common plan or conspiracy to commit any of the foregoing crimes are
responsible for all acts
performed by any persons in execution of such plan." (Article 6 (a) of
the Statute of the Tribunal).
Violent secession - especially the one endangering international peace
and security as were those that
broke SFR Yugoslavia into pieces - surely fit into the formulation of
the crime against peace.



From the time when someone had an idea to establish such a
tribunal until nowadays, the
Tribunal has been called in question both on the grounds of the body
which established it (The
Security Council of the United Nations) and on the grounds of its
jurisdiction ("trial of the persons
responsible for the serious violations of the international humanitarian
law in the territory of the former
Yugoslavia since 1 January 1991."! It has been contradicted not only by
all the people who are
significant for the international humanitarian law, but also by all the
people with common sense. It can
be said that the Tribunal was established by the people who had no
connection with international
law, the inventors of the concept of "The New World Order" according to
which the force and
political violence is the only "law" recognised by them. Still we should
define why the Serbian nation
was chosen for implementation of that concept. Why the mere attempt of
Serbian nation to
defend its country from the secessionist crime pronounced to be the
crime, while at the
same time that right is recognised to all other nations? Even the chief
sheriff of the New World
Order does not deny that right to the others. On 19 November 1999, on
the Summit of Organization
for Security and Co-operation in Europe, held in Istanbul Clinton said:
"We believe Russia has not
only the right, but the obligation to defend its territorial integrity".
Instead of recognition of the same
right to the Serbian nation, its striving to keep its state is
pronounced to be a crime and the Tribunal
is established for its punishing!!



I



1. Establishment and jurisdiction of the Tribunal



This Tribunal was, as it is well known, established by
Resolution 827 of the Security
Council of the United Nations of 25 May 1993. Invoking the Chapter VII
of the United Nations
Charter, the Resolution states that the Tribunal has been established
"solely for prosecution of the
persons responsible for serious violations of international humanitarian
law committed in the territory
of the former Yugoslavia between 1 January 1991 until the date which
shall be determined by the
Security Council after the peace establishment." At the end, under item
9, the Resolution states that
the Council "decides to remain actively seized of the matter".



Statute of the Tribunal, adopted by the Security Council in
the foregoing Resolution, has
determined that this "Tribunal" has jurisdiction as regards the
following crimes:



- grave breaches of the 1949 Geneva Conventions (Article 2),

- violations of the laws or customs of war (Article 3),

- genocide (Article 4) and

- crimes against humanity (Article 5).



So, the Security Council has not - as it was emphasised in
the beginning of the text -
given jurisdiction to the Tribunal regarding crimes against peace and
security of the
humanity as aggression, planning and conducting secessionist war and
alike. The reason is
obvious - in order not to prosecute those who directed and ignited
Yugoslav tragedy, that is the
leaders of Yugoslav secessionist republics and their foreign protectors,
masters and other
accomplices. In other words, the Security Council sent the message to
Yugoslavs: it is all
right to kill one another, but it is not all right to do it without
compliance with the rules
stated under the Articles 2-5 of the Statute!



And, that is not all! The Statute defined the foregoing
crimes, but in many ways
differently than they were defined by modern international law! In that
manner the Security
Council took the role of legislator to which, of course, it is not
entitled according to the
United Nations Charter!



Pursuant to the Article 24, paragraph 1 of the Statute, the
Security Council has even
abolished capital punishment for international crimes, although it was
introduced by the
Article 27 of the Statute of the Tribunal for trial of Nazis. Of course,
one may be for or
against capital punishment, but it is certainly not in the competence of
the Security Council
to decide whether it shall exist in international law or be abolished.



It should be also emphasised that the crimes as stated under
the Articles 2 and 3
(violations of Geneva Conventions and war laws and customs) may be
committed only in
the armed conflicts of international character, not in internal
conflicts. That way the Security
Council beforehand took the position that the conflict in Yugoslavia was
of an international character,
although the real answer to that question may come only from the science
of international law, and
not from the Security Council, which is a political and not an expert
body.



Apart from the fact that the jurisdiction of the Tribunal is
limited, only to ius in bello, and
not to ius ad bellum, the territorial limitation ("region of former
Yugoslavia") as well as time limit
("since 1 January 1991") give special dimension of absurdity to this
institution.



Russia and NR China voted for this Resolution as well.

As we can see Russia and NR China do not have their judges
in the Tribunal.



The Tribunal has so far grown up in a monster consisting of
832 officers from 68 states,
handling budget of 95,942.600 dollars for 2000 - ten times more than the
International Court of
Justice! It is financed by mostly USA and Arab states.





3. Work of the Tribunal (for more details see FACT SHEET on
www.un.org/icty)



Up to now 93 persons were accused, most of them being Serbs.
Out of these 93
accused, seven died - two in casemates of the Tribunal under
questionable circumstances
(Dokmanovic and Kovacevic), while the two were killed by SFOR while
trying to kidnap them in
Bosnia (Drljaca and Gagovic).



In the cells of Tribunal in the Hague there are 35
prisoners, 30 of them being Bosnian Serbs
among whom there are generals of the Army of Republic of Srpska Momir
Talic (kidnapped in
Vienna, under the Tribunal's order, by Austrian police while attending
international gathering under
the auspices of the OSCE and Austrian Ministry of Defence!!!), Radislav
Krstic and Milan Simic, 4
Croats and 1 Muslim. This very fact speaks against whom this Tribunal
has been established. So far,
the Tribunal brought several verdicts. Of course, it cannot be said how
many person shall be indicted
and who are those persons, even more because its practice is to have
so-called "secret indictments".
As it is well-known, the Tribunal also indicted citizens of FR
Yugoslavia - Slobodan Milosevic,
President of FRY; Milan Milutinovic, President of Serbia; Nikola
Sainovic, Dragoljub Ojdanic,
Vlajko Stojiljkovic, Mile Mrksic, Miroslav Radic and Veselin
Sljivancanin.



On the basis of the indictment against the president of FR
Yugoslavia and other high officials,
the United States of America has these days committed crime without
precedent in the international
relations: it offered 5 million dollar reward to anyone who helps their
kidnapping, murder and alike.
By this the current regime in USA showed and proved that it outlawed and
placed itself out of
civilisation norms, as well as introduced the "Wild West law" in the
international relations, while the
Tribunal showed to be blind instrument of that politics, not a court of
law and justice.



Not one of the persons accused by the Tribunal is
responsible for the war. The war
was imposed to them; they are its victims as the millions of Yugoslavs.
On the other hand,
Tribunal did not accuse any of the real culprits for Yugoslav tragedy:
leaders of
secessionist republics and their foreign planners, instigators and other
accomplices from
USA, EU, NATO and Vatican. This fact best indicates the true nature of
the Tribunal.
Although the author of this text addressed the Tribunal several times -
more precisely 23 May 1995,
4 September 1995, 14 October 1995, 9 May 1996, 2 July 1997 and 21 July
1998 - requesting
initiation of the criminal proceedings against all these main culprits
for Yugoslav tragedy and
endangering international peace and security, the Tribunal and its chief
prosecutor did nothing. The
Nuremberg and the Tokyo tribunals did exactly that: they tried main
criminals, while all others were
left to national courts.



Furthermore, the chief prosecutor of the Tribunal Carla Del
Ponte persistently
refuses to initiate investigation and procedure against the leaders of
the NATO member
states and officials of that aggressor alliance for aggression on FR
Yugoslavia and on that
occasion committed crimes, though she herself says that she received
numerous requests
(including mine - 12 October 1998, 21 February 1999, 29 March 1999 and
15 May 1999) and
voluminous documentation accusing them, including evidence submitted by
Russian Duma.





II





Since the first day of its existence, the Tribunal has been
challenged on all the grounds not
only by numerous international lawyers but also by many other people
with common sense. Many
arguments have been presented that it is the instrument of politics of
force of the United States of
America and its satellites (NATO and EU) for destruction of Yugoslavia
(former and current) and all
the Serbian nation and not court of law. At the same time, the people in
Yugoslavia constantly
wander how it is possible that Russia and China did nothing to oppose
the establishment of this
institution, which represents mockery of justice and equity.



In challenging this institution, first of all it is
emphasised that the Security Council of the
United Nations had no right according to the United Nations Charter to
establish international
criminal court, to limit its jurisdiction territorially and temporally,
to prescribe for which international
crimes it shall have jurisdiction and for which not by excluding its
jurisdiction with regards to the most
serious crimes against peace and security such as aggression, armed
secession, intervention in
internal affairs, international terrorism. It is also emphasised that it
was a political self-will of the
Security Council aimed against Serbian nation, that the real goal of
establishment of this Tribunal was
pointing a finger at the party which was not responsible in order to
protect the real culprits, etc.
Therefore, FR Yugoslavia did not recognise this Tribunal until it was
forced to sign, although vague,
obligation of co-operation with it in Dayton. The Americans, by
permanent pressure to satisfy all the
Tribunal's requests, constantly terrorise FR Yugoslavia and the entire
Serbian nation.



If the Security Council of the United Nations by
establishing this Tribunal (and the one for
Rwanda) overstepped its authorisations and resorted to self-will, it has
done it even in greater and
more dangerous degree by prescribing new international crimes by the
Statute of the Tribunal
for Yugoslavia, thus awarding itself with legislator's function in the
international field! In
fact, pursuant to the Articles 2 and 3 of the Statute, the Council
prescribed that the rules of
international humanitarian law, which are otherwise referring to the
international armed conflicts,
should apply to the armed conflict in Yugoslavia, although it is
non-international (internal)
armed conflict for which the legal rules referring to the internal
conflicts should be valid, i.e., first of
all the joint Article 3 of the 1949 Geneva Conventions and Supplemental
Protocol II to these
Conventions adopted in 1977. Furthermore, if the Article 5 of the
Statute could be considered to be
valid for the case of war and in peace, the Security Council added to
that Article some of its own
"rules" which are not part of modern international humanitarian law,
such as "jail", "torture", "rape",
"other non-humane actions" (?!).



Because of such a state of affairs, international lawyers
more and more often demand that the
issue of judicial, i.e. legal, control of the decisions and documents of
the organisation of the United
Nations is to be solved urgently, and first of all the decision of the
Security Council, so as to prevent
its self-will.



The course of the trials so far before this Tribunal
indicate what the real role and power of
this Tribunal is, and it shall be even clearer. For example, in the
beginning of the trial of the Serbian
Dusko Tadic we heard the prosecutor and one witness of the prosecution,
a James Gau, British, as
"an expert for Yugoslav affairs". In reply to the key question who holds
responsibility for the
destruction of Yugoslavia and commencement of war, they say the same
what their paymasters
are blowing into the trumpet from the very beginning: Serbs! Since they
could not possibly deny
the fact that any normal person knows that the Serbs fought to remain in
Yugoslavia and
that the others left it by anti-constitutional violent secession, they
say: well, they had to,
because they had good reasons to be afraid of Serbian nationalism! And
so on. Some signs show
that the things will not go the way they imagined. For instance, the
President of the Trial Chamber of
the Court in Tadic case as well as the Defence asked some, for them
unpleasant questions such as:
how Yugoslav National Army could be occupier in its own country?! "Could
American Army
occupy, e.g. Texas?", asked the President of the Trial Chamber American
Gabriella Kirk
McDonald. Does the state have right to defend itself from secession? The
American surely knows
history of her country that well to be aware how the former president of
her country Lincoln dealt
with secession. Furthermore, the sentence of Tadic caused headache to
the Tribunal's inventors:
namely, the sentence stated that it was non-international armed conflict
in Bosnia, which means that it
was civil war, and not the international, on which the prosecution
insisted. That annihilates the entire
concept, the entire "philosophy" of the enemy of the Serbian nation -
that the war in Bosnia and
Croatia was in fact aggression, of course made by FR Yugoslavia.
Therefore the Tribunal's
prosecutor lodged a complaint against the judgement, and the Tribunal
was ordered to revoke this
judgement and bring another according to which the conflict in Bosnia
would be of "international
character"! Consequently, the norms of international law regulating
internal conflicts have not been
applied for the war conducted on some parts of the former Yugoslavia,
precisely the common Article
3 of the Geneva Conventions and Protocol II, but the norms covering
armed conflicts of international
character!



All the above indicates that it is high time to initiate in
the Security Council the question of
abolishment of this Tribunal, which represents monstrous monument to the
tyranny of the Untied
States of America and their satellites over a small state and small
nation which was in the First and
Second World War exposed to the horrible genocide by Croat and Muslim
Ustasha's (pro-fascist
collaborators) and Nazis. That genocide is now continued by USA and
their NATO and EU
satellites by means of sanctions, aggression and political isolation and
terror. In these crimes Tribunal
is one of the most efficient instruments. Not only that it has to be
abolished as soon as possible, but it
should not have ever been established.



Therefore, the Security Council of the Untied Nations should
bring the following decision on
the grounds of the item 9 of its Resolution 827:



1. The International Criminal Tribunal for Former Yugoslavia
is abolished.



2. All the convicted or accused persons who are in the
prisons of the Tribunal are to
be delivered to their national states for the procedure before the
jurisdictional courts for
the crimes imputed to them, together with all the documentation and
evidence in their
possession. The Security Council shall control how the states are
conducting the criminal
procedures for the violation of the international humanitarian law and
shall take the
necessary measures - including sanctions anticipated by the United
Nations Charter -
against those states which would in any manner avoid objective and fair
actions.



3. All the states are called on to ratify the Rome Statute
of the International
Criminal Court as soon as possible, in order that the international
community could have a
real, permanent international criminal court like the International
Court of Justice.

IL FASCISMO ITALIANO E GLI USTASCIA
di PASQUALE JUSO, GANGEMI EDITORE, 1998, ROMA

Il testo è dedicato alle relazioni che il regime fascista italiano
intrattenne con il movimento separatista croato degli ustascia. Rapporti
che si ebbero a partire del 1928 fino alla Seconda guerra mondiale (il
testo arriva fino al 1941, anno in cui venne costituito lo Stato
Indipendente Croato).
Secondo l'Autore, l'intervento italiano si svolse su tre livelli
distinti:
1) A livello diplomatico, l'Italia cercò di creare una sorta di "cordone
sanitario" attorno al Regno di Jugoslavia. Infatti, tra il 1928 e il
1934, Roma allacciò stretti rapporti diplomatici con Albania, Austria,
Ungheria e Bulgaria, allo scopo di favorire sia il separatismo
antijugoslavo, sia l'istituzione di un contrappeso alla Piccola Intesa
formata da Francia, Jugoslavia, Romania e Cecoslovacchia.
2) A livello di appoggio, in territorio italiano, del movimento
ustascia; infatti Ante Pavelich venne ospitato in Italia a partire dal
1929. Inoltre a Como venne istituito un centro di reclutamento che fu
spostato, in seguito, prima a Bologna (Oliveto), poi a Lucca e infine in
Abruzzo. Furono anche costituiti due organi istituzionali preposti alla
logistica e al controllo del movimento ustascia operante in Italia:
- l'Ufficio Croazia, nato, nei primi anni '30, dall'Ufficio Albania del
Ministero degli esteri, diretto inizialmente da Cortese, quindi in
seguito da Mazzantini e poi da Vidau.
- l'Ufficio Speciale del Ministero degli interni affidato al questore
Conti, destinato a controllare e a gestire direttamente la presenza
ustascia in Italia. Tale ufficio si occupava dell'addestramento
militare, del vettovagliamento, della logistica e perfino dei debiti
lasciati dai singoli ustascia.
3) A livello "Occulto" (come lo definisce l'Autore); si trattava
dell'intervento diretto ad appoggiare il movimento ustascia in
Jugoslavia (terrorismo, sabotaggi, ecc.). Perciò furono istituite due
basi di appoggio operativo: una a Trieste affidata a tal
Godina e un campo di addestramento militare situata a Janka Pusza in
Ungheria e diretta da un ex-ufficiale dell'esercito austroungarico:
Servatzi.
All'indomani dell'assassinio del Re di Jugoslavia, Mussolini, per timore
che si scoprissero i legami tra Italia e ustascia (e anche dalle
preoccupazioni suscitate dall'intromissione nazista nell'assassinio di
Marsiglia), fece trasferire nelle Isole Eolie e in paesi dell'entroterra
del messinese, la maggior parte dei profughi separatisti croati. A meta'
del 1937 risultavano presenti in Italia circa 550 ustascia, ma dopo
l'accordo tra Ciano e Stoijadinovich, iniziò il rimpatrio di parte di
tali profughi. Questa operazione si svolse, però, molto lentamente,
tanto che alla vigilia dell'attacco alla Jugoslavia risultavano
rimpatriati neanche la metà dei profughi. Ciò era dovuto soprattutto al
fatto di non consegnare né gli ustascia addestrati nei campi fascisti,
nè i quadri e dirigenti del movimento. Per Mussolini essi
rappresentavano un'importante carta da giocare contro la penetrazione
tedesca nei Balcani. Inoltre, molti rimpatriati (tra cui Budak, già
braccio destro di Paveliche e che Stoijadinovich aveva con tattato per
risolvere la questione croata, ma in realtà per fare pressioni su
Machek, l'altro leader del separatismo croato, allo scopo di indurlo a
un accordo di governo in cambio dell'autonomia alla Croazia nell'ambito
del regno) ripresero la lotta armata contro il regime centrale di
Belgrado.

Tre incisi:
- Godina, Servatzi e gli altri coinvolti nelle operazioni "occulte",
furono tenuti lontani dagli altri separatisti presenti in Italia, ciò
allo scopo di non rilevare il grado di coinvolgimento del regime
fascista nei tentativi di distruzione dello stato balcanico.
- Assieme agli ustascia, l'Italia aveva dato ospitalità anche a Bandera
e ad altri nazionalisti ucraini che gli ustascia volevano utilizzare per
suscitare la rivolta della minoranza ucraina presente in Jugoslavia.
Si nota quindi che nella storia dei tentativi di compiere la distruzione
della Jugoslavia, l'Italia, allora come oggi, è sempre stata in prima
fila.
- Nel periodo che va dall'assassinio di re Alessandro alla creazione
dello stato ustascia, Pavelich decise di intrattenere sempre più stretti
rapporti con il nazismo, allo scopo di giocare sulle rivalità tra Roma e
Berlino e ampliare, quindi, il proprio margine di manovra. L'Autore fa
notare, però, che questo tentativo si risolse in una sempre più
accentuata sudditanza degli ustascia ai dettami politico-strategici di
Hitler.

Il quadro storico tratteggiato dall'Autore e', però, troppo ristretto
all'ambito della storia delle istituzioni politiche italiane; infatti
manca una analisi ampliata al livello europeo del movimento ustascia.
Mentre si da un quadro dettagliato dei conflitti interni alla colonia
ustascia in Italia, manca una spiegazione approfondita del processo di
avvicinamento del movimento ustascia alla Germania nazista.

Dopo l'entusiasmo, l'attesa: sotto esame il nuovo governo

Sconfitto il regime, resta uno stato in bancarotta "Ma non si risolve
privatizzando", critica la sinistra

Negli ultimi due tre mesi, improvvisamente la Croazia è diventata il
fiore
all'occhiello di molti statisti europei e d'oltre oceano. Viene da
chiedersi come mai, allora - nonostante le denunce degli organismi
dell'Onu, degli osservatori dell'Osce, della stessa Unione europea e del
Tribunale internazionale dell'Aja (al cui mandato di cattura per crimini
di
guerra Franjo Tudjman è sfuggito, morendo) - come mai, ripetiamo,
l'Occidente ha direttamente o indirettamente sostenuto e alimentato il
regime di Tudjman per dieci anni, fino alla morte del dittatore, facendo
ben poco per aiutare le forze democratiche croate nella loro difficile
lotta per abbattere col voto un regime supernazionalista, filofascista e
fondamentalmente antieuropeo.

Nella speranza che le promesse fatte nelle ultime dieci e più settimane
dallo stesso Occidente, di dare una mano al nuovo governo democratico
croato per facilitare il rientro dei profughi serbi in Croazia e il
ripristino dei diritti umani e civili, per migliorare la posizione
socio-politica delle minoranze nazionali, per la deustascizzazione delle
strutture create dal vecchio regime, eccetera, ascoltiamo una voce fuori
dal coro, una delle poche ma autorevoli voci della sinistra in Croazia.

Stipe Suvar, presidente del piccolo ma battagliero Partito socialista
operaio, fu l'ultimo massimo esponente della Croazia nella presidenza
collettiva della Repubblica socialista federativa di Jugoslavia fino
alla
vigilia della sua dissoluzione. Ed è stato il primo a criticare, da
sinistra, il nuovo governo del socialdemocratico Ivica Racan, perché "ha
proclamato una politica di radicale privatizzazione" delle industrie e
aziende di proprietà sociale o statale ereditate dal socialismo
autogestionario - che il regime tudjmaniano non era riuscito ancora a
vendere ai nuovi tycoons .

Svendita dei beni comuni

"Si va - dice Suvar - verso un'ulteriore svendita dei gioielli di
famiglia,
delle capacità produttive e di altri beni nazionali": destinati a finire
in
gran parte nelle mani di compagnie straniere, tedesche in primo luogo,
dalle telecomunicazioni alle banche, all'industria petrolchimica. Suvar
critica anche la scelta di una politica fiscale che dovrebbe stimolare
gli
investimenti, "ma tenendo conto più del capitale che del lavoro".

Suscita particolare malumore nella sinistra croata il fatto che il
governo,
nonostante le promesse elettorali, non abbia ancora affrontato la
revisione
o l'annullamento della "pretvorba", ovvero le ruberie commesse nel
processo
di trasformazione della proprietà statale in altri tipi di proprietà e
di
gestione. In molti casi il passaggio di proprietà è stato fittizio e ha
permesso a poche centinaia di speculatori, gerarchi del regime
tudjmaniano,
di impossessarsi gratuitamente o quasi di industrie e catene
commerciali,
arricchendosi a dismisura a spese dei lavoratori, gran parte dei quali
sono
stati gettati sul lastrico dai nuovi padroni, o privati dei diritti più
elementari.

Quando si comincerà a scovare i ladri e a punirli? - si chiede Suvar,
interpretando il pensiero di mezzo milione di operai mal pagati (su un
milione tra stipendiati e salariati) e di circa 400 mila disoccupati su
una
popolazione di appena 4 milioni e mezzo di abitanti. E non parliamo
della
legge sul lavoro in vigore: una legge tudjmaniana, da Suvar definita
"scandalosa" - certo la peggiore in Europa dopo quella della
Bosnia-Erzegovina - in cui è assente qualsiasi norma a tutela del lavoro
e
degli interessi dei lavoratori.

Lo stesso termine "lavoratore" è stato cancellato dal vocabolario croato
e
dalle leggi: non esistono lavoratori né operai, e invece è stato coniato
un
neologismo che, tradotto, significa "colui che riceve il lavoro". E
questo
"colui" può essere licenziato in qualsiasi momento e senza spiegazione.
"Esistono, dunque - dice Suvar - molti elementi che suscitano dubbi
sulla
qualifica di centro-sinistra data a questo governo". Secondo il nostro
interlocutore, "non è vero che la Croazia abbia svoltato a sinistra"; il
regime è stato destituito perché la gente "ha finalmente capito che la
Croazia stava andando alla rovina", che si erano dimostrate false le
promesse di Tudjman nel 1990, di "una società di benessere e felicità".
Il
paese è anzi precipitato nella miseria, e la popolazione ha reagito
abbattendo il regime dell'Hdz, portando al potere le forze politiche
rimaste per anni all'opposizione.

"Ma - insiste Suvar - non vedo un orientamento a sinistra, nelle prime
mosse, e nelle altre annunciate, del nuovo governo; e neppure nel
programma
del 'nuovo corso' indicato nella campagna elettorale dei due principali
partiti - socialdemocratico e social-liberale -che guidano l'attuale
governo esapartito".

Il leader della sinistra croata non può non ammettere che c'è stata una
"svolta democratica", e che le nuove forze al governo hanno almeno
salvato
il paese da un regime autoritario e filofascista. Teme, però, una fase
di
delusione e frustrazione delle "masse popolari che hanno votato non solo
per cambiare il regime, ma anche e soprattutto sperando che molte cose

bancarotta, uno Stato con le casse praticamente vuote, e circa 20
miliardi
di dollari di debiti (esteri e interni), ma attenzione: "una
disillusione
provocata dall'inerzia e dall'inefficienza potrebbe portare a rivolte
sociali". Ancora, nota Suvar, seppur sono stati sostituiti ministri,
viceministri, capi-dipartimento, direttori generali dei principali enti
statali, "sono però rimasti grossi papaveri del vecchio regime".

SCONFINAMENTI


Per verificare che truppe della Armata Jugoslava non avessero
"sconfinato" portandosi troppo vicino al confine amministrativo della
provincia jugoslava del Kosmet, soldati provenienti dalla Gran Bretagna
(sita tra l'Oceano Atlantico ed il Mare del Nord), guidati dal
Brigadiere Generale Richard Shirreff, hanno sconfinato lo scorso 29
marzo al di fuori dei confini del Kosmet, nella zona-cuscinetto di tre
chilometri posta tra la provincia jugoslava ed il resto della RF di
Jugoslavia.
Poco dopo, il 3 aprile 2000 la Turchia, che e' impegnata in Kosmet con
propri soldati ed armamenti ad impedire una presunta "pulizia etnica"
attraverso l'appoggio ai gruppi dei terroristi irredentisti dell'UCK, ha
sconfinato in uno Stato vicino (l'Iraq) con circa 1000 soldati e jet
F-16 per inseguire i "terroristi irredentisti" curdi, gia' scappati dal
territorio turco a causa delle continue operazioni di pulizia etnica
dell'esercito turco.

(Per la cronaca, in passato gli aerei turchi sono arrivati fin sopra il
territorio iraniano per bombardare. Inoltre, la Turchia occupa
illegalmente una parte dell'isola di Cipro da piu' di venti anni).
