Od danas u Institutu "Vinca" pocinje GENERALNI STRAJK (prva faza).
Juce su kolege iz "Vince" odrzale uspesnu konferenciju za stampu, koja
je bila veoma posecena. O tome mozete citati u svim dnevnim listovima
(spisak je prilozen), kao i na Web stranicama

Kako dodatak ovoj poruce se nalazi:

1. Saopstenje Strajkackog odbroa INN "Vinca" koje je juce (21.
januara 2004.) podeljeno na konferenciji za stampu,
2. Obavestenje o stupanju u prvu fazu GENERALNOG STRAJKA.

Od kolega iz "Vince":

"Evo i jedne sale koja kruzi Institutom, a ciji zacetak se nalazi u
istinitom dogadjaju sa konferencije za stampu Ministarstva za nauku,
koja je odrzana u ponedeljak (19. januar 2004.) Novinar je upitao
ministra Domazeta i v.d. direktora Instituta prof. dr Petrovica: "Molim
Vas recite mi sta je to bekerel?" Oni su se zbunili, zgledali i
Petrovic je poceo da muca..."mi koristimo neke druge jedinice..."

Zamislite fizicara koji je redovni profesor na Univerzitetu (Novi
Sad), koji se usudio da prihvati duznost v.d. direktora u nuklearnom
institutu, a da ne zna sta je bekerel, jedan od osnovnih pojmova u
radioaktivnosti !!!

Posle toga je u Vinci "prosetala" sledeca ssala. Kao, u oblasti
radioaktivnosti sada su uvedene nove jedinice:
1 PU (Prinudni upravnik) i 1 DO (Domazet). Jedan PU (prinudni upravnik)
je jedinica za raspad naucnog instituta.

Ako se raspadnu 3 instituta, tada je 3 PU, u slucaju da se raspadne
1000, onda je to 1 DO (jedan Domazet!). Znaci: 1000 PU = 1 DO."

I – zahtev

SVI ZAPOSLENI U INSTITUTU ZA NUKLEARNE NAUKE "VINCˇA" stupili su u
jednocˇasovni SˇTRAJK U P O Z O R E Nj A u dane 19., 20., 21. JANUARA
2004. god. (ponedeljak-sreda) sa pocˇetkom u 12,30 cˇasova, na platou
ispred sale i u sali amfiteatra RM, u laboratoriji 170, kao i na svojim
radnim mestima u svim organizacionim delovima.
Ovaj strajk upozorenja je organizovan i najavljen u skladu sa odredbama
Zakona o radu, Zakona o strajku, Opsteg i Posebnog kolektivnog ugovora.
SˇTRAJKACˇKI ZAHTEVI su sledec´i:
Ponisˇtenje svih odluka Upravnog odbora Instituta "Vincˇa" od 16. jula
2003.g. i 5. januara 2004.g. i smena svih cˇlanova Upravnog odbora i
nezakonito postavljenog v.d. direktora Dragoslava Petrovic´a.
Prihvatanje predloga Naucˇnog vec´a za imenovanje novog v.d. direktora
instituta "Vincˇa" i novih cˇlanova Upravnog odbora sa pocˇetkom
njihovog mandata od 22.01.2004godine.
Ukidanje v.d. stanja u Institutu "VINCˇA" koje traje vec´ godinama i
HITNO raspisivanje konkursa za izbor generalnog direktora u skladu sa
vazˇec´im opsˇtim aktima Instituta "Vincˇa" pre 16. jula 2003.g.
Preispitivanje dokumentacije o poslovanju Instituta i MNTRS-a od strane
nadlezˇnih drzˇavnih organa za period u poslednjih 10 godina.
Zahtev za regulisanje pitanja vlasnisˇtva zaposlenih iz Instituta i
drzˇave, ili nekih trec´ih subjekata nad objekatima, opremom i tapijama
nad zemljisˇtem unutar Instituta "VINCˇA" od strane za to nadlezˇnih
institucija.
U slucˇaju da sadasˇnji cˇlanovi Upravnog odbora i v.d. direktora
Instituta ODMAH ne podnesu sami neopozive ostavke ili ne budu ODMAH
smenjeni od nadlezˇnih drzˇavnih institucija, u skladu sa zakonom
pokrenuc´e se GENERALNI SˇTRAJK, od CˇETVRTKA 22. januara 2004. godine
sa svim dozvoljenim vidovima pritisaka, blokada, obavesˇtavanja domac´e
i strane javnosti i iskazivanje neposlusˇnosti rukovodstvu Instituta i
zvanicˇnicima Ministarstva za nauku, tehnologiju i razvoj Republike
Srbije.

II – nezakoniti postupci
Odluke o transformaciji se donose mimo Zakona o naucˇnoistrazˇivacˇke
delatnosti i osnivackog akta.
Sazivanje sednica Upravnog odbora u nesaglasnosti sa Statutom i
Poslovnikom o radu Upravnog odbora
Donosˇenje odluka UO Instituta bez misˇljenja Naucˇnog vec´a o onim
pitanjima gde je to po Statutu i zakonu obavezno, statusnim,
programskim i kadrovskim pitanjima.
Neposˇtovanje predloga i upozorenja Naucˇnog vec´a o zakonitosti rada
UO. Naucˇno vec´e po Statutu ima neke funkcije Nadzornog organa.
Iznudjivanje odluka UO putem pretnji i ucena.

Javno obrac´anje cˇlanovima Vlade RS

Posˇtovana gospodo
Zahtevi Sˇtrajkac´kog odbora su upuc´eni sadasˇnjoj i buduc´oj Vladi.
Ovim dopisom dobili ste nasˇe argumente za obustavu pokusˇaja
nezakonite transformacije Instituta "Vincˇa", koje c´ete nadamo se
prihvatiti. Smatramo da smo kao odgovorni ljudi upozorili sve
relevantne cˇinioce na nezakonitost ovih pokusˇaja i nasˇu spremnost da
u tome istrajemo.

III – Demanti netacˇnosti u izjavama resornog Ministra
(Prilog Naucˇnog vec´a)

Ministar: U "Vincˇi" ima 400 istrazˇivacˇa i svega 0.25 radova po
istrazˇivacˇu u 2002godini. Naucˇnoistrazˇivacˇki rezultati Instituta
su ne samo daleko ispod svetskih standarda, po kvantitetu i kvalitetu,
vec´ i ispod rezultata drugih, slicˇnih institucija u Srbiji.
Demanti: U "Vincˇi" ima 180 istrazˇivacˇa obaveznih da publikuju radove
- 0.6 radova po istrazˇivacˇu za 2002 godinu, prvu godinu projektnog
perioda. Od 6 projekata u Srbiji do sada prihvac´enih za finansiranje
od strane Evropske unije u okviru 6. Okvirnog Programa (FP6) u narednom
3-godisˇnjem periodu, CˇETIRI su iz Instituta "Vincˇa"
Ministar: U "Vincˇi" ima 146 doktora nauka, a u Naucˇnom vec´u svega
41, sˇto znacˇi da je nelegitimno.
Demanti: U "Vincˇi" ima 117 stvarno prisutnih doktora nauka sa
naucˇnim zvanjem, a u Naucˇnom vec´u 77, sˇto znacˇi da je legitimno.
Preostalih 40 izjasnili su se da ne zˇele da budu cˇlanovi Vec´a ili im
po Poslovniku Vec´a posle 3 neopravdana izostanka mandat prestaje u
naredna 3 meseca. U sastavu Vec´a nalaze se 32 rukovodioca projekta (od
40) i 12 direktora laboratorija (od 18).
Ministar: Podrsˇku Elaboratu dala je vec´ina Laboratorija i vec´inski
Sindikat u Institutu.
Demanti: Sindikat demantovao u medijima da je ikad raspravljao o
elaboratu, a kamoli davao podrsku. Nijedna laboratorija do sada nije
podrzˇala elaborat, osim mozˇda saradnika na akceleratorskoj
instalaciji.
Ministar: Naucˇno vec´e je protiv transformacije Instituta i reformi u
nauci.
Demanti: Naucˇno vec´e se zalazˇe za zakonitu reorganizaciju i istinske
reforme u nauci Srbije (ne samo u Institu "Vincˇa"). Takve reforme
zahtevaju vreme, strucˇnost i Strategiju razvoja republike Srbije i
Zakon o naucˇnoistrazivacˇkoj delatnosti kada budu usvojeni u Narodnoj
skupsˇtini.
Ministar: O naucˇnom programu Instituta, o njegovoj organizaciji i
nacˇinu rada treba da svoje misˇljenje da i naucˇna javnost Srbije, kao
i oni koji finansiraju njegov rad. U tom smislu c´e se o radu i
transformaciji Instituta izjasniti i Vlada Srbije(!).
Demanti: Naucˇno vec´e upravo insistira na javnosti, niko osim nekoliko
cˇlanova UO nije video elaborat, a Vlada Srbije ne predstavlja naucˇnu
javnost.
Ministar: Predlozˇen koncept je rezultat struke, a ne politike.
Transformacija je bila u pripremi visˇe od godinu dana i ona nije
iznena?enje ni za koga u Institutu, ni «praznicˇno» ni
«postpraznicˇno». Ministarstvo poziva politicˇke stranke da se uzdrzˇe
od politizacije tranformacije Instituta i da ne nasedaju pokusˇajima
pojedinih svojih cˇlanova ili simpatizera u Institutu da svoje licˇne
interese sakriju iza nekakvih politicˇkih, «strucˇnih» i stranacˇkih.
DEMANTI: Iza elaborata ne stoji nijedno strucˇno telo niti od njegove
strane ovlasˇc´eni pojedinci. TAJNI ELABORAT nepoznatog autora je zato
usvojen na TAJNOJ SEDNICI UO. U Institutu ne postoje partijski aktivi,
osim pojedinaca koji su 90'-ih bili vrlo aktivni u institutskim
aktivima vladajuc´ih partija, a sada zdusˇno rade na rasturanju
Instituta. Naprotiv, Naucˇno vec´e mada vec´inom nestranacˇko, sa
ponosom isticˇe da su u njemu zastupljeni cˇlanovi svih parlamentarnih
stranaka, ali da je strucˇnost, odgovornost i posˇtovanje zakonitosti
ono sˇto ih opredeljuje u iznetim stavovima i odlukama.
Ministar: Nacionalni akceleratorski centar treba da omoguc´i, pored
naucˇnih istrazˇivanja i domac´u proizvodnju radioizotopa za
zdravstvene centre u Srbiji.
DEMANTI: Jedinstven stav po ovom pitanju moze da bude samo taj da se na
pocˇetku svakog projekta prihvataju obec´anja, a posle duzˇeg
vremenskog perioda (15 godina) samo REZULTATI. To vazˇi i za MNTR (3
godine).
Ministar: U Institut drzˇava ulazˇe puno sredstava i ima pravo da od
njega i puno trazˇi i ocˇekuje.
DEMANTI: Drzˇava u Institut po istrazˇivacˇu ne ulazˇe nisˇta visˇe od
onoga sˇto ulazˇe u druge institucije. Polovinu svojih prihoda Institut
ostvaruje van projekata MNTR i tome doprinose skoro sve laboratorije u
Institutu osim akceleratorske instalacije. Mozˇe se samo zamisliti
kakav bi haos nastao deljenjem svake laboratorije u dva pravna lica.
Ministar: U vidu akontacije, Institutu je vec´ uplac´eno oko 60 miliona
dinara za nabavku opreme za novu Laboratoriju za nanotehnologije
DEMANTI: Oprema nije rezultat predloga Naucˇnog vec´a, niti je za
nanotehnologiju, niti se iko u Srbiji bavi takvom naukom.
Ministar: Odvajanje fundamentalnih i primenjnih i razvojnih
istrazˇivanja, i saglasno tome formiranje posebnih instituta za ove
vrste istrazˇivanja je poznata praksa u svetu.
DEMANTI: Netacˇno. Trend je upravo suprotan, primer je finansiranje
evropskih projekata, gde Institut basˇ zbog svog postojec´eg koncepta
ima komparativnu prednost.
Ministar: Transformacija smeta pojedinim nabe?enim naucˇnim velicˇinama
kojima ne odgovara prac´enje kvaliteta i produktivnosti naucˇnika u
skladu sa svetskim kriterijumima, i koji bi najradije da budu potpuno
zatvoreni na uvid javnosti..
DEMANTI: Netacˇno. Tih nekoliko je skoro celo Naucˇno vec´e i bar
polovina onih u Institutu, koji to nisu a imaju pravo. Na web sajtu
Instituta mozˇe se pogledati spisak svih istrazˇivacˇa u Institutu sa
detaljnim biografijama i bibliografijama. Ne znamo za slican primer,
ali bi bilo korisno da nasˇ primer slede i druge institucije.
Ministar: Zˇelimo da stavimo tacˇku na samoupravljanje u Institutu...
DEMANTI: Ovde se ne radi o samoupravljanju vec´ o posˇtovanju
elementarnih prava i obaveza naucˇnih radnika i ostalih zaposlenih u
Institutu. Upravo Sindikat pruzˇa podrsˇku Naucˇnom vec´u, za
strucˇnost i zakonitost u radu.
Ministar: Institut "Vincˇa", prema planu reorganizacije, umesto na
postojec´u 21 organizacionu jedinicu bio bi podeljen u cˇetiri celine
DEMANTI: Prema nezakonito pravljenom i prihvac´enom elaboratu, Institut
bi bio podeljen u najmanje 7 pravnih lica. Institut sada posluje kao
jedno pravno lice sa jednim zˇiro racˇunom.

PRVU FAZU [TRAJKA - GENERALNOG [TRAJKA
po~ev od 22. janura 2004.g., na radnim mestima zaposlenih u svim
organizacionim delovima, kao i u posebno zakazanim terminimana na
platou ispred sale i u sali amfiteatra RM, u laboratoriji 170.

Prva faza GENERALNOG [TRAJKA obuhvata: neizvr{avanje odluka i naredbi
koje donosi Upravni odbor instituta i ~lanovi Direktorijuma instituta
do njihovog razre{enja sa funkcija, po{tovanje racionalnih odluka
rukovodilaca projekata, direktora laboratorija i centara koje nisu
bazirane na odlukama UO i Direktorijuma od 16. jula 2003.g. i 5.
januara 2004.g., izvr{avanje ostalih ugovorenih obaveza iz minimuma
procesa rada.
SˇTRAJKACˇKI ZAHTEVI:
Prihvatanje predloga Naucˇnog vec´a instituta za imenovanje novog v.d.
direktora instituta "Vincˇa" i novih cˇlanova Upravnog odbora sa
pocˇetkom njihovog mandata od 18. januara 2004.g.
Ponisˇtenje svih odluka Upravnog odbora Instituta "Vincˇa" od 16. jula
2003.g. i 5. januara 2004.g. i smena svih cˇlanova Upravnog odbora i
nezakonito postavljenog v.d. direktora Petrovic´ Dragoslava.
Momentalno ukidanje v.d. stanja u institutu "VINCˇA" koje traje 4
godine (mandat poslednjeg v.d. direktora prestaje 18. januara 2003.g.)
i HITNO raspisivanje konkursa za izbor generalnog direktora u skladu sa
vazˇec´im opsˇtim aktima instituta "Vincˇa" pre 16. jula 2003.g..
Preispitivanje dokumentacije o poslovanju instituta i MNTRS-a od strane
nadlezˇnih drzˇavnih organa (privredne policije, finansijske policije)
za period u poslednjih 10 godina.
Zahtev za regulisanje pitanja vlasnisˇtva zaposlenih iz Instituta i
drzˇave, ili nekih trec´ih subjekata nad objekatima, opremom i tapijama
nad zemljisˇtem unutar instituta "VINCˇA" od strane za to nadlezˇnih
institucija (sudskih institucija).

'Prepad' za vreme praznika

Bez poziva za tajni sastanak

Naucno vece Instituta "Vinca" obavestava strucnu i siru javnost o
protivzakonitom rasparcavanju Instituta i protiv volje Naucnog veca i
ogromne vecine istrazivaca i saradnika Instituta, od strane prof. dr
Dragana Domazeta, ministra za nauku, tehnologiju i razvoj Republike
Srbije u ostavci i predsednika Upravnog odbora Instituta prof. dr
Dragana Vucovica.

Upravni odbor je na sednici od 16.jula 2003.godine, pod vodjstvom prof.
dr Vucevica i pod nevidjenim pritiskom, pretnjama i ucenama ministra
Domazeta na samoj sednici, doneo protivpravnu odluku o postavljenju
prof. dr Dragoslava Petrovica za vrsioca duznosti direktora Instituta,
kome je stavljeno u zadatak da sprovede takodje nezakonitu odluku o
transformaciji Instituta "Vinca", odnosno ucini pripreme za
rasparcavanje Instituta na vise pravnih lica. Sve odluke su donete bez
konsultacija (koje su obavezne po Statutu Instituta) sa Naucnim vecem
Instituta koje je najvazniji strucni organ i po mnogim odredbama
Statuta i Nadzorni organ Instituta.

Naucno vece je vec sutradan na svojoj vanrednoj sednici donelo stav da
ne prihvata nezakonito postavljenog v.d. direktora Instituta; da se bez
donosenja Strategije razvoja i Zakona o naucnoistrazivackoj delatnosti,
kao i bez misljenja Naucnog veca, ne moze sprovoditi proces donosenja
bilo kakvih akata u smislu transformacije, menjanja pravnog statusa,
delatnosti, vlasnickih odnosa i organizacije u celini; da se uputi
otvoreno pismo Vladi Republike Srbije, premijeru Zivkovicu licno, kojim
se Vlada obavestava o nezakonitim postupcima ministra i Upravnog
odbora, i da se u slucaju ne dobijanja zastite pokrenu drugi pravni
mehanizmi; da se uputi apel nasim istaknutim naucnicima u zemlji i
inostranstvu za spas Instituta (tekst peticije je podrzao 141
potpisnik).

Kako nije dobijen odgovor od Vlade Republike Srbije, Naucno vece je u
skladu sa svojim odlukama sa sednica od 24.jula 2003, 29.septembra
2003, i 09.decembra 2003.godine, ucinilo sledece korake: pokrenulo je
sudski spor za zastitu zakonitosti u vezi sa odlukama UO od 16.jula
2003.godine, podneskom tuzbe od 14.oktobra 2003.godine V opstinskom
sudu u Beogradu prosledilo zahtev Glavnom republickom inspektoru rada
dana 19.decembra 2003.godine za privremena resenja o obustavljanju
istih nezakonitih odluka i podnelo krivicnu prijavu dana 25.decembra
2003.godine protiv ministra Domazeta zbog zloupotrebe sluzbenog
polozaja i preinacavanja i iznudjivanja odluka UO Instituta putem
pretnji i ucena.

Naucno vece je takodje shodno istim odlukama prosledilo UO,
Ministarstvu i Vladi Republike Srbije punovazni predlog za novog v.d.
direktora Instituta, zahtev za hitnim raspisivanjem konkursa za
direktora Instituta i predlog za nove clanove UO iz redova Instituta,
koji ce zameniti one clanove koji su u medjuvremenu podneli ostavke ili
su opozvani od strane Naucnog veca po zakonskoj proceduri.

Umesto odgovora, ministar Domazet je 31.decembra 2003.godine, vrseci
pritisak na clanove UO, a u saradnji sa nezakonito postavljenim v.d.
direktora i njegovim pomocnikom, izdejstvovao da se neradni dani 1. i
2. januara produze do 12. januara 2004.godine i istovremeno da se po
hitnom postupku zakaze tajni sastanak (dva sastanka - u 12,00 h i u
13,00 h) Upravnog odbora Instituta u Ministarstvu za nauku i uz
prisustvo ministra Domazeta i njegovih pomocnika za 5.januar
2004.godine sa dnevnim redom i materijalom za sednicu koja treba da
dovede do daljih nezakonitih i konacnih odluka u pravcu prestanka rada
Instituta u sadasnjem obliku. Pri tome predsednik UO nije uputio poziv
za sednicu predsedniku Naucnog veca i predstavnicima pravne sluzbe
Instituta, na sta je obavezan po Opstem aktu i Poslovniku o radu UO.

Ovim putem ujedno pozivamo strucnu i najsiru javnost da nam pomognu u
borbi protiv nezakonitih odluka koje se zele sprovesti od strane
ministra za nauku u ostavci. Odluke donete na taj nacin mogu biti
dalekosezne po svojim negativnim posledicama, kako za Institut za
nuklearne nauke "Vinca" kao prepoznatljivo ime nase nauke, tako i za
nauku u Srbiji u celini.

Oni koji krse zakon, umesto da ga po svojoj duznosti ztite, ne mogu
imati pravo da odlucuju o tako vaznim pitanjima nase buducnosti,
zakljucuje dr Dragan Alavantic, naucni savetnik i Predsednik Naucnog
veca Instituta "Vinca".

"Prepad" u vreme praznika

Mi, dole potpisani clanovi UO u ostavci, izjavljujemo da necemo
ucestvovati u radu ove sednice, jer ne zelimo da snosimo ni moralnu ni
krivicnu odgovornost zbog donosenja protivzakonitih odluka, koje su u
sustini neakademski nacin obracuna sa naucnim radnicima Instituta, vec
dugo vremena izlozenim nemastini i raznim teskocama u radu.
Ministarstvo za nauku, tehnologiju i razvoj na celu sa dr Draganom
Domazetom, umesto da sa naucnim radnicima i njihovim predstavnicima u
Naucnom vecu Instituta DOGOVORNO radi na reorganizaciji, koja bi
unapredila naucni rad, odlucilo se za politiku pritisaka, pretnji i
konfrontacija, u cilju rasparcavanja Instituta.

MNTR je imalo dovoljno vremena da koriguje svoju protivzakonitu i
antistatutarnu odluku iz jula meseca 2003.godine, kojom je uvedena
prinudna uprava nad Institutom, i da politiku iznude i pretnji zameni
akademskim dogovaranjem sa kompetentnim naucnim radnicima i Naucnim
vecem Instituta, a u skladu sa osnivackim aktom Instituta, vazecim
Zakonom o naucnom radu i Statutom. Umesto toga dolazi ovaj ponovni,
krajnje neetican i nasilnicki gest i nacin sazivanja sednice UO od
strane ministra Vlade u ostavci. Gospodin Domazet je "prepadom" u vreme
praznika i odmora odlucio da svoj neslavni mandat zavrsi onako kako je
sve vreme i trajao - bez uvazavanja misljenja najkompetentnijih naucnih
radnika Instituta Vinca. Ministru Domazetu mora biti poznato da je
osnivac Instituta Vinca Narodna Skupstina Republike Srbije i da odluke
koje je on namerio da sprovede nisu u skladu sa Zakonom, pa ce u
slucaju nasilnog donosenja morati biti ponistene, makar pred
Medjunarodnim sudom.

Ponavljamo da mi u donosenju ovakve odluke necemo ucestvovati i o tome
cemo obavestiti nasu i medjunarodnu naucnu javnost. Sa ovom izjavom
saglasan je i legalno izabrani predsednik Naucnog veca Instituta Vinca,
koje je obrazovano u skladu sa vazecim Statutom Instituta, dr Dragan
Alavantic.

Izjavu su potpisali dr Zlatko Rakocevic, dr Borislav Grubor, dr Tatjana
Maksin i dr Slobodan Vukovic.

REGISTRY EXTENDS COMMUNICATION RESTRICTIONS ON DETAINEES
FROM THE TRIBUNAL’S DETENTION UNIT

On 8 January 2004, the Deputy Registrar of the Tribunal,
David Tolbert, issued two further Decisions concerning the
communication privileges of Vojislav Seselj and Slobodan Milosevic.
The Decisions were served on both Accused on 9 January 2004.

On 11 December 2003, the Deputy Registrar of the Tribunal
issued two Decisions concerning the rights of detainees in
the Tribunal’s Detention Unit to use communications privileges for the
purpose of political campaigning in the media (Please see
Press Release 810e). Both Decisions are due to expire on 10
January 2004.

Vojislav Seselj case

On 25 December 2003, Vojislav Seselj "flagrantly violated
the Decision" of 11 December 2003 which resulted in a
subsequent Decision from the Registrar, Hans Holthuis, on 29 December
2003 which prohibited "all communication via telephone between
the accused and any person(s) except his legal counsel (if
applicable) and diplomatic or consular representatives".
This decision is also due to expire on 10 January 2004.

In issuing today’s Decision, the Deputy Registrar considered
particularly that Vojislav Seselj had previously violated
the 11 December Decision which resulted in the 29 December 2003
Decision.

The Deputy Registrar decided, pursuant to Rules 60 and 63 of
the Rules of Detention, for a period of 30 days from 10
January 2004 to:

"Prohibit, unless otherwise authorised by the Commanding
Officer of the Detention Unit, all communication via
telephone and visits between the Accused with person(s) except for his
legal counsel (if applicable) and diplomatic or consular
representatives".

Slobodan Milosevic case

With regard to Slobodan Milosevic, the Deputy Registrar
considered, among other things, that "post-elections
associated activities will likely see the political party and the
supporters of the Accused seeking his further involvement in
post-elections political activities associated with the 28
December 2003 Serbian parliamentary elections" and "that
widespread media attention and coverage of the fact that
[the] Accused is facilitating, with ease, either an ongoing
Serbian parliamentary elections campaign or post-elections
political activities, each undermines the Tribunal’s mandate
to assist in the restoration and maintenance of peace in the
former Yugoslavia".

The Deputy Registrar decided, pursuant to Rules 60 and 63 of
the Rules of Detention, to extend the 11 December 2003
Decision for Slobodan Milosevic for a period of 30 days from 10
January 2004.

MILOSEVIC "TRIAL" SYNOPSIS - JANUARY 13, 2004: B-92 REPORTER TESTIFIES
AGAINST MILOSEVIC

After a nearly month long break the so-called "trial" of Slobodan
Milosevic again resumed on Tuesday. With only 16 hearing days remaining
to present their case the prosecution called a former journalist of
the Belgrade radio station B-92 to testify.

Nenad Zafirovic worked for Radio B-92 covering the Bosnian and
Croatian wars. Mr. Zafirovic is a member of the Democratic Party (DS)
of the slain former Serbian prime minister, Zoran Djindjic.

According to Mr. Zafirovic, the atrocities committed in Bosnia and
Croatia were mainly committed by locals against other locals.
President Milosevic pointed out that the phenomenon Zafirovic was
describing is known as a civil war.

Even though Mr. Zafirovic was a 92-bis witness, it took the
prosecutor, Mr. Groome, the better part of an hour to examine him, and
even after the examination in chief there were still inaccuracies in
his witness statement that had to be corrected.

In Mr. Zafirovic's witness statement it said that Slobodan Milosevic,
Biljana Plavsic, and Radovan Karadzic had entered into a conspiracy to
provoke fighting in Bijeljina. According to Mr. Zafirovic this must
have been some sort of a mistranslation, because it simply wasn't
true. That is certainly one amazing mistranslation, and it highlights
the reason why testimony should never be admitted under Rule 89(F).

The fact of the matter is that you simply can not trust the prosecutor
to write an accurate witness statement on behalf of the witness. All
of the evidence should be given live by the witness in the presence of
the accused. Evidence should not be given in the prosecutor's office
for them to manipulate as they please for the purpose of their case.

Mr. Zafirovic did his best to be a good witness for the prosecution.
He said that he saw Gen. Mladic and Mr. Krajisnik in Belgrade in the
area of Milosevic's office. Of course he didn't know what they were
doing there.

There was another time when he says he was in Radovan Karadzic's
office when Milosevic called, of course he was asked to leave, and so
he didn't know what the purpose of the call was.

Mr. Zafirovic claimed that President Milosevic was the man "in charge
of the Bosnian Serb delegation" at the Geneva talks. Of course his
claim wasn't based on any facts. He told Mr. Tapuskovic that all
decisions ultimately had to be made by the Bosnian Serbs themselves,
and that Karadzic was officially the one in charge. Zafirovic said
that he didn't know whether Milosevic could issue orders or make
decisions on behalf of the delegation or not. On the basis of what
then is he testifying? Apparently, as is typical of so many
prosecution witnesses, he's testifying on the basis of nothing.

In response to questions from President Milosevic, Mr. Zafirovic
confirmed that Milosevic only attended the meetings in Geneva at the
requests of Lord Owen, Mr. Vance, and Mr. Stoltenberg. President
Milosevic did not impose himself on those meetings. He was asked to
attend by the representatives of the international community so that
he could help to find a way to stop the war.

Even though Mr. Zafirovic didn't actually witness anything. He did
manage to directly contradict the testimony of Sead Omeragic.
Apparently Mr. Omeragic was lying when he claimed that Radio Bijeljina
had blocked the transmission of Fikret Abdic's speech. Because
according to Mr. Zafirovic that speech was broadcast, and the aim of
the speech was to calm down the population.

Some interesting information also came out about the infamous Ljubisa
Savic "Mauzer." Apparently, Mauzer was a member of the Democratic
Party. In fact he was even the president of the Democratic Party in
Republika Srpska.

The prosecution is fond of saying that Mauzer was "Milosevic's man."
In reality, Mauzer was opposed to Milosevic. Mauzer told the Belgrade
newspaper Vreme that when he was finished in Bosnia he would cross the
Drina and "take care of the communists."

At one point Mr. Groome asked Mr. Zafirovic if he was free to report
honestly and objectively about the events he observed in Bosnia and
Croatia. Mr. Zafirovic said that he was free to file honest and
objective reports and broadcast them in the media. At one point he
even broadcast reports calling Milosevic a liar with respect to the
war in Bosnia. It is worth noting here that if Slobodan Milosevic was
a real dictator that Mr. Zafirovic wouldn't have lived to see the next
day. Fortunately for Mr. Zafirovic Serbia had a free press and
Slobodan Milosevic was not a dictator.

Mr. Zafirovic trod over some old ground in his testimony. He had a tape
recording of President Milosevic's second speech to the Republika
Srpska assembly in Pale when Milosevic was trying to convince them to
accept the Vance-Owen plan. We have already seen this speech before,
President Milosevic gave this speech in response to objections to the
plan that had been raised by some of the deputies in the assembly.
Here is the text of the speech:

[START SPEECH]

I will try very briefly, but with the highest possible degree of
responsibility to say a few words. But before doing that, I wish to
convey to you my impressions. You spoke openly and from the heart. Most
of what you said related to the cruelties and injustices of war. In
the Serbian people, throughout their history, unfortunately there is
too -- there are too many truthful testimonies of the horrors of war.
However, all that we heard today regarding the testimony and the
horrors of war, all of this can be formed into one single argument and
a single statement and message, that the war should cease as soon as
possible, that the war should cease immediately.
However, let me go back to the question we are addressing today. The
question is not how much horrors -- how many horrors there were in
this war. This people has felt this on their own shoulders throughout
their history. The question today is whether we should consolidate what
has been achieved and through a peaceful process, under conditions of
security, achieve what remains to be done, what we call "outstanding
matters." There were many outstanding issues, but the plan envisaged
that those problems be addressed in negotiations.
So whether we should seek to address what we call 'outstanding
problems' through negotiation or should we destroy what has been
achieved at the expense of enormous sacrifice. That is the real issue
that this Assembly should decide. So the question, when talking about
the plan, is not whether we are departing from our goals. Of course
not.
The question is whether that plan represents the path towards the
ultimate goal. The plan is not the final fulfillment of the justified
demands of the Serbian people, but it certainly represents the path
towards the ultimate goal. But now we must make much more effort
through our wisdom and less bloodshed. I think that should be an
advantage, not a disadvantage. And this Assembly must have the courage
and self-confidence under these circumstances on the basis of the
plan, which must -- which is a sufficient basis to achieve our goal,
rather than committing a tragic error which will cruelly cut across or
put an obstacle on the way to success.
Will the Assembly opt for a reasonable or an unreasonable path? I
think no one needs to persuade this Assembly about. I think peace is
the reasonable, the sensible way. On the contrary, if the slogan is
spread about that the Serbs don't want peace, that could only justify
crimes against the Serbs, and this is something you should bear in
mind. When the road towards peace is being opened, you must explain to
the people that they -- why should they sacrifice their lives in even
crueler ways up to now? You cannot explain the reasons to the Serbian
people in Bosnia or in Serbia.
And let me say finally, one must sacrifice everything for the people
except the people. You cannot sacrifice the people. You do not have
the right to do that as an Assembly or as anyone else.

Mr. Zafirovic's point in playing the tape of the above speech was that
Milosevic used the word "we." Milosevic speaks in the first person
plural. The normal person would think that Milosevic uses the term "we"
because he is speaking to other Serbs that he is together in the
assembly hall with. "We" in the assembly hall, and "we" as Serbs. It
is very simple, because peace is in the interest of all Serbs,
President Milosevic used the term "we."

Rather than seeing what is obvious to anybody who reads the speech,
Mr. Zafirovic saw a conspiracy. Zafirovic said that Milosevic used the
word "we" because he was directly involved in the war together with the
Bosnian Serbs.

Only at the Hague "Tribunal" could a speech calling for the ending of
a war, and the adoption of a peace plan be used as "evidence" that the
man who gave it is a war criminal.

After Mr. Zafirovic concluded his testimony, which amounted to
basically nothing, Mr. Nice brought up some administrative matters.

Mr. Nice has found his much sought after constitutional expert. He
found a German citizen who is working in Croatia to testify as an
"expert" about matters pertaining to the Constitution of Yugoslavia,
i.e., the legality of the succession of Bosnia, Croatia, and Slovenia,
the constitutionality of the changes to Kosovo's status in the late
80s, etc...

It is worth noting that these matters have already been dealt with by
the Constitutional Court of Yugoslavia. The successions were illegal,
and the changes to Kosovo's status were in line with the Serbian and
Yugoslav constitutions. These are matters that the real courts have
already decided. It isn't for some German testifying in a phony
"court" to second guess the decisions made by the legitimate legal
authorities in Yugoslavia.

Mr. Nice is also trying to exploit the fact that he is running out of
time to present his case, by trying to get the "judges" to impose
strict time limits on President Milosevic's cross-examinations. Mr.
Nice wants to call a maximum number of witnesses in a short amount of
time, while simultaneously trying to limit the time available for
cross-examination.

Maybe if Mr. Nice hadn't been already presenting his case for two
years one could understand his claims that he doesn't have enough time,
and maybe if Mr. Nice hadn't wasted so much time with witnesses like
Mr. Zafirovic he would have time now for the "important witnesses"
that he says he still has to call.

After Mr. Nice finished the "tribunal" took a recess and upon
completion of the recess immediately went into closed session to hear
"testimony" from a secret witness.

There is no hearing on Wednesday, but the "tribunal" will sit an extra
day on Friday to make up for the missed day.

June 15, 2004 – Ante Markovic made his return to The Hague “Tribunal”
today. He "excelled" as a witness for the prosecution. You could have
asked him what the cause of global warming was, and he would have told
you that it was Slobodan Milosevic’s fault.

The war in Slovenia was discussed at great length. Slobodan Milosevic
produced stenographic notes taken from Federal Executive Council
sessions, SFRY Presidency sessions, and Ante Markovic’s personal
calendar. From these documents it emerged that Ante Markovic himself
made the decision to engage the JNA in Slovenia.

Under the constitution of the SFRY, the JNA was under the command of
the federal presidency, but Ante Markovic violated the constitution
and ordered the JNA to take action in Slovenia.

Ante Markovic tried to say that Slobodan Milosevic is the one who
ordered the JNA to “invade” Slovenia, while at the same time claiming
that Milosevic was trying to kick Slovenia out of Yugoslavia.

Apparently Mr. Markovic thinks it is perfectly logical for Milosevic
to use the JNA to keep Slovenia in Yugoslavia by force, while he is at
the same time trying to get Slovenia to leave Yugoslavia. Which is it
Mr. Markovic does he want to force them to stay, or does he want them
to leave?

From the documents it emerges that even Kucan, accuses the Federal
Executive Council (i.e. Markovic) for the war in Slovenia. Of course it
is Kucan himself who is most responsible. 44 JNA soldiers lost their
lives and 184 were wounded when Slovenia attacked the JNA. Slovenia
did not keep its promise to the EC not to take unilateral actions, and
it ignored the ruling of the Constitutional Court of Yugoslavia which
struck down their succession as being illegal.

After accusing Milosevic of “invading” Slovenia with the JNA, Markovic
changed his story. He began to claim that it was some sort of big
mystery who could have issued these orders, and then he said that the
JNA didn't have orders at all that it decided all on its own what it
would do.

Of course it can be expected that Markovic would change his story,
because he was lying. Bora Jovic, who was at the time a member of the
Federal Presidency, has already testified that it was Markovic who
illegally issued orders to the JNA.

Slobodan Milosevic’s position in all of this business regarding
Slovenia was essentially neutral. He opposed their succession on the
grounds that it was illegal, but he was also against deploying the JNA
to force Slovenia to stay in Yugoslavia. Of course it’s just his
opinion, since contrary to Markovic’s stories he had no command over
the JNA.

In addition to explaining how Markovic violated the constitution and
issued orders to the JNA illegally, Jovic explained how Markovic
introduced a program whereby the Yugoslav dinar was convertible at a
ratio of 7 dinars for 1 deutschemark. Jovic explained that on the basis
of Markovic’s program citizens went out and converted their savings
into deutschemarks.

What happened according to Jovic was that Markovic raided the foreign
exchange reserves of the SFRY, and the citizens who had converted
their money into deutschemarks were unable to get their money back out
of the banks, and had to be issued what amounted to IOU’s by the state.

Jovic explained that Markovic used the money from the SFRY’s foreign
exchange reserves to pay Croatia’s debt. Markovic’s so-called
“economic reforms” were a scam that increased the SFRY’s debt many fold.

Even though Markovic almost single handedly destroyed the economy of
the SFRY, and caused countless citizens to lose their life savings, he
had the nerve to accuse Milosevic of “stealing” state funds. Something
that Milosevic did not do, and was not in a position to do in the
first place, since it was Markovic and the Federal Government who
controlled the money.

Ante’s antics were rather amusing. He had a flare for being dramatic.
He spoke of the explosion at Tudjman’s Banski Dvori palace in Zagreb.
Of course evidence has come to light since then which indicates that
the explosions were rigged for the benefit of Tudjman’s own political
purposes. None the less, Markovic insisted that a MiG-29 aircraft
(that he didn’t see) had bombed him, and that Milosevic must have been
behind it. To be honest I’m a little bit surprised he didn’t claim
Milosevic was flying the plane.

Ante Markovic humiliated himself. This is a man who remained silent
for 12 years, and if he had been a smart man he would have continued
to remain silent, and maintained at least some measure of his dignity.

VRS OF FIRING SHELL AT MARKALE

FRIDAY, JANUARY 16, 2004 - The so-called "expert witness" Berko
Zecevic testified at the so-called "trial" of Slobodan Milosevic.

Mr. Zecevic was attached to the main staff of the ABiH. He was in
charge of the research and development of weaponry for the Muslim
forces. He also oversaw the production of weaponry for the Muslim
forces.

In spite of the fact that he has an obvious conflict of interest, Mr.
Zecevic wrote a report in which he concluded that the VRS fired the
shell that hit the Markale Market in Sarajevo on February 5, 1994.

In his so-called "expert report" he referred to Serbs in derogatory
terms calling them such names as "Chetniks" and "Aggressors."

Mr. Zecevic did not arrive at the Markale Market until after all of
the shell fragments had been removed, until after materials had been
dug out of the crater, and until after all of the debris had been
cleaned up.

It is worth noting that UN ballistics experts who arrived on the scene
immediately after the shell exploded have compiled two reports. One
report says that the Muslims fired the shell, and the other report says
that it can not be determined who fired the shell.

Apparently the UN's "tribunal" doesn't feel that the UN's reports are
good enough. So they went out and found an "expert" who was himself a
member of one of the warring factions, and who would naturally have an
interest in attributing this incident to the other side, which surprise
of all surprises is exactly what he did.

In spite of the fact that Mr. Zecevic's report was useless, because he
had no possibility of seeing the area of impact in its undisturbed
form, because he has a conflict of interest as a member of the ABiH,
and because he has exhibited racist tendencies towards Serbs through
the insulting names he called them in his report. In spite of all of
that the day wasn't a total waste of time.

Mr. Groome produced a number of documents during the examination in
chief which showed that the FRY was buying weapons and weapons
components from Republika Srpska in order to properly equip the VJ. Mr.
Zecevic even confirmed that the VJ needed to buy these weapons and
components from Republika Srpska, because no facilities in the FRY had
the ability to manufacture these things themselves.

This is quite the opposite of what has been presented by the
prosecution so far. So far the prosecution has tried to make it look
like everything came from the FRY to the Republika Srpska. But thanks
to these documents we see that many weapons were in fact going from
the Republika Srpska to the FRY.

The testimony of Ton Zwann is on the schedule for Monday, January
20th. All in all Berko Zecevic didn't prove useful for the prosecution.
Slobodan Milosevic has indicated that he will call competent experts
to testify so that the truth can be established about Markale once and
for all.

Kerbala, la Nassirya bulgara

Le reazioni in Bulgaria all’attentato nel quale hanno perso la vita
cinque soldati bulgari. Chiesta una commissione d’inchiesta
parlamentare anche se nessun partito in Parlamento si è pronunciato per
il ritiro delle truppe.

(16/01/2004) L’opinione pubblica bulgara è uscita scioccata
dall’attentato del 27 dicembre scorso al campo base “India” a Kerbala,
Iraq, nel quale sono morti cinque soldati bulgari ed altri ventisette
sono rimasti feriti. Mentre il governo rinnovava il proprio impegno a
rimanere con un proprio contingente in Iraq tra i gruppi della società
civile si sono alzate alcune voci contrarie alla permanenza, fatto
accaduto solo di rado prima dell’attentato. Altri hanno invece
criticato i sistemi di sicurezza della base “India” che non sono stati
in grado di garantire l’incolumità dei soldati bulgari. Intanto è
rientrata in fretta la polemica che ha coinvolto bulgari e polacchi.
Questi ultimi, in seguito all’attentato, erano stati accusati di aver
tradito il contingente bulgaro e di averlo messo alla mercé dei
terroristi in modo da non subire perdite tra i propri soldati. Notizie
poi ripetutamente smentite. Certo è che tutto quanto riguarda la
presenza bulgara in Iraq è finito sotto sordina. I giornalisti non
hanno potuto intervistare i militari feriti nell’attentato e ricoverati
presso l’Istituto Militare di salute di Sofia. “Ci hanno proibito di
parlare”, titola il quotidiano “Novinar” citando le parole di Radostin
Kirilov, tra i soldati feriti a Kerbala. Poche notizie anche in merito
alla difficoltà dell’esercito bulgaro nel reclutare volontari per
Kerbala.

Le critiche

Iliya Marinov, ex vice-Ministro della difesa e padre di Petko Marinov,
comandante del contingente bulgaro a Kerbala era stato il primo ad
ipotizzare un contatto tra il comando polacco, all’interno del quale
operano i bulgari, ed i leader sciiti locali. Oggetto dell’incontro un
allentamento dei controlli a loro carico, secondo Marinov, pagato a
caro prezzo dai soldati bulgari. “Chi ha tradito i nostri ragazzi a
Kerbala?”, si è chiesto il 2 gennaio scorso in un’intervista per “24
Chassa”. Sdegnate smentite sono arrivate subito da Varsavia e le
autorità bulgare hanno immediatamente porto le proprie scuse.
Stefan Dimitrov, generale in pensione ed ex consulente per la
Presidenza bulgara, ha invece chiesto venisse creata una commissione
parlamentare che compia una missione di indagine in Iraq. “Il comando
bulgaro in Iraq ha fatto valutazioni errate della situazione sul campo”
ha affermato Dimitrov “innanzitutto sbagliando nello scegliere la
collocare della base militare”. “I militari bulgari sono andati
incontro a molte delusioni” ha aggiunto “innanzitutto che la situazione
a sud di Baghdad fosse calma, che la guerra fosse terminata e che erano
impegnati in un’operazione di peacekeeping”. “In realtà si tratta di
una vera e propria operazione militare”. Ma contrari alla commissione
parlamentare sarebbero i due partiti di governo: il Movimento Nazionale
di Simeone II ed il Movimento per i Diritti e le Libertà, che
rappresenta la minoranza turca. Il Presidente bulgaro Paravanov, i
partiti d’opposizione ed molti rappresentanti della società civile si
sono dichiarati a favore della creazione di una commissione
d’inchiesta. “Non ritengo una commissione sia necessaria. La mia
convinzione è supportata anche dalla pratica adottata in Italia ed in
Turchia” ha affermato Stanimir Ilchev, capogruppo parlamentare del
Movimento Nazionale Simeone II. Unica voce in parte dissenziente
all’interno della maggioranza quella di Borislav Tsekov, vice di
Ilchev, secondo il quale una commissione sarebbe necessaria ma non per
indagare su Kerbala ma per fissare le linee guida per il futuro della
presenza bulgara in Iraq.
Intanto Boyan Saraev, sacerdote ortodosso e parente di una delle
vittime di Kerbala si è scagliato contro la permanenza in Iraq. Il suo
sfogo ha ottenuto molto spazio nei media bulgari. “Non abbiamo alcun
ruolo in un Paese distrutto e misero come l’Iraq, non possiamo
macchiarci degli stessi crimini dei quali si macchiano gli USA solo per
difendere i loro interessi economici” ha affermato a “24 Chassa”.
“Abbiamo abbandonato i nostri figli al sacrificio”, ha dichiarato
sempre Saraev alla televisione nazionale bulgara. Hristo Genchev,
architetto e rinomato analista politico ha affermato che a suo avviso
la Bulgaria dovrebbe salvare la sua gente ed abbandonare l’Iraq.

Ai limiti della rottura con la Polonia

“Scandalo con la Polonia su Kerbala”, ha titolato nei giorni scorsi il
quotidiano Monitor. “Parvanov chiama Kwasniewski sull’Iraq. I polacchi
negano un accordo con gli sceicchi sulle spalle dei bulgari”, riporta
24 Chassa. La stampa in Bulgaria ha riservato molto spazio alla
conversazione telefonica tra i Presidenti di Polonia e Bulgaria sulle
vicende irachene. Kwasniewski ha negato ogni accusa. Dal canto suo
Parvanov ha richiesto un maggior coordinamento tra i due contingenti.
“E’ assurdo e pericoloso muovere delle accuse ai polacchi
sull’attentato a Kerbala” ha affermato il vice Ministro della difesa
Ilko Dimitrov al quotidiano Dnevnik. Lo stesso Marinov, che per primo
aveva sollevato i dubbi sul comportamento del comando polacco ha poi in
parte ritrattato affermando che “non intendeva creare tensioni tra
Sofia e Varsavia”. Ad un giornalista polacco dell’agenzia di stampa PAP
ha poi ricordato che gli argomenti da lui sollevati erano stati tratti
da un articolo pubblicato sul quotidiano polacco Gazeta Wyborcza. Il
generale Nikola Kolev, a capo dell’esercito bulgaro, si è scusato con
Varsavia per le accuse di “tradimento” mosse la contingente polacco.

Di chi le responsabilità?

Secondo molti esperti militari bulgari ed ex membri dell’esercito a
Kerbala sarebbero stati compiuti molti errori per quanto riguarda la
messa in sicurezza della base. “I colpevoli per la morte dei cinque
militari bulgari sono a Sofia”, ha affermato Velizar Shalamanov, ex
vice Ministro della difesa. E nel settimanale “168 Chassa” si accusano
le forze armate bulgare di nascondere la verità e di non voler
riconoscere le responsabilità di chi si sarebbe dovuto occupare della
sicurezza. Il settimanale inoltre insiste sul fatto che le
responsabilità di quanto accaduto sono solo bulgare e non da attribuire
al comando generale polacco. Viene ricordato infatti che in un accordo
segreto firmato a Varsavia nel luglio del 2003 da rappresentanti di 24
Paesi, e tra questi il vice Ministro della difesa Ilko Dimitrov si
stabiliva che fosse diretta responsabilità delle autorità di ciascun
Paese e del proprio comando militare quanto avvenisse all’interno delle
proprie basi in Iraq.
“Possono i vertici dell’esercito essere denunciati?” si chiedono
invece i giornalisti del quotidiano “Troud” dopo che un procuratore
militare di alto livello aveva reso noto che le indagini sulla morte
dei 5 soldati bulgari erano state archiviate. “Denuncerò lo Stato
perché ha fallito nell’adottare le misure necessarie per garantire a
mio figlio ed ai suoi colleghi quanto necessario alla sua sicurezza” ha
affermato la madre di Svilen Kirov, giovane rimasto ucciso
nell’attentato “lo farò assieme ad altri parenti delle vittime di
Kerbala”. I genitori di Nikolai Saraev, un’altra vittima, sono
categorici: “morto per negligenze criminali”. “Presenteremo denuncia
non appena sarà finito il lutto, tra 40 giorni” ha affermato il loro
legale “dimostreremo che nulla è stato fatto per salvare quei ragazzi”.
Fortemente critico sull’operato dei comandi militari bulgari anche
Pavel Gonevsky, inviato in Iraq del quotidiano “24 Chassa”.
“L’incidente trasuda mancanza di professionalità. La base militare
India era mal difesa su tre lati. I nostri soldati erano un obiettivo
ideale”. “Le uniche misure di sicurezza adottate erano trincee e muri
di mattoni collocati però a soli dieci metri dall’edificio principale”,
specifica Tzvetan Tomchev, inviato a Kerbala del quotidiano Troud.

Sessantadue soldati hanno detto no

Sessantadue soldati appartenenti al secondo battaglione dell’esercito
bulgaro che dovrebbe essere presto inviato in Iraq si sono rifiutati di
partire. “Uno ogni dieci lascia il secondo battaglione”, titola Troud.
L’attuale regolamento prevede infatti che per missioni all’estero
occorra l’assenso del militare selezionato per partire. Secondo il
quotidiano “Sega” il ministro della Difesa sarebbe già al lavoro per
proporre al Parlamento una modifica dell’attuale legge che regolamenta
le missioni di peacekeeping in modo da renderle obbligatorie ai
militari di carriera. Queste modifiche legislative ricadranno su circa
8.000 militari professionisti e sui 1.500 militari che hanno già
partecipato, come volontari, nella loro carriera a missioni all’estero.
Ma la polemica in Bulgaria è anche scoppiata sull’inadeguatezza
dell’equipaggiamento dei militari a Kerbala. “I nostri soldati vanno in
giro con torce elettriche da 1 leva (50 centesimi di euro)”, titola “24
Chassa”. Il quotidiano poi riporta che molti dei soldati che partono
per l’Iraq stanno spendendo migliaia di euro procurandosi privatamente
un miglior equipaggiamento. Anche in seguito ad esplicite richieste il
rinnovamento dell’equipaggiamento a disposizione sarebbe stato negato.
Nonostante i 5 milioni di euro spesi negli ultimi dieci anni per
riformare l’esercito non vi è ancora un solo soldato bulgaro in grado
di partecipare a missioni come quelle in Iraq, constata il settimanale
168 Chassa.

62 Bulgarian Soldiers Drop out of Second Iraq-Bound
Unit

Sixty-two Bulgarian soldiers dropped out of Bulgaria's
480-strong replacement unit following the attack in
the city of Karbala on 27 December, the Chief of the
General Staff of the Bulgarian Army General Nikola
Kolev announced.

The attack wounded twenty-six and killed five
Bulgarian soldiers, the country's first fatalities in
Iraq.

The new contingent is to replace 480 Bulgarian troops
who have been deployed in Iraq as part of a
9,000-strong Polish-led multinational contingent in
Iraq.

Some of the tasks of the first Bulgarian unit will be
handed over to the coalition forces due to the rising
tension among Bulgarian military men after the deadly
attack at the end of 2003, the Bulgarian and Polish
commandments have agreed.

Bulgaria's second unit is due to head for Iraq in
separate groups after January 15.

At an official ceremony in the town of Kazanlak,
Bulgarian President Georgi Parvanov warned the
soldiers that some of the Iraqi locals might be
hostile to them and called on them to be on the alert.

filosofia. è incredibile -dice ljusic- come la storia possa creare dei
paradossi. gandhi lottò contro il colonialismo inglese, mentre rugova
(che di frequente dai media internazionali è chiamato “il gandhi dei
balcani”, ndt) non fa che espellere i serbi dal kosmet e non vuole
altro che l’annessione dei territori del kosmet all’albania. gli
italiani hanno presentato rugova come un non-violento ed un
propugnatore della tolleranza, un politico di stampo occidentale con
forti legami con il cristianesimo. eppure, rugova non ha perso
l’occasione per far ‘digerire’ anche ai lettori del corriere l’idea di
un kosovo separatista ed indipendente, con tanto di esibizione della
nuova bandiera. ad analizzare l’intervista, continua ljusic, è evidente
il tentativo di rugova di mascherare e manipolare non soltanto la
realtà dei fatti ma anche gli obiettivi della comunità albanese, che
preme per la definitiva indipendenza.  rugova è particolarmente
tollerante, sì, ma nei confronti dei criminali di guerra albanesi che
hanno compiuto ripetuti atti terroristici a danno della minoranza
serba. negli ultimi tre anni e mezzo sono duemila i serbi uccisi e
rapiti, e gli attacchi di matrice terroristica contro la comunità
serba si verificano con cadenza pressochè quotidiana. è raro che passi
un giorno senza che un cittadino di etnia non albanese non venga
aggredito o senza che non si oda l’esplosione d’una granata. la
presidenza di rugova non ha affatto fermato -né diminuito- la violenza.
il ritratto che rugova offre di sé è quello di un uomo religioso e
tollerante soltanto perché vuole ingraziarsi i favori del vaticano.
vuole costruire una cattedrale per madre teresa di calcutta a pristina
(ed ignora che madre teresa fosse originaria di skopje, in macedonia);
è stato invitato il papa in persona all’inaugurazione perché rugova è
consapevole di quanto un simile evento tornerebbe utile in senso
politico agli albanesi del kosovo. che di cattolici a pristina non ce
ne siano (i pochi croati di fede cattolica che abitavano a janjevo sono
scappati) per rugova non ha alcuna importanza. è un gesto mediatico che
serve a sdoganare una “tolleranza” di facciata agli occhi del mondo
intero. delle 114 chiese serbe che in kosovo in questi tre anni sono
state danneggiate o distrutte (l’ultima proprio questa settimana a
urosevac, ndt) non gli importa, perché sono dei serbi ortodossi, e
rugova non si interessa affatto della minoranza serba. e del resto, la
distruzione del patrimonio culturale ed artistico dei serbi in kosovo è

of the international communty regarding the rights of

displaced persons, Russian Deputy Representative to
the United Nations (UN) Gennady Gatilov told a
Security Council session on the situation in this
southern Serbian province on Wednesday.
There is no real and equal security for the entire
population of the province, and no respect for the
elementary rights and freedoms of all citizens,
including the right to equal conditions for
employment, Gatilov said.

Kosovo: UN Official Cites Poor Record On Minorities

United Nations, 17 December 2003 (RFE/RL) -- A top UN
official says Kosovo's Serbs and other minorities have
little influence on decision making at any level of
government in the majority-Albanian province.
The UN's undersecretary-general for peacekeeping,
Jean-Marie Guehenno, told the UN Security Council in a
briefing today that Serbs are under-represented and
poorly integrated. He said less than 10,000 Serbs have
returned to Kosovo from a pre-1999 population of about
250,000.
The return and integration of minorities is a key
reform benchmark in the UN's "standards before status"
policy for Kosovo. A document launched this month
calls for the reforms to be reviewed in 18 months, but
Guehenno stressed that it is not a formal timetable
for the province's status to be decided. "It is clear
that there is no deadline and that the future status
process will not start automatically on the review
date," he said. "A prerequisite for any discussion on
Kosovo's future status remains achievement of the
eight standards."
Other standards include functioning democratic
institutions, rule of law, freedom of movement, and
dialogue between Pristina and Belgrade. The United
Nations runs Kosovo as a virtual protectorate but has
been gradually returning authority in local government
areas to local bodies dominated by ethnic Albanians.
Security Council members today expressed
disappointment that reforms were lagging. They called,
in particular, for Pristina and Belgrade to resume
direct dialogue.
Germany's UN Ambassador Gunter Pleuger said that
failure to engage in dialogue and other reforms will
have an impact on Kosovo's European integration
prospects. "The implementation of the standards will
be closely linked with the EU association process, and
conversely, obstruction of efforts to meet the
standards will surely have serious consequences for
aspirations to draw closer to Europe," he said.
The British and U.S. envoys also urged a resumption of
talks first held in mid-October. British Ambassador
Emyr Jones Parry also pressed Kosovo Albanian leaders
to genuinely embrace the reform effort. "Kosovo has
been given an opportunity, an opportunity to come out
of the shadow of darkness and to move forward and the
whole concept of 'standards before status' is not
rhetorical. It's absolutely basic to the sort of
Kosovo that all of us want to see created," Jones
Parry said.
The leaders of Kosovo's provisional institutions, as
well as the Kosovar president and prime minister, have
stated their commitment to the process on implementing
the eight chief standards. Kosovo Serb leaders have
criticized the document launching the new process --
to be reviewed in mid-2005, as inadequate.
The UN peacekeeping chief, Guehenno, told the council
that Kosovar leaders have not endorsed the dialogue
with Belgrade on practical matters for political
reasons. But he said preparatory work is ongoing
within the local government.
He said Belgrade has not been willing to discuss the
dialogue because of the Serbian parliamentary election
campaign. The UN ambassador of Serbia and Montenegro,
Dejan Sahovic, told the council Kosovar leaders were
to blame for the failure to resume talks. "We express
the full readiness of Serbia and Montenegro to engage
in discussions on practical issues of mutual interest,
which would improve the daily lives of all inhabitants
of Kosovo and Metohija," he said.
Under previous agreements, experts from both sides are
supposed to meet to discuss practical issues such as
energy, transportation and returns of minorities to
Kosovo.

il primo ministro zivkovic si è incontrato a belgrado con javier
solana ed ha ribadito che la ‘road map’ per il raggiungimento degli
standard nel kosovo è inaccettabile per il governo di belgrado, perché
sembra voler definire unicamente lo status (l’indipendenza) senza che
la risoluzione 1244 delle nazioni unite venga tenuta in considerazione.
zivkovic, che ha discusso con solana delle imminenti elezioni in
serbia, si augura che la stabilità politica della serbia porti ad una
soluzione soddisfacente per l’area del kosovo e della metohija.

Union of Serb communities to adopt "St. Nicolas Day
Declaration"

of Kosovo-Metohija Serb Communities will hold a
session on Thursday, and, in view of the present
sitiation which followed after the adoption of
so-called standards for Kosovo without the
participation of the Serbian side, adopt a "St.
Nicolas Day Declaration" which is to specify the
stands of Kosovo-Metohija Serbs, union's president
Marko Jaksic confirmed for Tanjug on Wednesday.
"Since the so-called Holkeri's (UNMIK) stands are, in
fact, those of the ethnic Albanians, which are
unacceptable for us, we will specify our views, stands
and strategy in the 'St. Nicolas Day Declaration' with
the aim of protecting the survival of Kosovo-Metohija
Serbs," Jaksic said.

Kosovo Serb MPs boycott Standards Plan drafting

PRISTINA -- Wednesday – Two Serb minister in the
Kosovo interim government said today that they will
not take part in drafting a plan for the
implementation of standards in Kosovo.
Milorad Todorovic told media that he and Goran
Bogdanovic had been invited by Prime Minister Bajram
Rexhepi to join working parties for minorities and
repatriation and for economics and finance.
Describing the term “minorities” and unacceptable to
the Serb community, Todorovic said he would not
consider being seen as a minority until UN Security
Council Resolution 1244 is implemented in the
province.
“To make it more ironic, invitations and documents
were sent to us in Albanian,” he added.

una donna serba è stata aggredita e linciata nell’area nord di
mitrovica. la donna, il cui nome è zlata djurovic (52 anni) era in
compagnia dell’anziana madre, ed è stata ricoverata nel più vicino
centro ospedaliero con ferite alla testa. le forze dell’unmik, ha
spiegato ai cronisti dell’agenzia srna il direttore dell’ospedale marko
jaksic, non pattugliano più le zone serbe di mitrovica che sono
costantemente a rischio di incursioni della maggioranza albanese. un
mese fa due teenagers serbi erano stati ricoverati nello stesso
ospedale dopo essere stati selvaggiamente picchiati da alcuni albanesi.
il comandante unmik di mitrovica, john napolitano, ha definito

Serb man aquitted in Kosovo murder case

GNJILJANE -- Wednesday – An international trial
chamber in Kosovo has aquitted a Serb man of the
murder of an ethnic Albanian in 1999.
A lawyer for Dragan Nikolic said the court had
concluded the defendant was not at the scene when the
crime was committed.
Nikolic had originally been sentenced to 12 years'
imprisonment by a panel of ethnic Albanian judges in
Gnjiljane.
The murder occurred in the village of Lubidza, near
Vitina.

(ANSA) - TIRANA, 18 DIC - Il parlamento del Kosovo, a maggioranza
albanese, ha votato oggi una risoluzione con la quale accetta di
collaborare con il tribunale penale internazionale (Tpi) per i
crimini di guerra nell'ex Jugoslavia. Lo stesso parlamento dovra' ora
preparare una legge apposita. Dalla fine della guerra con la Serbia
(giugno 1999) combattuta al fianco della Nato, tre ex guerriglieri
albanesi del disciolto Esercito di liberazione del Kosovo (Uck) sono
stati arrestati e trasferiti davanti al tribunale dell'Aja. I tre
sono accusati di crimini di guerra commessi contro serbi ma anche
contro albanesi sospettati di collaborare con Belgrado. La
procura del Tpi ha tuttavia rivelato nei mesi scorsi di avere in
corso altre indagini contro esponenti della guerriglia albanese che
potrebbero essere incriminati dallo stesso tribunale di fronte al
quale e' imputato anche Slobodan Milosevic, loro acerrimo nemico.

Balkan traffic in women and girls 'on rise'

The "white slave trade" - the sale of women and girls
into prostitution and children into forced labour - is
growing in the Balkan region, according to a report
published yesterday by the United Nations and the
Organisation for Security and Co-operation in Europe.
International efforts to stop the trafficking of women
and children in and through south-east Europe have
yielded "no actual decline" in the illegal trade, even
as tougher police and border patrolling have succeeded
in cutting off some transit routes from the region to
the European Union.
Instead, ringleaders of the illegal trade have
abandoned old trade routes and adopted new methods.
For example, where overland routes are now blocked,
Moldova-based gangs have begun transporting victims by
air into the EU, the report alleges.
Crime bosses operate with impunity in the region and
elected leaders are sometimes complicit in their
crimes, it says.
The alarm sounded by the report, backed by facts and
figures from the region, will be an embarrassment to
Bulgaria, Romania, Moldova, Albania and countries of
the former Yugoslavia.
Romania and Bulgaria may be hit particularly hard,
having been encouraged by the European Commission to
prepare for membership in an enlarging EU as early as
2007.
Liberalised visa regimes with the EU mean that
citizens of both countries, along with citizens of
Moldova allowed to carry Romanian passports, can be
smuggled more easily into the EU but cannot be traced
because they carry legitimate papers.
The report also reflects poorly on international
efforts to fight the stubborn influence of Balkan
criminal gangs, increasingly perceived as a serious
security threat not just in their home countries but
in western Europe.
"The reality is that there is no time to rest on our
laurels," Helga Konrad, head of anti-trafficking
affairs for the EU-sponsored Stability Pact for South
East Europe, says in the report's foreword.
A new collective security strategy adopted by leaders
of the EU's member states at last week's summit in
Brussels accuses "Balkan criminal networks" of
illegally trading 200,000 women.
The document notes a further need to increase crime
fighting efforts already boosted earlier this year,
during the Greek presidency of the EU, which placed a
high priority on fighting Balkan crime.
But traffickers resist direct international pressure.
In Kosovo, Serbia's breakaway province run by the UN
and occupied by Nato, the report warns of increasing
illegal migration including the slave trade.
Such difficulties mirror those faced in efforts
against heroin smugglers.

Covic announces criminal lawsuit over privatization in
Kosovo

18:31 GORAZDEVAC , Dec 20 (Tanjug) - Democratic
Alternative leader and Coordinating Center for Kosovo
and Metohija President Nebojsa Covic announced in
Gorazdevac, near Pec, on Saturday that he will file
criminal charges with the international court against
all responsible staff of the local United Nations (UN)
administration UNMIK because of the manner of
implementation of the privatization of companies in
Kosovo and Metohija, describing it as plain robbery.
Covic told residents of this Kosovo-Metohija town to
live in harmony and unity, because that is the only
way they can resist the enemy who wants ethnically to
cleanse this area, the DA PR Service said.

Albanian guerrilla leader arrested in Germany

BERLIN -- Friday -- German police have arrested an
Albanian politician suspected of inciting interethnic
hatred, officials said Wednesday.
Idajet Beqiri was taken into custody Saturday after he
attempted to cross by foot into Switzerland near the
southern German city of Constance, said German border
police spokesman Helmut Mutter.
Beqiri was returned to Germany Monday and is currently
in prison in Constance, Mutter said. He had no details
about his possible extradition to Albania.
The charges against Beqiri, the head of Albania's
Party of National Unity, arise from his involvement
with the Albanian National Army, which claims to be
active in ethnic Albanian-populated areas of southern
Serbia, Kosovo and Macedonia, the Albanian authorities
say.
Kosovo, and to a lesser degree Macedonia and parts of
Serbia bordering on Kosovo, have been rocked by ethnic
Albanian insurgencies over the past five years. The
ANA seeks to unite all predominantly ethnic
Albanian-populated areas of the Balkans.
The U.N. mission in Kosovo declared the Albanian
National Army a terrorist organization in April, after
it took responsibility for the bombing of a railway
bridge in the north of the province.
If found guilty of inciting ethnic hatred, Beqiri
could be sentenced to 10 years in prison.

KOSOVSKA MITROVICA -- Wednesday – UN police have
arrested an ethnic Albanian man in Kosovo suspected of
killing a Serb man in April this year.
Erol Jahiri was arrested for the murder of Slavisa
Maksovic in the village of Grabovac on April 5.
Serbian police said the murder was solved in
cooperation with the UN police investigators.

A former ethnic Albanian rebel commander in northern
Macedonia, Xhemail Hiseni, surrendered to NATO
peacekeepers in eastern Kosovo, NATO said in a
statement Tuesday.
Hiseni, also known by his nome-de-guerre, "Commander
Jamie Shea", was sentenced to seven years in prison by
the Macedonian judiciary in November for two bombings,
one on a vital Belgrade-Skopje railway and the other
on the main square of the northern town of Kumanovo.
Hiseni - along with another fugitive sentenced in the
Kumanovo bombing, "Commander Jackal" Avdi Jakupi - was
believed to be a regional leader of the extremist
Albanian National Army (AKSh) - an underground group
that was declared a terrorist organization by Kosovos
United Nations administration.
At least a dozen Macedonians and two Polish
peacekeepers were killed in a spree of bombings
earlier this year in ethnically divided Macedonia.
Tensions in the region close to the Albanian-dominated
Serb province of Kosovo remained high, posing a steady
threat to the stability of Macedonia ever since the
end of the UCK-led rebellion in 2001.
About 200 European Union police officers were
dispatched to Macedonia to help local authorities try
to regain full control of the former crisis regions
and fight widespread organized crime.

Kosovo Serb MPs protest election

PRISTINA -- Monday – Serb MPs in Kosovo have walked
out of today's session of parliament after the
presidency adopted a declaration dismissing the
validity of Serbian general elections, without
presenting it to MPs for discussion.
Parliament Speaker Nexhat Daci announced this morning
that the Parliament Presidency had adopted the
declaration and MPs would not be given the opportunity
to debate it.
The declaration was proposed by the Democratic League
of Kosovo, in protest at the participation of several
Kosovo Serb MPs in the Serbian parliamentary
elections.
A member of the Serb Return Coalition said the
parliament had no authority to rule on Serbian
elections.

Strong protest against UNMIK chief''s decision on transfer of authority

20:09 BELGRADE , Dec 30 (Tanjug) - President of the Coordinating Center
for Kosovo-Metohija Nebojsa Covic issued Tuesday the strongest protest
over the decision of UNMIK chief Harri Holkeri to complete the
transfer of authority to provisional institutions in the province in
sectors cited in the Constitutional Framework Chapter 5. A statement
presented to Tanjug says that the sectors concerned are those of
industry, culture, education, energy, trade and media, and notes that
the authority has been transferred despite the fact that even the
fundamental conditions set out in the Constitutional Framework and the
UN Security Council Resolution 1244 have not been secured.
A special concern has been caused by a statement from Holkeri's office
that provisional self-government institutions, that is ethnic
Albanians, will have an advisory and consultative role in sectors
reserved for UNMIK, which is contrary to Resolution 1244, the
statement says.

Book on terrorism, organized crime in Kosovo and Metohija

17:07 BELGRADE , Nov 4 (Tanjug) - The book entitled
"Ethnic Albanian Terrorism and Organized Crime in
Kosovo and Metohija", published by the Serbian
government, is clear evidence that terrorism and
organized crime exist in the province and that nothing
has been done to stop them, Serbian Prime Minister
Zoran Zivkovic said on Tuesday.
This book can help the provincial United Nations
administration UNMIK and local peacekeeping force
KFOR, the prosecutor's office of the Internatuional
Criminal Tribunal for the former Yugoslavia (ICTY) in
The Hague, and the police forces of numerous European
countries, since organized crime in Kosovo poses a
threat not only to this country, but to other states
as well, Zivkovic said.
