Una delegazione del Coordinamento Rsu e della Cgil di Brescia si è recata alla Zastava di Kragujevac nei giorni 26-27-28-29 ottobre per consegnare le somme relative alle adozioni a distanza attivate a favore dei figli dei lavoratori della Zastava .
La maggior parte delle nuove adozioni portate in questa occasione
(per un totale di lire 40.000.000) sono state raccolte a Padova,
Trieste e Firenze.
Assieme alle nuove adozioni sono state portate anche le quote
per i rinnovi di parte delle adozioni attivate l'anno scorso
(sopratutto quelle di Milano, Lodi e Brescia).

Da una verifica effettuata con i delegati della Zastava risulta che,
pur tra mille difficoltà, sono 1.400 le adozioni fino ad ora attivate
(600.000 per adozione) con quelle avviate anche in Piemonte,
Puglia, Emilia, Lazio, e dalla FIOM di Lecco.

La situazione che abbiamo trovato è peggiore
di quanto abbiamo visto le precedenti volte.
Le conseguenze dell'embargo e della guerra pesano
su tutti i lavoratori della Jugoslavia come un macigno
sempre più grande e pesante da sopportare:

- La speranza di ricostruzione delle fabbriche bombardate
è ormai una chimera sempre più difficile da conquistare.
La subordinazione economica imposta dall'occidente
e sostenuta dal quadro politico Jugoslavo si manifesta nello
smantellamento delle poche risorse industriali disponibili,
nella privatizzazione di quanto può essere appetibile al capitale
ed alla finanza occidentale (attività e mercati). Il risultato è
(ad esempio per la Zastava) il licenziamento dei lavoratori
(15.000 per ora sui 36.000), l'inoccupazione e la precarietà
di chi rimane, costretto alla massima flessibilità ed alla riduzione
della paga (mediamente chi riesce a lavorare percepisce
70/80.000 al mese, chi rimane "disponibile" e non è ancora
stato licenziato, percepisce un'assegno (come se fosse in Cig)
di 18.000 al mese.
La stragrande maggioranza dei lavoratori è tutt'ora disoccupata
e le poche e precarie occasioni di lavoro sono all'insegna
di un quadro iperliberista, senza diritti e tutele.
Di contro il Governo favorisce per legge l'importazione
delle auto usate tutto a scapito delle possibilità produttive
(che si potrebbero rilanciare nonostante le distruzioni)
della produzione interna.

- L'allentamento dell'embargo si è trasformato sopratutto
in occasione di arricchimento per la speculazione privata
a discapito di un servizio pubblico ormai marginalizzato
ed avviato allo smantellamento dalla stessa classe politica
Jugoslava che ha accettato anche in questo campo
la totale privatizzazione.
Per esempio il servizio sanitario non riesce a reperire e distribuire
i medicinali necessari mentre questi sono in abbondanza
nelle farmacie private che le vendono a prezzo pieno
(per chi le può comprare).

- Il Governo ha avviato una serie di interventi (di risanamento ...!? )
che colpiscono essenzialmente i lavoratori e le fasce più deboli.
Tra gli ultimi provvedimenti Governativi la riduzione delle tutele
per assenze in caso di maternità e malattia, lo smantellamento
dei contratti di lavoro, la liberalizzazione delle assunzioni a tempo
determinato, la privatizzazione degli uffici di collocamento,
e la riduzione dell'agibilità sindacale di cui si vuol comprimere
sopratutto l'autonomia dal quadro politico.
E' stata abolita la proprietà di azioni da parte dei lavoratori
(ultimo residuo della politica di Tito) e tutto il potere torna nelle mani delle classi dirigenti aziendali che non devono più rendere conto
delle loro scelte ai lavoratori.
Salari e pensioni sono ridotti per legge mentre di contro
la nuova gestione privata di gas, luce ed acqua pretende il pagamento
delle bollette (non più in regime di prezzo amministrato e calmierato
ma a prezzo libero) anche di quelle arretrate (congelate in parte
durante i periodi di embargo e guerra) pena il taglio dei servizi
a chi non può pagare.

- Del fiume di aiuti occidentali di cui si sente parlare in occidente
non si vede nulla. Quello che arriva è destinato a sostenere
la propaganda politica e l'apparato delle forze e delle
amministrazioni filo-occidentali. La popolazione continua
ad impoverirsi mentre si rafforza una nuova ed arrogante burocrazia
che cerca ormai di controllare e ridurre a se anche le organizzazioni
sindacali, dividendole e spaccandole in sindacatini di parte (legati
alle varie correnti del DOS). Solo alla zastava sono ormai 7 i sindacati
inventati di sana pianta, accanto a quelli storici ("indipendenza",
sindacato minoritario su posizioni più radicali presente sopratutto
nel reparto zastava che costruisce fucili da caccia (non bombardato),
e il sindacato autonomo Zastava, maggioritario che raccoglie ancora
il 90% delle iscrizioni tra i lavoratori, e presente sopratutto nei reparti auto e camion, quelli interamente distrutti dalle bombe).
Per questo il sindacato autonomo Zastava rimane esposto
ad un'attacco che rende sempre più difficile la sua azione.
Un esempio è il tentativo da parte della direzione aziendale Zastava
di ridurre l'impatto che la campagna di adozioni a distanza
ha sui lavoratori della Zastava.
Grazie alla solidarietà dei lavoratori Italiani, i lavoratori della Zastava riescono a ridurre gli effetti di una frantumazione della loro unità attorno all'insediamento industriale e contro i tentativi del suo
definitivo smantellamento. Anche grazie a questa solidarietà
il sindacato, in Zastava, riesce a rimanere un importante riferimento
per i suoi lavoratori ed a frenare processi di esodo e migrazione,
di riduzione della presenza organizzata del sindacato in fabbrica.
Ciò riduce la mano libera che la nuova direzione aziendale vorrebbe
avere nella gestione dei processi di liquidazione, chiusura e
privatizzazione di ciò che rimane appetibile per il capitale occidentale.
Questo atteggiamento si manifesta in diversi modi. Ultimi esempi
sono il licenziamento di una lavoratrice zastava che seguiva
e gestiva dal punto di vista amministrativo la campagna adozioni
(ciò nonostante questa continua la sua attività come volontaria,
anche se licenziata) e la precarietà in cui è oggi costretta a lavorare
l'unica altra lavoratrice che con fatica gestisce il progetto
e che fa da interfaccia alle iniziative che partono dall'Italia.
In occasione dell'ultima visita della Fiom di Lecco che doveva
distribuire le sue adozioni, l'azienda non ha concesso neppure
la saletta per le assemblee in cui si procedeva solitamente alle
consegne. Le consegne sono state fatte all'aperto, nel cortile.

Contro il progressivo smantellamento delle normative contrattuali
e di legge che normano i rapporti di lavoro, contro il peggioramento
delle condizioni di vita e di lavoro, per impegni certi sulla
riorganizzazione delle attività industriali al fine di un loro salvataggio e rilancio, si sono realizzati tra mille difficoltà scioperi e manifestazioni, ed altri sono in programma.
Ma rimane la difficoltà di una lotta condotta con scarsa efficacia
(è difficile incidere quando la produzione è già ferma di per se a
causa dei bombardamenti) anche per il totale silenzio del Governo
e delle controparti aziendali che sembrano non voler legittimare
alcun sindacato, alcuna iniziativa, che si muove esplicitamente
in termini di critica alla loro politica..
Una lotta peraltro condotta in estrema solitudine anche per la scarsa
attenzione che viene loro prestata dalle grandi organizzazioni sindacali
Europee incapaci di vedere come il liberismo e la globalizzazione,
come l'attacco ai diritti dei lavoratori ed ai sindacati stia distruggendo (non solo in Jugoslavia ma anche in Bosnia, Croazia e Slovenia) quella "carta dei diritti" che a Nizza è stata presentata come carta d'idendità di una europa democratica, e che il sindacato Europeo celebra come conquista fondamentale.

La solidarietà che con le adozioni a distanza, nonostante tutto,
si riesce ancora a tenere attiva, è sempre più la sola cosa che aiuta
concretamente questi lavoratori a resistere ed a ridare prospettiva
alla necessità di un sindacato forte ed autonomo.
Oltre all'aiuto economico, delle adozioni, conta sopratutto l'aiuto morale che questa iniziativa produce su questi lavoratori. Il non sentirsi abbandonati e dimenticati da loro la forza di provare a credere
che stare assieme e difendere la loro rappresentanza ed il diritto
di averla è una lotta ancora possibile.
Posso dirvi che questo aspetto non è da sottovalutare.
Abbiamo girato per una Kragujevac deserta, quasi una città morta.
Nessuno in giro, negozi vuoti. Neppure subito dopo la guerra
abbiamo visto tanta desolazione. Ma abbiamo visto anche tanta
riconoscenza e convinzione che, nonostante il Governo, nonostante
questa desolazione, se questi lavoratori saranno compresi ed aiutati,
se riusciranno a non essere dimenticati, qualcosa di importante
si possa ancora fare.

Siamo in pochi a continuare su questa strada.
I sindacati Italiani sono sordi ed assenti.
I miliardi ricavati dalla trattenuta per l'ora di solidarietà col Kosovo, non si sa come siano usati e spesi, non si sa a chi sono consegnati e per fare cosa.
Sicuramente non una lira è andata ai lavoratori della Jugoslavia
colpiti dai bombardamenti e che lottano oggi per difendere
la possibilità di avere un forte sindacato e per una prospettiva
di lavoro e di salario.

I nostri sindacati balbettano parole incomprensibili sulla guerra,
penzolano tra interventismo e preoccupazione, non riescono a dire
un NO alla guerra. Non l'hanno detto per la Jugoslavia, non riescono
ancora a dirlo per l'Afganistan.
Ma le vittime di quella guerra, i lavoratori, le loro famiglie, i pensionati, ancora ci guardano. Hanno cercato, inascoltati, la solidarietà dei nostri sindacati che avevano invece come unica e stupida
preoccupazione quella di non confliggere con le politiche dei nostri
governi, ma hanno trovato quella dei lavoratori.

Oggi è tutto più difficile.
Non facciamo venire meno la speranza e rilanciamo la campagna
di adozioni a distanza per le famiglie dei lavoratori della Zastava.
Anche questo è lotta contro la guerra, contro un liberismo selvaggio,
contro una deriva sindacale che non riesce più neppure a manifestare
solidarietà alle vittime della guerra, ai lavoratori.

Per sostenere la campagna di adozioni Vi proponiamo di organizzare
iniziative di presentazione nelle vostre realtà e territori.
Vi proponiamo di traguardare una iniziativa per la prossima primavera.
Un' incontro tra le famiglie dei lavoratori Italiani che hanno avviato
una adozione e quelle della Zastava di Kragujevac.
Un'incontro da organizzare dentro la loro fabbrica.
Una giornata di incontro e di festa, in cui confrontarci, divertirci,
per far sentire anche fisicamente che questi lavoratori non sono
stati ne dimenticati ne abbandonati.

Oltre che con la raccolta delle adozioni, è possibile sostenere il progetto organizzando la vendita di un CD realizzato in occasione di un concerto di solidarietà tenutosi a Marghera il 15 luglio 2000.

l'iniziativa e la illustra nel quadro della lotta contro la guerra.

HAEKKERUP, COVIC SIGN DOCUMENT ON KOSOVO
BELGRADE, Nov. 5 (Beta) - UNMIK head Hans Haekkerup
and Coordinating Center for Kosovo chairman Nebojsa Covic
signed a joint document on Kosovo in Belgrade on Nov. 5.
The documents confirms the basic principles outlined in U.N.
Security Council Resolution 1244 and reaffirms its provisions
related to security, human rights, and the return of displaced
persons and refugees.
The signers of the document said they were determined to "be
active in eliminating the justified concern felt by Serbs and
other ethnic communities in Kosovo and Metohija."
The future of Kosovo, according to the document, cannot be
altered "by any action, including interim self-government
institutions." It also boosts the number of international judges
and prosecutors in Kosovo's judiciary.
Covic called the document "Serbia's and Yugoslavia's return to
Kosovo," adding the the most powerful countries of the world
and U.N. Secretary General Kofi Annan had guaranteed in it that
Kosovo would not become an independent state.
The signing ceremony was attended by Yugoslav President
Vojislav Kostunica, Yugoslav Prime Minister Dragisa Pesic,
Yugoslav Deputy Prime Minister Miroljub Labus, Yugoslav
Ethnic Minority Minister Rasim Ljajic, and Serbian Interior
Minister Dusan Mihajlovic.
Covic said, speaking of Serb participation in elections in Kosovo
on Nov. 17, that the Yugoslav delegation "has succeeded in
eliminating the arrogant stance visible among international
community representatives at the beginning of the
negotiations."
"Now it is up to Albanian leaders to tell their people that they
have been lying to them about an independent Kosovo," said
Covic, adding that he expected problems in both Kosovo and
southern Serbia.

DRAFT UNMIK - FRY COMMON DOCUMENT

Belgrade, 5 November, 2001

An UNMIK - FRY Common Document has today been adopted,
by the Special Representative of the secretary-general in
Kosovo Mr. Hans Haekkerup and the Special Representative of
the Government of the Federal Republic of Yugoslavia and the
Government of the Republic of Serbia Mr. Nebojsa Covic, who
is also the President of the Coordinating Centre for Kosovo and
Metohija, which

- GENERAL -

1. Confirms the basic principles of United Nations Security
Council Resolution (UNSCR) 1244 (1999) and the shared belief
that the Resolution can only be successfully implemented
through the joint efforts of all concerned parties. It is in the
interest of all parties to do their utmost to promote the
objectives of the Resolution and to consider the concerns of
other parties and to strive to resolve them through cooperation.

2. Reaffirms the obligations stipulated in UNSCR 1244 on
security and human rights, the return of all displaced persons
and refugees as well as the unchallenged authority of UNMIK to
implement UNSCR 1244 and confirms that all communities in
Kosovo have the same rights and that UNMIK shall support
these rights.

3. Affirms our determination to address actively the justified
concerns of the Kosovo Serbs and other communities in Kosovo
and firmly commits to continue to address these, so that all
communities will be able to fully rely on the prerequisites and
principles underpinning the international effort in Kosovo.
Non-discriminatory treatment for all the citizens represents the
basis for a multi-ethnic, multi-religious and multi-cultural
Kosovo.

4. Promotes the protection of the rights and interests of
Kosovo Serbs and other communities in Kosovo, based on the
principles stated in UNSCR 1244, including the sovereignty and
the territorial integrity of the Federal Republic of Yugoslavia, as
well as in the Constitutional Framework for Provisional
Self-government.

5. Reaffirms that the position on Kosovo's future status
remains as stated in UNSCR 1244, and that this cannot be
changed by any action taken by the Provisional Institutions of
Self-government.

6. Welcomes the recently established cooperation between
UNMIK on one side and the Federal Republic of Yugoslavia,
through the Coordination Centre for Kosovo, on the other.
Affirms the establishment of a high-ranking working group
under the authority of the SRSG, which will comprise of
representatives of the FRY on the one hand, and
representatives of UNMIK, including the Provisional
Self-Government Institutions on the other. This group shall
provide for a continued and sustainable cooperative approach
covering areas of mutual interest and common concern in order
to secure a timely and regular consultation and coordination.
The high-ranking working group can establish working bodies
within specific areas of mutual interest.

7. Reiterates the commitment of solving the fate of the
missing persons, and points out that this open wound of all
communities can only be healed through cooperation and sharing
of information.

8. Honors the indisputable right of displaced persons and
refugees to return to their homes and assures that the
irreversible process has begun.

9. Warmly welcomes the extensive participation of all
communities in the process of registration and supports the
aspiration that no one should be denied the benefits of
democracy.

10. Stresses that the next stage in the process is to promote
the development of democracy, security and prosperity and that
the election presents an opportunity for a new democratic start
with the establishment of the substantial Self-government and
the basis for an open dialogue on a shared regional and
European future, which
will require cooperation between all communities in Kosovo
and between democratically elected leaders in Kosovo, the
Republic of Serbia and the Federal Republic of Yugoslavia.

11. Strongly recommends the Kosovo Serbs to actively engage
in the future of a multiethnic Kosovo by participating in the 17
November election and the institutions of the Provisional
Self-government.

- SPECIFIC AREAS OF ENGAGEMENT AND COMMON
INTEREST -

Security, Protection and Freedom of Movement The
ensuring of security for all communities is the key condition for
a multiethnic Kosovo. It is necessary to enhance the level of
general security and protection of vulnerable persons,
settlements, communications and cultural sites and property,
and full freedom of movement in Kosovo.
Recognizes the need for enhanced cooperation between
UNMIK, the Federal Republic of Yugoslavia, and the Republic
of Serbia to increase freedom of movement at administrative
boundary crossing points between Kosovo and areas within the
Federal Republic of Yugoslavia and agrees to increased
operational coordination and security at these locations.
Recognizes UNMIK's commitment to increase freedom of
movement through the issuance of free license plates to Kosovo
Serbs, as well as the planned establishment of a train service
and transport from Kosovo throughout the FRY.

Missing Persons
Reiterates the commitment of solving the fate of the
approximately 4,000 missing persons from all communities, and
to that end, UNMIK agrees to, by 31 December 2002,
investigate all non-surveyed gravesites in Kosovo and
undertake exhumations of all human remains, and to process,
through DNA testing and ante- and post-mortem data, 1,250
unidentified human remains held throughout Kosovo with a
view to their identification and return to family members.
Recognizes that the exhumation and identification program is
only part of the activities related to missing persons, thus
obliging UNMIK and FRY authorities to cooperate in full
transparency and to share all relevant data and information.
This cooperation shall also include work on gravesite locations.

Return of Refugees and Displaced Persons
Honoring the indisputable right of displaced persons and
refugees to return to their homes, UNMIK will establish as a
priority an Office of Return under the direct supervision of the
SRSG, acting as the operative, coordinating body for the
furtherance of the process, including by suggesting a new plan
for returns covering 2002-2003. In the process all relevant
actors shall be represented, including, as appropriate, from the
Provisional Institutions of Self-government, IDP and refugee
communities as well as host area authorities with a view for
appropriate facilitation. The fragile process must be sustainable
and considerable measures will be taken to ensure the safety of
the returnees. This key issue shall be given priority and the
Provisional Institutions of the Self-government are expected to
support returns actively.
Reaffirms the right for refugees and internally displaced
persons to recover their property and possessions and
acknowledges that the restitution of property or compensation is
crucial to the return process. Donor support, through established
mechanisms, from the international community, and the FRY, is
key to the return process.

Property Rights
Fully recognizes the inalienable right to private property as one
of the cornerstones of a democratic society and reiterates the
firm determination to reinstall property to their legal owners
when this is not the case. Recalling the claim process till now,
UNMIK undertakes to improve the processing of claims.
UNMIK shall identify practical solutions for the implementation
of decisions made by the Housing and Property Claims
Commission and commits to the opening of offices in Serbia this
year and in Montenegro early next year in order to facilitate the
filing of claims by internally displaced persons. The claims
intake deadline will be prolonged to 1 December 2002.

Protection of Cultural Sites and Property
Confirms the will to apply the relevant provisions of the
Hague Convention (1954) regarding the protection of cultural
sites and property in Kosovo.

Judiciary
Recognizes that in order to address in an unbiased manner
issues related to inter- ethnic criminal activities, there is a
need to expand the number of international judges and
prosecutors within the Kosovo judiciary. UNMIK will double
the numbers of international judges and prosecutors within the
next six months, ensure the consideration of their use in serious
inter-ethnic criminal cases, and promote active cooperation
between the Kosovo judiciary, whether local or international,
and the Serbian and Yugoslav judiciary.
Confirms the commitment of UNMIK to the creation of a
multi-ethnic judiciary in Kosovo, which shall enjoy the trust of
all communities, and, to that end, agrees to the immediate
consideration for appointment of Kosovo Serb judges and
prosecutors within the Kosovo judiciary and to provide
adequate security for the proper discharge of their
responsibilities.
Reiterates UNMIK's commitment to ensure access to the
Kosovo courts by the Serb population and, to that end, UNMIK
agrees to immediately create and staff a new unit within the
UNMIK Department of Justice that will be responsible for
furthering efforts in this area by focusing resources and
personnel on issues of accessibility to the
courts and the employment of Serbs and other non-Albanians
within the Kosovo court system.
Affirms that there is a need to increase the number of
Kosovo Serbs employed by the Kosovo Correctional Service, and
to that end, UNMIK agrees to the immediate consideration for
employment of Kosovo Serb applicants within the Kosovo
Correctional Service.
Agrees that a joint working group including participants
from UNMIK and the Federal Republic of Yugoslavia will
review cases of serious crimes allegedly committed by Kosovo
Serbs, in which international judges and prosecutors did not
participate, in order to alleviate concerns of ethnic bias.
Confirms that the Kosovo Albanian detainees held within
the prisons and detention centers of the Republic of Serbia for
offenses that they are alleged to have committed in Kosovo
should, after a review of their cases according to international
standards, be transferred to Kosovo and the authority of the
UNMIK prison system as soon as possible.

Police Cooperation
Recognizes that the fight against crime and criminal
organizations is an area of mutual concern, particularly in the
areas of trafficking of drugs and women, money laundering and
smuggling of weapons and that it must be addressed through an
enhanced level of coordination and cooperation, which will
include the sharing of information relevant to criminals and
criminal organizations and regular monthly meetings of a joint
committee between UNMIK, the Federal Republic of
Yugoslavia and the Republic of Serbia.

Action against Terrorism
Undertakes, within the framework of police cooperation, to
combat terrorism destabilizing regional security and confidence
building efforts.

Development of the Kosovo Police Service
Firmly reiterates the commitment to continue to develop and
strengthen the Kosovo Police Service so that all communities
can confide in a professional, multiethnic and inclusive police
force, with the primary objective to serve and protect the rights
of all the people of Kosovo, and further commits to prioritize the
recruitment of more Kosovo Serbs, especially from the northern
part of Kosovo.

Multiethnic Civil Service
Commits to continue to develop a multiethnic and multilingual
Civil Service in Kosovo that shall be recruited from all
communities in order to reflect the multiethnic character of
Kosovo and which will be secured by implementing
non-discriminatory personnel policies in all areas and levels.
The Civil Service will meet high standards of accessibility,
equal treatment and professionalism and UNMIK confirms that
the representation of Kosovo Serbs shall be closely
proportionate at all levels to their representation in the
Assembly.

Local Government
Commits to promote increased Kosovo Serb participation in
the institutions and administration of Kosovo. UNMIK will also
delegate further competencies to the municipal level and
thoroughly reassess, and if necessary adjust, the Kosovo Serb
representation in each municipality, as well as the operation of
local community structures
in order to promote inclusiveness.

Education
Ensures that the Kosovo Serb community will have access
to education in their own language from primary school to
university. The educational curricula will make the Kosovo Serb
educational structures adequately compatible with the Serbian
education system and labour market requirements.

Information and Media
Undertakes to further develop the dissemination of
information, including from the FRY, and media targeted at the
Kosovo Serb community. This may include the establishment of
more independent TV and radio stations.

KOSOVO INSTITUTIONS' POWERS LIMITED
PRISTINA,Nov 6 (B92)- The UNMIK chief Hans Haekkerup
confirmed last night in Pristina that the Joint Document of
UNMIK and Federal Republic of Yugoslavia signed yesterday in
Belgrade clearly stipulates that the future temporary institutions
in Kosovo will not have the authority to proclaim the province's
independence.
However, he added that both the Belgrade agreement and the
UN Security Council Resolution 1244 are neutral in defining
Kosovo's future status, thus that no options are ruled out.
Haekkerup said that the international community and the UN
Secretary General Kofi Annan personally welcomed the signing
of the Joint Document.
Emphasizing that the Yugoslav President Vojislav Kostunica
and the Yugoslav and Serbian governments had decided to urge
the Kosovo Serbs to participate in the provincial elections,
UNMIK chief said the Belgrade democratic authorities deserve
to be praised for their cooperation that will have positive
influence on all ethnic communities in Kosovo

KOSOVO SERB LEADERS REJECT ELECTION
PARTICIPATION
GRACANICA, Nov. 5 (Beta) - Political representatives of most
Kosovo Serb organizations voted at a meeting in Gracanica on
Nov. 5 against participating in elections that will be held in
Kosovo on Nov. 17 despite recommendations issued by the
government in Belgrade and a joint document signed by UNMIK
and Yugoslav officials.
The boycott decision was made by Serb Resistance Movement
president Momcilo Trajkovic, Democratic Party vice president
Marko Jaksic, Socialist Party of Serbia regional chapter
chairman Dobrosav Radovic,
Democratic Party regional chapter chairman Zlatibor
Djordjevic, and Milan Ivanovic, an official representing Serbs
from northern Kosovo.
The meeting was not attended by representatives of the
Coalition for Return and Raska-Prizren diocese Bishop
Artemije of the Serb National Council of Kosovo and Metohija.
The Kosovo Serb leaders said: "We understand the state
leadership's recommendations, but the agreement between
UNMIK and Belgrade is unacceptable because it does not
guarantee even basic conditions for Serb participation in the
elections and, ultimately, separates Kosovo Serbs from Serbia
and Yugoslavia."
They said they hoped that the government in Belgrade and
representatives of the international community would not
pressure or blackmail Serbs to vote.

DOS LEADERS TO ENTER ELECTION CAMPAIGN FOR
KOSOVO ELECTIONS SOON
BELGRADE, Nov. 5 (Beta) - On the evening of Nov. 5,
members of the Kosovo Coordination Center didnot discuss the
list of candidates of the Coalition for Return, who will represent
Kosovo Serbs in the upcoming Kosovo elections. Still, they said
that the election campaign would be very short and very
efficient.
"All DOS leaders will be in Kosovo for the next two weeks,"
until the general elections in Kosovo, participants of the
meeting told BETA.
They said that the question of candidates for the Coalition for
Return was to be discussed at the next meeting of the Kosovo
Coordination Center, which could be held as early as Nov. 6.
According to earlier announcements, there should be 60
candidates on the ticket of the Coalition for Return.

AHTISAARI ON KOSOVO ELECTIONS
BELGRADE, Nov 5 (Tanjug) - Considering the dangerous
security situation of Kosovo Serbs and the lack of their freedom
of movement in Kosovo-Metohija, it is understandable why
many wonder if minimal conditions have been fulfilled for
forthcoming elections, the Belgrade daily Danas on Monday
quoted former Finnish president Martti Ahtisaari as saying.
Ahtisaari, who is also president of the international crisis group
managing board, said in an article published in this daily that
Kosovo Serbs feared they would victims of hostile repression by
ethnic Albanians once they returned home, and added that,
unfortunately, their fears were quite justified.
According to Ahtisaari, the elections are an opportunity for
Kosovo Serbs to confirm their role in the province's future and
to take part in its development.

Morto Di Giacobbe, presunta vittima sindrome Balcani

E' morto stamani nella sua casa di Ferrara, Corrado Di Giacobbe, 24 anni, il caporalmaggiore degli alpini malato di linfoma di Hodgkin che era stato in missione in Bosnia nel 1997 e nel
1998. Lo ha reso noto il maresciallo Domenico Leggiero, dell'osservatorio per la tutela dei diritti degli appartenenti alle forze armate e di polizia, l'organismo che per primo si è occupato
della cosiddetta 'sindrome dei Balcani'.
"Di Giacobbe, il cui caso è noto da tempo, aveva ricevuto solo una decina di giorni fa - spiega Leggiero - l'invito da parte della commissione Mandelli (che indaga sulla presunta
contaminazione da uranio impoverito) di presentarsi a Roma per una visita. L'appuntamento era fissato per l'11 novembre, ma non ha fatto in tempo".

Preminuo Di Djakobe koji je bolovao od posledica trovanja
osiromasenim uranijumom
("La Repubblica", rimski dnevnik, 6. novembra 2001.)

Prema saopstenju Domenika Ledjera iz Observatorije za zastitu prava
vojnih lica i pripadnika policije, u svom domu u gradu Ferara,
preminuo je jutros Korado Di Djiakobe, star 24 godine, po cinu visi
kaplar u sastavu Alpinaca.
Bolovao je od Hodgkinovog linfoma a u Bosni je boravio 1997. i 1998.
Mada je njegov slucaj odavno poznat, Korado je tek pre desetak dana
dobio poziv da svedoci pred Komisijom Mendeli. Trebalo je da se javi
11. novembra, ali je njegova smrt ocigledno preduhitrila pomenutu
Komisiju, zaduzenu da razmotri sve slucajeve gde postoji sumnja na
balkanski sindrom, odnosno na trovanje osiromasenim uranijumom.

Kosovo")

S.M.:
Quello che abbiamo appena ascoltato dimostra di per se che
l'imputazione è falsa ed è anche la prova che richiedeva il sig.
Robinson rispetto alla faziosità di quella imputazione falsa e del
Pubblico Ministero. E questo per due ragioni. Primo, c'è
un'intenzione precisa di invertire completamente i ruoli giocati
dalle due parti nel conflitto... [a questo punto il microfono viene
spento]

S.M.:
Questa imputazione è il secondo atto del crimine commesso contro il
mio popolo, perchè dichiara colpevole la vittima al fine di
proteggere i veri colpevoli per il crimine contro la Jugoslavia.
E' assurdo accusare la Serbia ed i serbi per la secessione armata
della Croazia, che ha causato una guerra civile, conflitti e
sofferenze per la popolazione civile.
L'imputazione vorrebbe addirittura negare che l'ex leader croato
Franjo Tudjman, che nel suo messaggio al popolo croato disse... [qui
il microfono viene spento]

S.M.:
Io chiedo che voi ripudiate il Pubblico Ministero per ovvie ragioni,
e ne citerò solo due.
La prima. L'abbiamo ascoltata ieri, forte e chiaro, che leggeva
l'imputazione sul Kosovo, che riguarda solamente fatti avvenuti dal
24 marzo alla fine della prima settimana di giugno, laddove, e questo
è il secondo punto, tutto il pianeta sa che è proprio dal 24 marzo
fino alla prima settimana di giugno compresa che la Nato ha commesso
la sua criminale aggressione contro la Jugoslavia.
L'imputazione e ciò che abbiamo udito implicano che la Nato non ha
commesso una aggressione contro la Jugoslavia, ma piuttosto che la
Jugoslavia ha commesso un'aggressione contro se stessa, e perciò le
conseguenze di 78 giorni e 78 notti di bombardamenti sulla
Jugoslavia, durante i quali sono state scaricate 22.000 tonnellate di
bombe causando un altissimo numero di vittime - questi non sarebbero
gli effetti della aggressione della Nato, ma piuttosto gli effetti
dell'aggressione che la Jugoslavia ha commesso contro se stessa.

Questa non è semplice faziosità. Faziosità è una parola troppo
tenera. Quello che abbiamo ascoltato oltrepassa persino ciò che
dovevamo ascoltare da parte del nemico, cioè dal portavoce della
Nato. Quindi è ovviamente un caso di ciò che potreste definire
faziosità totale.
SE la corte può rimanere cieca dinanzi al fatto che dal 24 di Marzo
fino alla prima settimana di giugno è stata commessa un'aggressione,
che il numero delle vittime è stato enorme, che 22.000 tonnellate di
bombe sono state scaricate e che si cerca di scaricare la colpa di
tutto questo sulla Jugoslavia come se essa abbia commesso questi
crimini contro se stessa e che si cerca di assolvere la Nato - ed io
credo che persino una corte illegale come questa debba considerare
questi fatti - se la corte non vuole prendere in considerazione
questi fatti, allora è ovvio che questa non è una corte ma solamente
una parte del meccanismo atto ad eseguire crimini contro il mio paese
e la mia gente.
Se quest'ultimo è il caso, se la corte non intende considerare
nemmeno una parzialità così sfacciata e vuole trascurare una
questione così cruciale come l'aggressione, così da non ripudiare il
Pubblico Ministero per come ha impudentemente presentato falsità e
per come parteggia con l'aggressore, se questo è il caso, e dunque se
la corte è parte dell'ingranaggio, allora per piacere, date lettura
ai verdetti che vi è stato detto di formulare e smettetela di
annoiarmi - facendomi ascoltare per ore testi scritti al livello di
un bambino di 7 anni; per essere più precisi: al livello di un
bambino di 7 anni ritardato. Non mi annoiate, leggete i vostri
verdetti.
Io credo che tutto questo fino ad ora sia stata una farsa. Se si
accetta quello che abbiamo ascoltato ieri, che la Jugoslavia avrebbe
commesso un'aggressione contro se stessa e che per quanto riguarda
questo procedimento non ci sono conseguenze per l'aggressione della
Nato,
tutto quello che segue è un circo.
Ecco perchè io suggerisco che voi formuliate i verdetti
immediatamente, per evitare tutti i problemi procedurali che avete di
fronte.

In secondo luogo desidero dirvi qualcosa ed avvertirvi. Desidero
avvertirvi che questi processi hanno una diretta influenza nello
scatenare il terrorismo nel sud della Serbia. Desidero avvertirvi che
in questi giorni, in queste settimane, in questi mesi terroristi
albanesi nel sud della Serbia tagliano gole, incendiano, stuprano,
picchiano, saccheggiano e fanno tutto quello che già usavano fare in
Kosovo e Metohija. A costoro è stato prestato il fianco perchè,
diversamente dall'attuale amministrazione americana che ha dichiarato
la sua opposizione al terrorismo, l'amministrazione precedente era
alleata del terrorismo.
Sapevano che Osama Bin Laden era in Albania 2 anni dopo aver
distrutto le loro ambasciate.
Hanno persino parlato con me di questo fatto, incontrandomi insieme
ai miei collaboratori.
Perciò, per cortesia non alimentate il terrorismo nel sud della
Serbia, perchè lì la gente soffre troppo.
Voi dovreste anche tenere a mente che a causa di quel terrore e sotto
l'avallo delle Nazioni Unite 330.000 persone sono state espulse da
Kosovo e Metohija. 330.000, soprattutto serbi, con l'avallo delle
Nazioni Unite.

GIUDICE MAY:
Abbiamo ascoltato e saremo molto felici di ascoltare se c'è qualcosa
che avete da dire riguardo al vostro stato fisico e mentale.

S.M.:
Quindi adesso devo limitare i miei commenti solo a questo, giusto? Ok.
Allora desidero chiedere alla corte, poichè ho sentito che la parte
avversa insiste che non ho "privilegi" sulla velocità del processo,
per cui mi pare di capire che il vostro piano è che il processo duri
più o meno tre anni, lasciate almeno che io non sia discriminato dal
punto di vista del trattamento.
Quindi richiedo che le telecamere siano rimosse dalla mia cella, e
che la smettiate di tenere presenti i vostri funzionari durante le
visite dei miei familiari.
Le giustificazioni per le telecamere nella cella sono prive di senso.
Viene detto che le telecamere servono ad impedirmi di commettere
suicidio. Voglio dichiarare qui dinanzi a questa corte che io non mi
suiciderei mai, prima di tutto perchè non voglio fare questo ai miei
figli e alla mia famiglia, di renderli i figli di uno che si è
suicidato.
In secondo luogo non mi suiciderei mai perchè devo combattere qui,
per distruggere questa corte, questo processo-farsa e quelli che lo
hanno messo in piedi, che usano questa corte contro quelle persone
che lottano per la libertà nel mondo.
Perciò cortesemente rimuovete le telecamere ed in funzionari, perchè
la regola secondo cui le telecamere possono rimanere installate per
un mese viene adesso abusata da 4 mesi, senza alcun motivo, abusando
della regola che parla di un mese solo perchè avete il potere di
farlo.
Questo è ciò che richiedo, di non essere privilegiato ma di non
essere nemmeno discriminato, almeno da questo punto di vista. Per

Gli ecologisti di Novi Sad avvertono il pubblico della minaccia
derivante dal pericolo dell'inquinamento dell'acqua potabile, a causa
della presenza di sostanze nocive che sono la conseguenza del
bombardamento della NATO sulla "Raffineria di Novi Sad".
Allo stesso tempo, dall'"Acquedotto di Novi Sad" fanno sapere che la
città di Novi Sad potrebbe rimanere senza acqua potabile. Come rende
noto l'inviato di Radio B-92, nella vicinanza immediata della
Raffineria si trova una sorgente da cui i cittadini di questa citta'
ricevono il 60% del fabbisogno dell'acqua potabile.
Il direttore del Movimento ecologico di Novi Sad, Nikola Aleksic,
dice che ci vogliono due, al massimo tre anni per l'infiltrazione
delle
sostanze inquinanti nel deposito dell'acqua potabile. Secondo le
affermazioni degli esperti dell'"Acquedotto di Novi Sad", è già in
atto un certo modesto inquinamento, ma con il cambiamento del
Regolamento sulle quantità permesse delle sostanze nocive,
quell'inquinamento si
e' inserito nelle norme previste dalla legge. Secondo le parole di
Aleksic: "la città non ha fatto niente per impedire l'irruzione delle
sostanze nocive. E' stata solo seguita la situazione, ma senza
predisporre la "tenda idraulica". Se la città perde questa sorgente
importante, non l'avrà mai più, e Novi Sad avrà sempre sete" -
conclude Aleksic.

The Hague, 30th October 2001

SLOBODAN MILOSEVIC:

I demand that you disqualify the prosecutor for obvious reasons, and I
will mention only two. First, we heard her yesterday, loud and clear,
reading the indictment concerning Kosovo, which only deals with events
from the 24th of March until the end of first week of June, when,
second, the whole planet knows that it is exactly from the 24th March
until the first week of June, inclusive, that NATO committed its
criminal aggression against Yugoslavia.

The indictment and what we have heard implies that NATO did not commit
aggression against Yugoslavia, but rather that Yugoslavia committed
aggression against itself and therefore the consequences of
seventy-eight days and seventy-eight nights of bombing Yugoslavia, in
which 22,000 tons of bombs were delivered causing huge number of victims
- these are not effects of any NATO aggression, but instead are the
effects of the aggression Yugoslavia committed against itself.

This is not simple partiality. Partiality is too mild a word. What we
have heard surpasses even what we used to hear from the enemy side,
i.e., from the NATO spokesman. Thus, it is obviously a case of what you
would call total partiality. IF the court is able to remain blind to the
fact that from the 24th of March to the first week of June aggression
was committed, that the number of victims was huge, that 22,000 tons of
bombs was delivered and that an attempt is being made to blame all this
on Yugoslavia as if it committed these crimes against itself and to
absolve NATO - and I think that even such an illegal court must take
into account these facts - if the court does not want to take into
account these facts, then it is obvious this is not a court, but only a
part of the machinery for the execution of crimes against my country and
my people.

If the latter is the case, if the court s would not take into account
even such flagrant bias and would disregard such a crucial matter as the
aggression, so as not to disqualify the prosecutor for impudent
presentation of untruth and for siding with the aggressor if that is the
case, and therefore, the court is part of the machinery, then, please,
read the verdicts you have been instructed to reach and stop bothering
me - making me listen for hours to texts written at the level of a
seven-years old child; to put it more precisely - a retarded seven-year
old child. Do not bother me, read your verdicts. I think all of this up
to now has been a farce. If what we heard yesterday is accepted, that
Yugoslavia committed aggression against itself and that there are no
consequences of the NATO aggression as far as the prosecution is
concerned, all that follows would be a circus. That's why I am
suggesting that you reach the verdicts immediately
so as to avoid all the procedural problems you are facing.

Second I wish to tell you something and to warn you. I wish to warn you
that these trials have a direct influence on inducing terrorism in the
south of Serbia. I wish to warn you that these days, these weeks and
months Albanian terrorists at the south of Serbia are cutting throats,
setting the fires, raping, beating up, plundering and doing everything
else they used to do in Kosovo and Metohia. They were given wings
because in distinction to the current American administration that has
declared an antagonistic position regarding terrorism, the previous
administration was in alliance with terrorism. They knew that Osama bin
Laden was in Albania two years after he demolished their embassies. They
even commented on that fact when meeting with me and my associates. So,
please do not induce terrorism in the south of Serbia because people
there are suffering too much. You should also
bear in mind that because of such terror and under the Untied Nations
auspices 330,000 persons were driven from Kosovo and Metohia. 330,000
mainly Serbs under the auspices of the United Nations.

JUDGE MAY:

We have heard that and we would be very glad to hear what you have to
say, whether there is something you wish to say regarding your physical
and mental state. [Note this is an English retranslation from the
Serbian.]

SLOBODAN MILOSEVIC:

So, now I have to limit my comments only to that, is that it? OK.

Then I wish to request of the court, since I have heard that the
opposite side insists that I have no 'privileges' in regard to an
expeditious trial, so that I understood your plan is to have the trial
last some three years, let me at least not be discriminated against in
respect of treatment.
Therefore I request that cameras be removed from my prison cell, and
that you cease to have your officials present when my family visits. The
Explanations for cameras in the cell are senseless. It is explained that
cameras are needed to prevent me from committing suicide. I wish to
declare here in front of this court that I would never commit suicide
because first of all I do not want to do that to my children and my
family, to make them children of one who committed suicide.

Secondly. I would never commit suicide because I have to fight here, to
destroy this court and this mockery of a trial and it's employers who
are using this court against persons fighting for freedom in the world.

Thus, kindly remove the cameras and the officials, because the rule,
that cameras could be installed for one month is being abused for 4
months now without any reason, misusing the one month rule because you
have the power to do it.

That is what I am requesting, not to be privileged, but not to be
further discriminated against, at least in that respect. As far as
monitoring of other meetings, taping of telephone conversations, etc.,
that you ordered, that's your problem, you may continue to do that.
After all, when my family is here your officials don't have to be
present - you may eavesdrop, even without their presence, so I would ask
you to free me of this unpleasantness as much as possible.





The Hague, 29th October 2001, Afternoon

SLOBODAN MILOSEVIC (after the reading of the "Kosovo indictment" ):

What we have just heard shows by itself that the indictment is false and
it is also the proof that Mr. Robinson asked for in relation to the bias
of that false indictment and of the prosecutor. And that is for two
reasons.
First, there is a total intention to completely switch the roles played
by the two sides in the conflict... (At this point the microphone was
turned off)


SLOBODAN MILOSEVIC (after the reading of the "Croatia indictment"):

This indictment is the second act of the crime committed against my
people, because it proclaims the victim to be the culprit in order to
protect the real culprits for the crime against Yugoslavia. It is absurd
to accuse Serbia and the Serbs for the armed secession of Croatia that
caused civil war, conflicts and sufferings for the civilian population.
The indictment even attempts to refute the late Croatian boss Franjo
Tudjman who in his message to the Croat people said... (The mike was cut

Did CIA made a wrong move by making a web of Bin-Laden's terrorists in
Albania, Bosnia, Macedonia and Kosovo&Metohia?

Holbrook's "chat" with Albanian terrorists in Junik paid by Tachi and
directed by Osama Bin-Laden

The World most famous terrorist has not agreed to be for the American
single-use, since the "Balkan heroin cake" is too worthy to renounce
to it just like that - The German Intelligence Services estimated to 1,5
billion dollars per year the profits from sales of heroin in
Kosovo&Metohia - Who has been not shot by cameras while shoeless Richard
Holbrook "chatted" with terrorists



Gracanica: The web of Bin-Laden's terrorist organization Al Khaida
branches in the Balkans is far more spread and much stronger rooted than
high CIA officials think (that is - affirm and officially state), since
they obviously miscalculated when, for the sake of the too ambitious
American plans in this region and further towards Asia, actively helped
to connect Bin-Laden with terrorist organizations in Bosnia, Macedonia,
Albania and Kosovo&Metohia. Namely, Bin-Laden never accepted the
American "logic" of "single-use" operation, since the "Balkan heroin
cake" is too sweet and worthy for the "America's enemy No. 1" to
renounce to it just like that.

A million dollar worth taking-off of shoes: The trails of heroin are at
the same time trails of terrorism, that go across in Macedonia, Albania
and Kosovo, while the road-toll is paid in human lives. Regardless how -
from a needle or a bullet. Exclusively found out by "Jutarnje novine",
the German intelligence services have reliably estimated that in
Kosovo&Metohia the year criminal profits out of heroin sales go to 1,5
billion dollars, and that this is the main source of financing the
Bin-Laden and Tachi's terrorist organizations in the southern Serbian
province! - The Albanian terrorist KLA, by using money from heroin for
bribing leader figures and journalists of the most influential World TV
stations and news agencies, has created a media
campaign according to its needs, and with money from heroin literally
are being bought the most famous names of the World political scene.
Before the bombing of Yugoslavia, Richard Holbrook has cashed in a
million dollars from these funds for the public visit to the Albanian
terrorist base in the Metohian border village Junik, where he has,
before the cameras of the most followed World TV stations in his socks
and legs-crossed, "chatted" with Tachi terrorists. In this Albanian
terrorist base were present also several tens of (invisible to cameras)
Bin-Laden mujaheddins, arrived to Kosovo&Metohia through neighboring
Albania. - Being in Kosovo&Metohia during NATO aggression,
Bin-Laden was not only busy directing joint terrorist actions of KLA
members and mujaheddins, that were completely coordinated with NATO
aviation attacks on Yugoslav Army positions.
That particular stay in the province Bin-Laden used for the purpose of
flaring up war in Macedonia, where he easily succeeded in persuading,
with a convincing dollar sum as well, the most influential local
Albanian separatist and terrorist leader Arben Dzaferi. This was
confirmed as well by the discovery of a secret bank account of the of
this former TV Pristina journalist, which account has been fed, on a
command of Bin-Laden, with almost a million dollars by a "good fairy"!

Mesud Jakupi - A Connection to Macedonia: Meanwhile, as "Jutarnje
novine" found out from foreign intelligence and other sources, the main
Bin-Laden's liaison person with terrorist groups in Macedonia and
Kosovo&Metohia is a certain Mesud Jakupi. With heroin money, of course.
Jakupi organized the armament of the Albanian terrorist Liberation
National Army in Macedonia, but also of the Albanian terrorists in the
Bujanovac, Presevo, Medvedja area. According to our sources, during the
NATO bombing campaign Jakupi was seen in Albania, where at the time of
the 1997 armed rebellion (also according exclusive "Jutarnje novine"
information), beside over 800.000 rifles, more than 100.000 blank
passport have disappeared, which is one of the major reasons of
Bin-Laden's interest for the "land of bunkers". - Few years ago a quite
unnoticed agency news went through the air, the one saying that a guy
called Suleyman Mohammed El Said (married to an Albanian woman) got
killed in Tirana in a shootout with the police. That news has never
included, however, a key data that this man was one of the major figures
of Al Khaida and that he took part not only in the fights in
Afghanistan, but also in the bomb attacks on American embassy in
Africa.

A Frenchman as a front: Most probably not to raise any suspicions,
Bin-Laden for the bosses of Al Khaida's Balkan branches is choosing not
only Albanians and Islamic countries' citizens, but Europeans as well,
whose citizenship (in the beginning, at least) represents a solid front
for a relatively easy forming and engaging of terrorist organizations
and groups in the Balkans. - That's how Claude Cadert, a French citizen,
arrived to Tirana on Bin-Laden's command, and received quite substantial
and "earned" on heroin means for the recruitment of new KLA members
among criminals and murderers of Albania. The KLA in its terrorist
actions is also assisted by almost 600 mujaheddins in Tropoja and
Podgradec in Northern Albania. For their transfer to the territory of
Kosovo&Metohia, about 70 Albanian terrorists under the command of
mujaheddin warlord Sheik Mohammad Adalby (codename: Abu Al Abbas), are
acting almost without obstacles and staying in the border villages Meja
and Orize, where NATO aviation had bombed a convoy of Albanian refugees
killing almost 80 children, women and elderly people (and the same
number of Albanian civilians in the village of
Ljubizda near Prizren). - In this area, beside the Albanian terrorist
commander Suleyman Selimi called "Sultan", with whom Claude Cadert is in
permanent contact, foreign intelligence services keep mentioning, as a
very important connection between Bin-Laden and the KLA, the Islamic
Charity (Mercy International relief Agency). And, "in the end", the name
of former French pupil and president of Albania, Sali Berisha, is
mentioned as a very active individual within the activities of KLA and
Al Khaida. Berisha's huge role in strengthening terrorism in the Balkans
is very well known to American and other intelligence services, which
until Bin-Laden's attacks on USA have acted in a rather friendly way
towards that terrorism.

Innanzitutto, io non sottopongo nessuna memoria a questo Tribunale
perche� non lo riconosco. Se voi ritenete che quello che sto dicendo a
questo microfono si puo� considerare come una memoria, e� un problema
vostro.

In secondo luogo : rispetto a questi �amici curiae� [avvocati
d�ufficio], io ho capito che la vostra motivazione quando li avete
nominati era di contribuire ad un processo nel rispetto del regole,
sempre che si possa parlare di rispetto delle regole nell�ambito di un
simile procedimento illegale. Ritengo che con questo abbiate
incrementato il novero dei nuovi concetti, visto che cosi� adesso, in
questa situazione nella quale due team lavorano entrambi per la stessa
parte, si puo� parlare del �rispetto delle regole secondo l�Aia�. E per
quanto riguarda questa alluvione di nuovi emendamenti ed imputazioni,
essa non puo�, questa alluvione non puo� sommergere la verita�, che e�
nota a milioni di persone.

Io qui ho sentito, come ho sentito anche la volta scorsa, che c�e�
preoccupazione perche� io non leggo la documentazione su queste
incriminazioni fasulle, perche� a quanto pare dovrei sapere di che cosa
vengo accusato. Desidero dirvi che io so benissimo il perche� sono
messo sotto accusa : sono accusato perche� con mezzi legali e metodi
legittimi, in base al diritto di autodifesa che appartiene ad ogni
nazione, ho difeso il mio popolo. Ho avuto l�onore di difendere il mio
popolo dalla aggressione criminale attuata contro di esso, e di
difendere il mio popolo dal terrorismo con il quale la amministrazione
di Clinton ha strettamente collaborato, cosa che nessuno puo� confutare.

La verita� non si puo� sommergere con nessuna alluvione di accuse
mendaci. Ed io continuo a non avere intenzione di conoscere il
contenuto di qualcosa che e� assolutamente artificioso e lontano dalla
verita�.

Per quanto riguarda la polemica che ho qui ascoltato, su chi sarebbe
competente e se qualche governo abbia dovuto fare qualcosa prima di un
altro governo, mi meraviglio che anche l�avvocato di Belgrado,
componente degli �amici curiae�, si esprima in merito a chi sarebbe
competente, dimenticando che nessun governo poteva avere la facolta� di
stipulare accordi infrangendo la Costituzione della Serbia e quella
della Jugoslavia.

Mi fa piacere che i signori �amici curiae� siano consapevoli del fatto
che non possono parlare a mio nome, e che io con loro non ho niente a
che fare.

I ONLY DEFENDED MY PEOPLE FROM TERRORISM ALLIED WITH CLINTON

(transcript of the statement of president Slobodan Milosevic in the
Hague "court room" on October 29, 2001 in the morning - final correct
version)

SLOBODAN MILOSEVIC:

First of all, I do not submit any motions to this court because I do not
recognize this court. If you consider what I say at this microphone a
motion, that is your business.

Secondly, regarding amici curiae, I understood your explanation when you
appointed amici curiae, that their appointment should contribute
towards a fair trial, if in fact in such an illegal procedure it makes
any sense to even mention the term "fair trial". I think that by this
appointment, a collection of new concepts is enriched. This situation
where two teams work for the same purpose may now be named The Hague
Fair Play. As far as this flood of new amendments and indictments is
concerned, it cannot drown the truth because the truth is known to
millions of people.

I have heard here, as on the previous occasion, expressions of concern
because I do not read the documents from this false indictment;
supposedly, I should learn what for I am accused of. I would wish to
state that I know very well what I am accused of. I am accused because
I defended my people, in a legal manner and by legitimate means, on the
basis of the right of self-defense that belongs to every nation. It was
my honour and privilege to defend my people against the criminal
aggression committed against it and to defend my people against the
terrorism with which Clinton's Administration closely co-operated,
something no one would be able to deny.

The truth may not be drowned by any flood of false indictments. I do not
have any intention of getting acquainted with the contents of something
that is completely fabricated and very distant from the truth.

Regarding the discourse I have heard here on the issue of who was the
appropriate authority and whether some government should have done
something before some other government, I am amazed that even the
lawyer from Belgrade, a member of the amici curiae, speaks on issues of
authority, forgetting that no government could have the authority to
enter into any deal that would violate the Constitution of Serbia and
the Constitution of Yugoslavia.

I am glad that the gentlemen from the amici curiae are aware that they
may not speak on my behalf and that I do not have anything to do with
them.

Postovani gospodine premijeru,

Krajem juna ove godine u Hag, gde je smesten Medjunarodni
tribunal za bivsu Jugoslaviju, iz Beograda je bio isporucen raniji
predsednik Savezne Republike Jugoslavije Slobodan Milosevic. Zbog
okolnosti pod kojima je nasilna isporuka Slobodana Milosevica iz
Beograda u Hag izvrsena, prinudjeni smo da na taj cin gledamo kao na
zlocin. I vise drugih okolnosti su takodje sporne.
1. Ustav Jugoslavije direktno zabranjuje izrucenje svojih
gradjana stranim drzavama. Nadnacionalni karakter haskog tribunala ne
menja sustinu stvari, jer se "tribunal" nalazi na teritoriji strane
drzave - Holandije. Zbog toga je "izrucenje" Slobodana Milosevica u
stvari otmica - jedan od najtezih zlocina, koji se goni po zakonima
svih civilizovanih zemalja.
2. Cinjenica da su narucilac i izvrsilac te rabote sluzbena
lica - tuzilac tribunala g-dja Karla del Ponte i premijer Srbije g.
Zoran Djindjic - ne oslobadja ta lica od odgovornosti za krsenje Ustava
Jugoslavije i Srbije. Ocigledno je da i vlada Holandije takodje nosi
odgovornost za protivzakonito drzanje u pritvoru u Hagu ranijeg sefa
jugoslovenske drzave.
3. Haski "tribunal" je stvoren krsenjem Povelje UN, koja ne daje
pravo Savetu bezbednosti da stvara sudske organe, i zbog toga je ovaj
tribunal nelegitiman. Taj stav zastupa veliki broj pravnika sa
medjunarodnom reputacijom, kao i grupa profesora Pravnog fakulteta
Beogradskog univerziteta, koji su podrobno analizirali nacin stvaranja
ovog organa.
Iz recenog proizilazi da se na teritoriji Holandije nezakonito
drzi u pritvoru raniji predsednik Jugoslavije Slobodan Milosevic, kao i
da na istoj teritoriji deluje nezakoniti sudski organ, stvoren krsenjem
medjunarodnog prava.
4. Holandija je jedna od zemalja - clanica NATO, koja je
ucestvovala u agresiji protiv Jugoslavije protivno Povelji UN. Verujemo
da cete se sloziti da drzanje Slobodana Milosevica u pritvoru upravo u
Holandiji, zbog toga dobija za samu Holandiju posebno neprijatan
kontekst.
5. Predmet g. Slobodana Milosevica je u trenutku njegove otmice
pripreman za razmatranje na beogradskom Okruznom sudu. Otmicom je stoga
naruseno i pravo jugoslovenske drzave da nastavi ovaj sudski proces, a
takodje i pravo Slobodana Milosevica na odbranu.
Polazeci od svega navedenog zahtevamo neodlozno oslobodjenje
otetog u Beogradu i nezakonito zadrzavanog u pritvoru na teritoriji
Holandije ranijeg predsednika Savezne Republike Jugoslavije Slobodana
Milosevica.
